UPND President Hakainde Hichilema has described the re-election of President Edgar Lungu as a coup on Zambia’s democratic process.
Mr Hichilema said the will of the people has been changed in an illegal and undemocratic way.
He has since announced that the UPND will file a petition in the constitutional court to challenge President Lungu’s victory.
Mr Hichilema disclosed this during a press briefing this evening.
“Firstly we wish to thank our supporters from the bottom of our heart. We are truly grateful for your support, hard work and dedication throughout the election period. Today the PF has effected a coup on Zambia’s democratic process,” Mr Hichilema said.
“The will of the people has been changed in an illegal and undemocratic way. We submitted evidence before the declaration of the results regarding the gross irregularities that have taken place,” he said.
Mr Hichilema said in any free, fair, transparent and democratic system this would have been enough to prompt a recount in the affected areas but that Zambia no longer operates that way.
“The ECZ has taken the decision away from the people. Zambians made their decision on Thursday. That decision has not been respected. During these delays the PF have acted with impunity to change the result,” he said.
Mr Hichilema said the UPND team endured countless obstacles and perversions of democracy throughout the campaign period and that it cannot now accept the manipulation of the vote itself.
“That is why we will not accept the result. We will be launching a Constitutional Court petition on the basis of the evidence we have collated and presented to the ECZ,” he said.
“As the Constitution sets out, once we have launched our petition then there must be no inauguration until the matter is settled in the court. This is according to a provision in the new Constitutional Amendment Bill that Edgar Lungu himself assented to just a few months ago.”
He said the independence of the ECZ has been compromised, after coming under pressure from the PF.
“We will now place our faith in the Constitutional Court, in the people of Zambia.”
He said the grounds on which the party will launch the petition are many, but they include the withholding of G12 forms from UPND’s polling agents in order to enable tampering with the results in favour of the PF.
“Without authenticated certificates for the stations there is no validity in the totalling process. The ECZ itself acknowledged this fact, agreeing to a verification and recount of votes in Lusaka district and the formation of a task team to oversee the process just yesterday afternoon, before the decision was later reversed under pressure from the President Lungu,” he said.
Mr Hichilema also cited the intimidation of party agents at polling stations during the counting process, whereby PF supporters physically kicked them out before having uncontrolled access to the ballot boxes.
“Discrepancies in the vote count and the result issued by the totalling centre, for example the case of the 14,039 missing UPND votes in Kanyama that were later found in the bin. Once these were input our vote went from 17,985 to 32,024. Even after this, however, the ECZ announced a figure of 30,892. We are compiling a list of other such instances to present to the courts.”
“Instances where a higher number of votes were cast than registered voters. For example, at Kamanga polling station in Munali constituency where there were 714 more votes cast than registered voters. The discovery of pre-marked ballot papers outside of ZAF HQ in Lusaka as late as Sunday morning,” he said.
Mr Hichilema said the UPND has specific evidence of gross irregularities in a number of constituencies, including all of the Lusaka urban constituencies, namely Kanyama, Munali, Chawama, Mandevu, Lusaka Central, Matero and Kabwata.
“If we fail to stand up for our democracy today then we undermine our prospects for peace and development in the weeks, months and years to come.”
“Finally, we call on Lungu to stop brutalising our supporters. Across the country’s markets, bus stops, taxi ranks and their work places our supporters have been victimised. This must stop right now. Zambians have a democratic right to vote for a leader of their choice. We will not return to a one-party state. We have come a long way and now is not the time to give up. We don’t give up,” he said.
“To our members, our supporters and our sympathisers, I thank you once again. I am asking you to remain united. I am asking you to hold each other’s hands and support one another because we need you now more than ever.”

