The Constitutional Court has thrown out the petition challenging the re-election of President Edgar Lungu.

The Court ruled that the petition stood dismissed for want of jurisdiction by midnight on Friday.It said there is no petition to be heard today.
It said its jurisdiction on the petition ended and expired last Friday at 23:59 Hours.

The Petitioners re-hired the same lawyers and included Vincent Malambo, SC.The only respondent represented is the Attorney General only for purposes of informing the court that we will take no further part in the proceedings as the court has no jurisdiction to continue hearing the matter.

The lawyers contend that any hearing beyond the 14 days would be unconstitutional.The lawyers have refused to participate in a process that is outside the law.
They contend that Hakainde Hichilema’s lawyers had their day in the 14 days allocated to them by the Constitutional Court.

The petitioners’ lawyers had requested to see the court in chambers.The court refused to be seen in chambers.

Judge Sitali, Judge Mungeni and Judge Mulonda ruled that the petition should not be heard while Justice Munalula and Justice Chibomba, the President of the Concourt ruled that the petition should be heard but the majority won by 3 against 2.

  1. Just one word; CIRCUS!!!
    The whole process has been a sham, that’s this court’s legacy!
    The fact is, these judges have not acquitted themselves well and this is a view shared by both parties (PF and UPND). The embarrassing flip-flops rulings do not instil confidence in our judiciary.
    I doubt any of these judges ever worked as constitutional lawyers.

    • Law is not like engineering where 1+1 is always equal to 2 but very subjective. This is why in America the Republicans want Obama not to fill the vacant position of a Supreme Court judge because they fear the judge he will appoint will look after the interest of the Democrats and are hoping they will win the presidential election where the new president will appoint a judge who will look after their interests. In Zambia a look at the dissenting judges’ surnames speaks volume as to why they dissented. Which constitution where these two learned judges reading?

    • If it was to throw the petition, it was supposed to be on friday, not after you yourselves agreed to add the says to the agreed 14 days, today you were only suppose to rule that E.C.L won clearly not to throw the petition naimwe, you go home and ask what to do,then advised wrongly on a simple clearly matter, this brings second thughts even to us PF carders, i am a PF carder and glad that we are the leading party but winning with this kind of Homework judgment makes me feel bad…..mwafunsa funsa first kuli ba nzelu banu koma ndimwe muli panchito, no dignity in our law chapwa bonse fye machakolwa!!!!

    • The petition legally expired on friday

      When making decisions over legal matters, make sure you base your decisions on the law and not fairness.

      The latter (fairness) is very important and it must always given first priority as long as it falls within the constitution and the law.

      Never be tempted to pursue fairness that causes you to break the law.

      The risk is this: when you violate the constitution in preference to fairness, should things go wrong as a result of your decisions, you are unexcusable.

      If you follow the constitution, God forbid that there be but, anything going wrong you will be covered by the constitution.

      Emotions are good, that is why God gave us. But regarding constitutional matters we cannot prefer emotions to upholding the constitution.

    • The Petitioner’s Lawyers were very dull and lacked direction in this case. I wonder what sort of lawyers are they. This was not a matter in which you waste time like they did. They have themselves to blame. Their client HH claimed to have overwhelming evidence and these Mushipe lawyers would have just gone into the main petition unlike what they did, wasting the whole 14 days on delaying to save the respondents with the summon and coming up with unnecessary preliminary issue which actually had no bearing on the main petition. For instance, what was Lungu’s stepping down had to do with their petition or even the court to have the custody of election materials.

      We shall live to politic another day. As for Kalusa and his cliques, identify the needs of the youth/women and work to minimise their jobless burdens as a supplement to Govt effort; who knows?     • We are all struggling to understand what was going on within the legal camp for UPND. According to them they had credible evidence which they never bothered to bring to the attention of the court. All we heard and saw were peripheral issues and not the main petition until the expiry of the 14 days. If on Friday morning they had presented one convincing evidence the case could have no doubt taken a different turn. Bushe did they have actual evidence at all or it was all speculation propelled by the Watchdog?

      “Things have not gone my way”.

      This is because maturity is yet to come on majority of our people.

