FODEP says Serious Errors were made in vote tallying for the Presidential Election

In a statement released to the media today and signed by the president Shepherd Chilombe, FODEP said that their monitors reported that cadres of a named political party stormed St Patrick’s Basic School polling station in Kabwata constituency, chased party agents and got away with ballot boxes.

In Kanyama constituency in Lusaka, FODED said that they received reports that 14,000 votes meant for the UPND presidential candidate were stuffed into the bin and had to be retrieved and added to the Kanyama total after intervention from the UPND Lusaka mayoral candidate.

FODEP said that they also observed a serious discrepancy in the totalling of the presidential votes by the ECZ.

Citing Lundazi Central constituency, FODEP said that the results announced by ECZ showed that PF candidate Edgar Lungu obtained 29,979 and UPND candidate Hakainde Hichilema got 4,975 bring the total to 34,954. However, the number of votes cast was 29,741. These kind of errors in computation of results appear to have been widespread.

Post-Election Statement

The Foundation for Democratic Process (FODEP) wishes to congratulate the Zambian people for turning up in large numbers to vote in this years’ general election. The national turnout of 56.4 percent and up to 78 percent in some constituencies shows that citizens took their civic duty seriously. Taking place under a new Constitution and new electoral laws, the election posed daunting challenges to the Electoral Commission of Zambia (ECZ) and in some cases to voters as well.

We wish to congratulate all candidates and political parties for participating in the elections and specifically those who were elected to various positions as councillors, mayors or council chairpersons and members of parliament. We also wish to congratulate and thank co-operating partners, monitors and all stakeholders for their contributions to the elections.

Specifically, FODEP wishes to congratulate His Excellency President Edgar Chagwa Lungu for emerging winner in the highly contested election and his running mate Ms Inonge Wina.
We also congratulate the UPND and their candidate Mr Hakainde Hichilema for providing a strong challenge to the PF during the elections.

FODEP joins the nation in wishing the elected officials success in their new responsibilities and hope that they will not betray the trust bestowed on them by the electorate. Elective office calls for accountability and all those elected should know that they will be made to account at the next elections.

FODEP deployed 5,090 monitors on the day of elections, covering 60 percent of all polling stations. We were in all 10 provinces, 74 districts and 96 constituencies. Our broad coverage across space and throughout the election process enabled us to get a comprehensive picture of the electoral environment and the conduct of the poll.

The Election Day was generally peaceful in most parts of the country, with voters turning up early, sometimes as early as 02:00 hours in the morning. On the whole, voters were peaceful, orderly and patiently waited in queues for their turn to cast the votes. There was evident enthusiasm from first time voters, as majority of the voters in queues were young.

The election was held against the backdrop of inter-party violence, intimidation of opposition leaders, lack of professionalism by the police in dealing with public protests and widespread acts of bribery.

Election Day was not without incident. For instance, there were reports of violence on Election Day in Itezhi Tezhi, involving political party supporters. FODEP condemns all acts of electoral violence as they work against participation of citizens in the electoral process. Violence in any form goes against our values and should be condemned by all peace-loving Zambians. We are glad that the Police effectively dealt with such situations.

FODEP notes that while the Election Day was by and large peaceful and voting went on smoothly, there were reported cases of incompetence and inefficiency in many cases by electoral officials, which resulted in the disenfranchisement of voters in a number of polling stations across the country.

We are also concerned at the inefficiency that characterised the result management process, where the vital GEN12 Form caused tension. In some polling stations, the GEN 12 form was not available for endorsement by stakeholders, while in in some cases, it was not signed by monitors.

While we appreciate the scale of the work that had to be done on Voting Day, FODEP is of the view that the ECZ had adequate time to prepare to ensure that voting and counting were handled competently to minimise complaints and ensure credible results. We are aware that recounts were demanded in some polling stations and at totalling centres, suggesting errors by polling staff.