IF PF are so confident that they won the elections legally why don’t they let it go to court, allow the recounts and then become the true and trusted winners. The voters turned up and expressed themselves in their strongholds. Chitulika Constituency gave ECL 33,477 and HH 89 votes. This was followed by a reply from Dundumwezi giving HH 30,000 and ECL 200.
Lungu and PF have nothing to worry about if they won this election on the platform of the international standard of ‘free and fair’. The election petition will have to show prevalent incidents of:
1. vote buying and/or corrupt practices
2. uneven campaign space through denial of police permits and blackout by public media
3. unmatched votes ‘cast’ compared to register
4. mirror of combined mp votes with presidential vote
5. voter intimidation…

President elect did not constitutionally qualify to be winner. There is information circulating that The ECZ errored in declaring him winner when he only attained 49.2% of the toal VALID votes. The ECZ used a wrong figure which included spoiled ballots to calculate the percentage.
Suffice to say if you visit the new constitution website, 50+1 is based on the total VALID votes cast. I hope the Constitutional Court will look at the matter in that regard too.
@Abene, your argument does not make sense. You’re saying that the percentage of the votes cast for a candidate reduces if the total number of votes reduces to include only valid votes? Have you actually done the math? The relationship is supposed to be inverse & not converse. The base # is indeed VALID votes but you’re using the wrong principle. Total valid votes is 3,695,710 & President got 1,860,877. Try the math again sir & you’ll find ECZ is accurate.

My comments yesterday are vindicated again today. If this commentary board is anything to go by, no wonder Zambia continues to be in this mess. Are people so obessed with their political affiliations that they fail to realise that they are firstly Zambians. It does not take a genious to know that these elections where rigged. If ballots can be found in the bin and then accepted by the ECZ as valid and added to a political party, the question is what else happened. It is our right as citizens to have free and fair elections regardless of who wins. Just look at South Africa, the IEC is so independent that when results are released they is no cry of fraud (That might change now that those in power are losing), that is what we need in Zambia. If we as Zambians continue to allow those in power…

Those riots going on in southern province simply show that people did not vote for quality leadership. They voted on tribal lines. Somehow this is the kind of situation that brought about genocide in Rwanda. I say Congrats Edgar Lungu and to HH I say it is not over till God himself says it is over.

This calculation does not include spoiled votes which is the right computation as per constitutional requirement.

HH and UPND, when the wind of change knocks on the door, no one can stop it. Who is ECL to stop a revolution? Pause and think what happened to KK in 1991, could anyone stop change? It was a tsunami; it was not even possible to think about rigging. History repeated itself 20 years later when again in 2011 a tsunami swept RB and MMD out of power. There was no starting point for rigging, a landslide victory is a hallmark of a revolution and is not possible to rig. When a revolution arrives, it does not happen in 3 provinces only, it extends from Chavuma to Chadiza and Sesheke to Mwenzo, all corners of Zambia. Let’s just go back to the drawing board and prepare for a revolution in 2021.

There is a claim that the ECZ website is down due to maintenance being carried out. In the meantime, a re-calculation of the final tally of VALID votes cast, as given by the ECZ itself, shows that Lungu obtained 49.21%. Does the shutting down of the site have anything to do with this? Some vote searches or re-calculations going on behind the scenes? I can’t help being cynical as these elections, for all intent and purposes have been a farce.

Yes ECZ made errors in their calculations ONLY in areas where PF won, where UPND won with wide margins then the same ECZ was somehow a very efficient and trustworthy organisation!

ECZ needs to employ educated Zambians who can do simple grade 12 mathematical calculations in percentages. ECZ have shut their website after announcing wrong figures that declared Lungu a president (?).
Please help me with this ECL scored this 1,860,877 and HH scored 1,760,347 total number of votes cast 3,781,505 in percentage terms ECL 49.21% and HH 46.55% what’s meaning of 50% plus 1 was not attained.
Democracy is an ugly animal but must be obeyed by all. Lungu did not win this election. Will see if the constitutional court has any balls to show or are under the powerful influence of the president. I for one dont care who wins as long as long the law we have is followed.

HH has achieved what Anderson Kambela Mazoka failed to achieve; that is to get over 50 MPs. He put up a spirited campaign but the Zambian people did not trust him enough with power. There are several reasons but those will be discussed in another forum on another day. In a tightly contested election, it is unnecessary for HH to go court and begin opening wounds which are healing. For ALL the elections Sata lost between 2001 – 2008, he never contested them in a court of law. General Miyanda contested every case. Sata went right back to campaign, mobilise and strategize and it all paid back in 2011.