    • What really happens next is unknown. What most Zambians apparently missed in the last one hour immediately after the “Outcome” of the ConCourt was Mr. Lungu’s invocation of God in his “win”, namely, that it was God that justified today’s outcome. Who knows the mind of God but God? Why would Mr. Lungu add God to an evil that he and his PF party committed? I believe God will settle this case better than the cons of the Constitutional Court. Zambians keep at your knees. Your prayers will not go unanswered. For God can not be mocked.

    • You cannot disregard the constitution and still call yourself a Constitutional Court judge.

      The very reason why the Constitutional Court exists is the constitution.

      It would be like having a District Governor where there exists no District.

      The last person to fail to defend the Constitution is a Constitution Court Judge.

      A ConCourt judge is like the captain of a ship; they cannot jump until there remains no more life in the ship

      Thus, the ConCourt judges will defend the Constitution even when everyone else decides to killing it. The moment they decide to kill the constitution, there function ends.

    • For me who has never done law this is very confusing. Is the Constitutional court handing the case to an unknown court? If UPND are the ones who caused the problem were they made aware of the CC’s power ending at 14 days? Is the CC just scared of making a ruling? Or is the CC acting in the good interests of the country by this ruling?

How I wish the President elect did not make that statement that he was consulting his lawyers after the expiry of the 14 days. THis had a lot of bearing on the predictable outcome of the case. Our God is a God of second chances. This is the first time we have the constitutional court as a fast track to petitions but time will reveal so many things in due time.

    • Come to think of it, that five-some didn’t need to wait 48 hours to come announce the lapsing of the petition period. It should have been done the very Friday so that PF cadres could have used the weekend to celebrate and sadly do stupid things. Because if one critically looks at this, it’s like they went to be told what to do i.e. have two dissenting votes and three for just to hoodwink the populace.

      In any event what effect is the ruling itself because it was already time bad?

      And to think that this is the court vested with adjudicating matters scares the day lights out of those who are progressive in thinking.

  32. How can a whole court of supposedly intelligent men of an integrity of some sort, fail lamentably to interpret the Constitution? Or was this POLITICAL decision ‘pre-ordained’? After a petition has been submitted it will be heard in 14 days – meaning the court is mandated to START hearing it. It doesn’t mean to be concluded in 14 days! Its absurd to expect to sift through mountains of evidence in a couple of days, let alone hours. This court has simply refused to work. Justice goes down the drain again!

The questions we should be asking are that if the petitioner had overwhelming evidence as they put it, why was it such a comedy of errors when submitting and presenting this evidence? the truth is, they concentrated on disrupting the swearing in ceremony so much so with a hope of creating a political vacuum in the country.       I disagree. The failure of UPND to prosecute their petition has given ECL and PF an advantage and an opportunity for UPND to scan their managerial infrastructure. Either the Republican or Democrat candidate will fall in November, but those parties like the church will march on. So UPND stays and we the loyal members stay. We may change leadership though. Justices Chibomba and Munalula are women of integrity.These two really wanted justice to be delivered. The rest should resign on moral grounds. Justice has not been delivered. If ECL was duly elected by the Zambian people the concourt should have said so AFTER HEARING ALL THE AVAILABLE EVIDENCE.I had some confidence in the concourt but from today NEVER again. They had enough time to hear from UPND on Friday but threw out everything. The only people who should remain in the concourt are the two women who agreed to proceed with the hearing.This simply shows that a sitting President in Zambia is above the law.

    • There was no evidence. Imagine HH asking for evidence from ZNBC (the organisation he loathed) and the accused ECZ. Strange and confusing indeed. I am equally appalled.

Surely today’s decision reached itself last Friday at 23 59 hours when the petitioners requested for extension of time to look for new lawyers when the court should have thrown out the petition. Any verdict which was going to be passed after the deadline would have been voidable by either party because the extension is ultra-vires. In reality PF should have proceeded with the inauguration process because whether they lost or won the case, they would not have been bound by the verdict.

That is why his lawyers wasted time on pointless petitions. On the last day, HH and his lawyers played a well calculated move. HH said he would not accept defeat.

  74. Leadership is about wisdom. Please read the history of Sebitwane the Makalolo King who united the then Makololo empire following his conquest of some parts of Western and Southern Zambia. Sebitwane considered everyone as being equal including the conquered tribes. When he arbitrated, he ensured fairness to everyone. He died following a fall on David Livingstone’s horse. His Son Sekeletu, took over and he was cruel, subjugating the conquered tribes to humiliation while playing them against each other. The end result was that when Sipopa rebelled the Kingdom crumbled. Lets learn from history to prepare a better future for our beloved country.