In addition to the broad observations made above, FODEP wishes to note specific incidences including the following;

(a) Late opening of polling stations

Despite long and adequate preparations and training of polling staff by ECZ, several polling stations opened late, ranging from 30 minutes to 9 hours in some polling stations. Some polling stations opened after 10:00 hours and others after 12:00 hours. The main reason for late opening was attributed to either late arrival of poll officials or of election materials. One centre where voting started late is at Kama primary school polling station where voting started at 12:00 hours. Lulambo polling station in Kaoma district opened at 11:00 hours due to late arrival of polling officials and materials arising from the breaking down of the vehicle they were using.

(b) Late voting

In two polling stations, one in Sioma and the other in Katombola constituency of Western and Southern provinces respectively, voters were made to vote late due to late delivery of election materials, including ballot papers. At Kalongola ward in Sioma District voting started at 06:15 but the process went on until 11:45 hours the next day. This was because of inertia and delays by polling staff. In Katombola Constituency, voting started at 15:00 hours. While ECZ extended voting in those two areas, turnout and the security of the vote may have been seriously compromised by voting at night.

(c) Interruption of voting

There were strange incidents involving electoral officials interrupting voting by either closing for lunch or stopping voting because ink pads had run out and were consulting as to what they should do next. Our monitors noted that at Ngwelele Polling in Mandevu Constituency the ECZ delivered poor quality ink stamps that broke down immediately voting started. In Mongu Central at Namauna polling station in Yeta Ward, Western Province, our monitors noted that voters forced themselves into the polling station because of the large number of people who had gathered to cast their votes. The impatience arose because of the slow pace at which the voting process was progressing. The police failed to maintain order for a long period before calm was restored. This may have resulted in vote stuffing in the midst of confusion. In Senga Hill constituency, Northern Province suspected UPND cadres stoned PF candidate Kapembwa Simbao’s vehicle smashing the wind screen.

(d) Turning away voters and disenfranchisement

There were several incidents where female voters were wrongly turned away because they had nail polish. One such incident was reported at Silverest Polling Station, in Chongwe constituency. Some voters found that their names were not in the register or were transferred to another polling station far away, while others were unable to vote because they had been moved from the area to give room to development. For example, most people registered at Kashilu polling station could not vote because they were moved to a far-away place close to the Democratic Republic of Congo border. They were unable to travel back to Kashilu because of distance and high transport costs. In Kabwata Constituency, Lusaka, the polling station at Chilenje Middle Basic School, in Chilenje South was transferred without proper communication to voters. This left scores of voters waiting at the original location before they knew it was transferred, discouraging many from exercising their right to vote.

(e) Inter-party violence

At the close of polling, there were incidents of violence involving rival political parties. For example, UPND and PF supporters clashed at Solwezi Lodge in Solwezi where vehicles were damaged. PF cadres clashed with police at Shimabala Basic School in Chipangali Eastern Province.

(f) The vote count

Our monitors noted some incidences during the ballot counting process, which instigated delays in transmission, collation and release of final results. For instance, the PF local government candidate was declared winner instead of UPND at Lubendwe ward where a named ECZ data entry officer recorded the results erroneously. The Mayoral results for the entire Kanyama constituency went missing and were not collated for that reason.

(g) Late release of results

The ECZ committed itself to release the results for the presidential election in 48 hours, this was only done four days after voting. The delay in releasing results caused anxiety and suspicion from stakeholders. In future, ECZ must set realistic deadlines for itself unlike the previous experience. The Presiding Officer at Zambezi-C ward in Chawama constituency fell ill before he could submit all the reports for parliamentary and local government elections. This forced the polling staff to delay in announcement of results. The presiding officer at Wusakile main totalling centre in Kitwe went home with the G12 form that was not signed off by stakeholders, causing commotion at the collation centre and forcing delays in announcement of results.

(h) Voting tallying of the presidential election

FODEP notes with concern that there were serious errors in the vote tallying for the presidential election. Our monitors reported that cadres of a named political party stormed St Patrick’s Basic School polling station in Kabwata constituency, chased party agents and got away with ballot boxes. Further, FODEP has observed a serious discrepancy in the totalling of the presidential votes by the ECZ. In Lundazi Central constituency results announced by ECZ show that PF candidate Edgar Lungu obtained 29,979 and UPND candidate Hakainde Hichilema got 4,975 bring the total to 34,954. However, the number of votes cast was 29,741. These kind of errors in computation of results appear to have been widespread.

Conclusion

The 2016 presidential election was marred by irregularities. While we understand that the ECZ worked under adverse conditions and did everything to deliver a credible election, there is still a lot of work to be done to address anomalies and inefficiencies that characterised this election.

But following the declaration of the winner of the presidential election on Monday 15 August, 2016, being the PF candidate, Edgar Chagwa Lungu, FODEP calls on the PF and its leaders to celebrate peacefully and avoid provoking supporters of other parties. The result was close and the winners should respect the losers, who are also quite substantial. Half of the electorate did not vote for the winning candidate. It is therefore important that the winners recognise the right of those who voted for other candidates. Freedom entails respecting the rights of others.

FODEP is saddened by acts of violence by supporters of both the winning and losing parties in Lusaka, Solwezi, Monze, Mongu and other towns which resulted in loss of life and property. We strongly appeal to all Zambians to embrace each other following the elections. Electoral competition should not be turned into war, it is a competition to serve the people. We hope Police and other security agencies will preserve safety of individuals and property during this transition leading to the inauguration of the President-elect.

However, FODEP is mindful that should there be an election petition, transition arrangements as spelt out in the Constitution will be invoked. We hope all those charged with the task of enforcing the law will play their part to ensure that the country is not thrown into a constitutional crisis.

Considering the scale of irregularities and lack of transparency in the transmission, counting, and announcement of results, FODEP is of the view that the just-ended election failed to adhere to the republican Constitution, Electoral Process Act, regional and international standards for a free, fair and credible election.

We appeal to the losers of this election, especially the UPND to exercise maximum restraint. Where they may not be satisfied with the result, we wish to encourage them to follow legal procedures. The Constitution of Zambia, Act number 2 and the Electoral Process Act provides legal avenues that can be used in case of disputes over election results.

The main winners of these elections are the Zambian people whose views and assessment of the contestants was expressed through their vote.

Both winners and losers in this election should look at the results and recognise that the results themselves are an expression of the people’s will.

You have in your hands both a hummer and a nail to either drill the last nail to our democracy or to pluck out the nails drilled by ECZ and PF to our democracy. This is the turning point of Zambia. Your judgement will either decide Zambia forever or send a strong warning to would-be dictators to our democracy. The evidence is there in videos, articles, documents, images, etc. We wont accept shallow excuses of “we dont have conclusive evidence”, bla, bla..

So that was the trend in southern province- if there are any votes to be verified they should start with southern and north western province- the figures from there are puzzling!A candidate cannot be having consistently the same range of figures in almost the whole region- with VJ on upnd”s side, its possible that those figures were manipulated!

    • It is true that at least half of the electorate did not vote for EL. In fact, FODEP and other citizens have pointed to tangible evidence of mulpractice such as removing cast votes from a candidate. Mind you, all these issues come up in court and the agents who were present when these things were happening will be witnesses and if the courts really operate professionally, PF may not enjoy this victory. Don’t just support for the sake of it. You will not be there in the docks.

  5. Literally just checked the ECZ website for Lundazi constituency and the tally is 21,979 for ECL & 4,975 for HH giving a total with other candidates of 29,741. It is very careless & irresponsible of FODEP to insinuate non existent errors on the part of ECZ which in turn erodes the credibility of the whole FODEP report. There were also other candidates who got votes in Lundazi & not just ECL & HH. How can an official report from such an entity published for the whole world to see contain such lies? What is in it for FODEP to fuel an already delicate situation? I think this is actually an offence under Zambia’s electoral laws or other laws.

    • ECZ changed the figures later on their website, check with media who were reporting the figures as ECZ announced them you will find the figures FODEP has mentioned, people need to check if the totals for PF President were adjusted too.