  76. All genuine Zambians should congratulate EL even if you feel disappointed. The greatest lesson from this petition is not for HH has many may think. What this petition has exposed is the competence levels of our lawyers in this nation. Of course not every lawyer but their profession representatives have dented their image. Reason is simple, they failed to provide leadership in the petition process. Even if UPND wanted to keep bringing new issues it was the responsibility of the bench to put a stop to that and have the hearing begin. Also the weekends were wasted by the court not UPND. What these judges have done is to give UPND a platform to be saying their lawyers never argued the case or the case was closed without any hearing.

    • If HH has overwhelming evidence that he won the last election, there is no reason he can not publish that evidence outside the jurisdiction of the court.

  80. Some people supporting PF who live in the diaspora have not visited Zambia for many years. Travel to your country and see for yourselves then talk. Poverty in Zambia is shocking and simply scandalous. Unemployment is allover the country. The majority of children don’t have enough food and are stunted while politicians are sending their children abroad and driving expensive cars around. Go to what used to be the UTH. It’s a mortuary. People sleep on floors and the stench is unbearable while politicians and their relatives are sent abroad for treatment and you say things are okay. How is GBV being vp going to improve the lot of poor women who face violent from their husbands? What most Zambians apparently missed in the last one hour immediately after the “Outcome” of the ConCourt was Mr. Lungu’s invocation of God in his “win”, namely, that it was God that justified today’s outcome. Who knows the mind of God? Why would Mr. Lungu add God to an evil that he and his PF party committed? I believe God will settle this case better than the cons of the Constitutional Court. Zambians keep at your knees. Your prayers will not go unanswered. For God can not be mocked.

The reality of the situation is that we don’t know who actually won those elections and we may never know because there were no court proceedings that took place as there was no hearing, no trial, no cross-examination,no witnesses,no defence and eventually no judgement was passed. The full bench agreed last Friday to continue with the proceedings but what happened over the weekend? Were some judges bribed?Judgement was NEVER delivered in this matter.Kwasila, we are finished as a nation. The Concourt owes us an explanation. They kept adjourning simple applications or appeals over which they were able to pass rulings the same day. The concourt you have failed us, resign on moral grounds.

    • Who won the majority of seats in parliament? Who won 7 out of 10 provinces? We know who won the elections, it is just that HH and GBM did not want to accept the results just like they said they would not before even one vote was cast.

    Why did your lawyers present these evidences from the begining because ti was false from ZWD. Your learned lawyers refuse to present false evindence hence started looking for other evidence such as all 19hrs from 5th May 2016 to 11th August 2916. Even if you were given two days were you going to able present 82 evidence plus news hours mentioned and be cross exammined in 2 days.

If UPND are the ones who caused the problem were they made aware of the CC’s power ending at 14 days? Is the CC just scared of making a ruling? Or is the CC acting in the good interests of the country by this ruling?

  95. Two possible theories.
    1. The petitioners’ lawyers knew how to present the case, even though they did believe in it or that they had evidence at all.
    2. HH was more interested in President Lungu vacating office. This wasted a lot of the lawyers time and they did not even believe that that line would succeed because they inderstood the constitution better. But he who pays the piper calls the tune. So HH insisted and the lawyers obliged. When time was wadted the lawyers bailed out to protect what remained of their professional integrity.
    Conclusion: Umulandu wabola pantu ba underfive ifikansa bamona kwzti ebaishiba ifintu beka: economy, finance, law etc etc ba underfive baleimona bukalapashi. With disastrous results.

  96. This disaster for HH and UPND exemplifies the failure by UPND since HH took over the party. The only reason for failure by UPND to form government all these five attempts is that everybody believes that only HH is capable of thinking. Even the lawyers believe the legal expertise lies in HH (just look at the shameful analysis by Muna Ndulo, I refuse to call him Professor), the party functionaries on the ground cannot advise HH on what is happening on the ground. Even the petition evidence was provided by HH when he had no clue what happened at polling stations on ballot day. Even the Stephen Katukas whom we thought could guide that underfive boy looked at him in awe and failed to think.