    • If as you claim ECZ corrected errors after realising, what is point of FODEP issuing report today claiming that election result currently available is erroneous & irregular? That is whole objective intended in conclusion of report. And why is FODEP insisting on tallying votes for only to candidates to find a total when there were 9 candidates altogether?     • @ Hold Politicians Accountable. Those figures were never changed. If they were altered later that would have affected the final figures.
      It is incumbent upon every well meaning Zambia to tell the truth and quench the tension in the country. However it seems that all UPND supporters do not want that. War has no discrimination, and definitely no winners. let us be responsible.

  6. Those who seek justice must came with clean hands: the FODEP cited figures for Lundazi Central are WRONG. The ECZ announced results are 21,979 for EL and 4,975 for HH with a combined total of 26,954 which is indeed less than the total votes cast. This example is proof that the ECZ verification exercise worked. FODEP seem to be speaking about unverified figures. As for the other stuff, kaya!

  7. The Kanyama 14000 votes were “retrieved and added to the Kanyama total”. The Lundazi Central figures were corrected by the verification exercise. Some instances of disenfranchisement and inter-party violence re regretted. Then we have housekeeping issues (late opening, late closing and interruption of voting) which are purely human mistakes and not systematic. Meanwhile FODED does not mention any outstanding issue on parley elections and others, and no comment on referendum.

    The big question is, could these issues WARRANT nullification of the election? Bloggers are invited to debate this question. No insults please!

    • The Kanyama 14000 ballots discovered by Maureen Mwanawasa should not have been added. How sure were they that she did not enter the center with those pre-marked ballots. Why did she have to go straight to the bin to discover those papers? What kind of instincts did she have?

      Parties or candidates do not have their separate ballot boxes.
      Votes are not kept in separate containers according to candidates.

  8. Fodep need to put their facts right. If i remember correctly the recent lawlessness in choma was upnd cadres fighting the bembas and eastners. So to have the whole fodep coxing stories wont help the situation instead add more fuel to the already fragile situation.

  15. We thought UPND did it’s home work by following all trucks and opening them to check for ballots.
    But what was wrong with the lusaka group.
    Iam not convinced HH won; look at the number of his mps how many 56. PF 87. How can he form a government with the minority.
    Something to think about. Reason fails me.
    However PF with the majority would do that with it’s numbers that would hold.
    UPND is a joke.

  16. In this day and age of cell phone cameras if you don’t see a video don’t believe it. They talk of ballots recovered from the trash, do you seriously think they would not have recorded this? Same for the intimidation. The other laughable accusation by their supreme leader is that PF cadres walked into polling stations with ballots in their pockets. But when casting votes, when putting the ballot into the box it is in full view of everyone. Hmmm

    • You may not have all the details now. Some of these facts end up appearing in court. You will be shocked. I hope you have been in court before, especially High and Supreme Courts. Some evidence is kept for the courts viewing only.

  21. The delays came about because upnd brought foreigners who hacked into the ECZ system. By God’s grace it was discovered before announcing of results began. So only verified results were announced. Thats why HH won’t petition the results because a lot of UPND evils would be exposed. It may even affect the future of UPND.

She sits and starts counting all by herself: 1, 2, 3, 4………. and discovers that they are all together 14,000. After completing the count she only informs the presiding officer to add them to the results and the presiding officer accepts and off she goes!! What nonsense!!

  25. Question is at what stage were the ballot papers discovered? It can only be at the point when the polling station is closed and agents had the opportunity of separating votes for candidate right? This is the most sensitive stage at the polling station. The next question is how did she gain entry inside when the station was closed to outsiders? What was the size of the bin that accommodates 14,000 ballots? This being Lusaka, where were the UPND agents?. And her being a lawyer, all she cares is take a video of herselfself narrating the incident and neglects to take even a photo of the ballots in a bin let alone report the issue to police? And FODEP decides to make this story part of their report!! Nonsense!!

    The logical path to follow is the parliamentary voting, if presidential is in question.
    I’m hoping that the Constitutional Court will adopt that logic.

    When Fodep says 50 percent of the electorate they are not being accurate- there was a higher voter turn-out in UPND strongholds as oppossed to PF strongholds. As far as I know the word electorate stands for registered voters or people who are eligible to vote (kindly check you dictionaries Fodep).

    This report by Fodep is biased but that’s their job, to be biased and to receive a fat cash handout from UPND in one form or another. Since day one Fodep has been against the PF govt! However we still have the EU, Carter Center, AU and SADC and they have said the elections were free and fair!

  33. With this kind of lying, Zambians will not trust HH even in 2021.
    If UPND have some other people who can inspire confidence in the people to be able give UPND a vote let them replace HH.
    If they don’t have any capable alternative let them maintain HH and wait for 2021.
    Majority of voters will turn out in numbers to keep HH away from statehouse because he cannot be trusted – mark my words!!!!
    HH will now learn a lesson of his entire life. He will look back and regret having gone into politics.

  35. When commenting on NATIONAL issues one should be very careful . you should comment with big and strong balls. There is no middle ground . The election are either credible or not. Do not create doubts in peoples mind like what FODEP is doing. This report is rejected and probably should address t to the courts like his UPND counterparts. FODEP should not even waste his time with his joke congratulatory messages to ECL. We have received enough messages from USA,UN, KAUNDA, the Cater Foundation and others too numerous to mention.

    If at all you were giving even the slightest thought to what you were being told, how do you think the said 14000 ballots found themselves batched together?
    How did those vites decide to gather for UPND?
    You know FODEP, you may just find that in your effort to help UPND, you are exposing the same UPND’s efforts to rig the just ended elections.
    It is important to be alive to the fact the desperation has the potential to make you look unreasonable to the public like Mishipe, who people acuse of being a lawyer.
    I don’t think the accusations made against her that she is a lawyer are true. I think those false allegations – she is not a lawyer.

    “I have received reports that I have died. According to the reports I was killed by thieves this morning and thieves stole my car before burying and getting with my money.

    My conclusion is that, in view of the reported killing of me, I condem such killings and I urge the police to investigate the matter to make sure my killers a brought book”

    And when asked whether there is sense in what you are saying, your answer is:

  41. All this evidence which FODEP is talking about was planned by UPND before the start of the campaigns. HH told his supporters that elections will be rigged, he won’t accept the results. It is amazing that Maureen would just go to one particular dust bin and pluck out 14,000 votes for UPND, which were planned by them. What is FODEP saying about the 200 voters cards stolen by UPND in EP, UPND cadres in SP forcing voters to vote for HH, chasing of PF monitors in SP, the violence of UPND in Sinazongwe, Namwala, Lusaka, Kasama etc. When HH was telling his supporters that he will not accept the results, he knew that he was going to lose, all these are HH’s machinations to save face. For all we know those ballots could have been printed by UPND. If the courts are going to be fair let them…

  42. Fodep, Ecz and UPND MONITORS YOU HAVE CONTRIBUTED TO THIS CONFUSION GOING ON. Reasons u underlated pf intentions to rig the elections at all costs. In some constituences, monitors signed the G 12 form withiout verifying figures after tallying there by advantaging Pf. The I.T specialists manipulated figures. Eg, figures for luapula province, somewhere in mansa district, 1 constituence Ecl was awarded 1843.

So they saw what was happening and they will be able to testify in court as witnesses.PF supporters,no need to panic if you know you won this election genuinely.I’m not a supporter of any party but a strong supporter of free,fair and credible elections.

    • They testify like the woman people say she is a lawyer, Munshimbwe.
      She testified that there was a truck with ballot boxes from Luangwa which went to st. Patrics in Lusaka’s Kabwata constutuency.
      Upon verification it was found out that the was from one of the polling stations within Kabwata constituency, taking the ballot papers to st. Totaling Centre for the constituency .

  45. Very good report. How can we say the election was free, fair and represented the will of the people when their will was trashed into the bin!! Its wonderful to realise that some org like FODEP can still be credited and report things as they happened in this era where even bishops and pastors are biased after receiving 30 pieces of silver.
