UPND tells members to remain strong as they consult the legal team for the next step

We wish to remind all our members across the country to remain strong as we confer with our legal team on the next step to be taken.

We know that this is a difficult time for all of you. But we wish to put it on record that we have not lost an election, neither have we lost the petition which was before the constitutional court.

In view of the foregoing, we have decided take necessary measures to see to it that justice prevails as we believe that justice should not only be done but it must be seen to be done.

It is important for us to point out that the constitutional courts inconsistencies in presiding over the presidential petition have created a constitutional crisis which has brought us to where we are.

Remember that one single Judge ,in the name of Judge Anne Mwewa Sitali , who initially gave direction that the hearing of the main presidential petition was supposed to have commenced on Friday 2nd September 2016 and run up to 8th September 2016.

Surprisingly, Judge Sitali rescinded her decision on Thursday 1st September 2016 upon hearing an oral submission by the respondents on the computation of time (14 days).

The judges decision created confusion in that she contradicted her earlier direction to have the main petition heard starting on friday 2nd September 2016.

Note also that a single Judge threw out six of the applications we filed for further witnesses, and to make amendments to the main petition.

We also filed in an application to have president Edgar Lungu step aside and allow the speaker of the National Assembly act as republican president in accordance with article 104(3) of the amended constitution, but the court refused to hear the application.

This in a way compromised the court proceedings as this allowed for interference in the court proceedings.

Our lawyers advanced motions to have the 14 days dispute resolved until friday evening when they withdrew their advocacy. To this effect, the 1st and the 2nd respondent on Friday sought leave arising from Judge Sitalis misguided position. The president of the constitutional court granted the 1st and 2nd respondents who are President Hakainde Hichilema and His running mate Geoffrey Bwalya Mwamba (GBM), leave to prepare legal representation and adjourned to Monday 5th August 2016.

Our argument is that the court was inconsistent and failed to live up to their earlier decisions and continued changing positions almost in each sitting. As you may be aware, two judges namely Judge Chibomba and Judge Munalula disagreed with the idea by other three judges (Judge Mungeni, Sitali and Mulonda) to throw out our petition on the basis of an application made by Patriotic Front lawyers explaining the lapse of time.

The two Judges who agreed with us contended that the decisions should not be made using one clause or one article in the constitution but instead read together with other clauses.

Judge Munalula and Judge Chibomba submitted that petitioners needed to be heard in accordance with article 18 of the constitution of Zambia.
They further submitted that justice shall be administered without undue regard to procedural technicalities and that justice shall be done to all without discrimination.

Judge Munalula also argued that it could have been good if the petitioners were given time to prove their allegations.

Finally, we wish to tell the nation that we have rejected the court ruling in that the judgment was passed on an application from the respondents without allowing us to respond.

How can the court tell us to prepare for a hearing and then come to deliver a judgment? This is the question we have as petitioners among other questions.

      UPND lawyers had something in mind when they were coming up with Tom and Jerry games.

      It was a total miscalculation on their part, of a trick they hoped to use to surprise their opponent with.

      But this trick backfired on them, causing them to try and place the blame on the ConCourt.

      They have also decided to put the blame on the respondent.

      They also have gone ahead to blame the incumbency, saying there was political influence on the case as if incumbency had influence on the time.

      This character has often been seen in the UPND on a number of occasions; a character I would describe as CRY-BABY mentality.

      What was shocking was that the very people complaining about time in the last two hours, were the ones who raised ALL the prelinary…

      I wonder what would have been the story if it were the respondents who had spent time raising those preliminary Tom & Jerry cartoon games.

      Of course they would have blamed the judges for allowing the said legal cartoon games.

      It would have been percieved as a collusion between the court and the respondents.

      But, what even more amazing was that the respondents’ lawyers even tried to help the UPND lawyers by trying to stop these UPND lawyers from raising further preliminaries and amendments.

      But the UPND lawyers kept fighting to continue with preliminaries and amendments even in the afternoon of the 14th day.

      The same continued even after they were told by the ConCourt that the case hearing needed to end that very day.

      Now, what happens? Two (2) hours before petition hearing closure time they decide to walk out, saying there is no time left to defend their client.

      I know that what the lawyers for UPND were doing is understandable by the legal fraternity, but for a layman like me I would not believe that a person in their normal thinking would do that.

      That is why i am not a lawyer. I would rather go straight to play Tom & Jerry cartoonsin the right environment than use the courts to shall my artistic talent.

    • HH is a very misguided fellow. Isn’t he the very person that was bragging during his press briefing stating people actually asked him to be a professor at law after the stint he pulled in court, but now he wants to consult his legal team? If you had a water tight case, preliminaries should have been dealt with in the first 2 days at most. But your legal team was so incompetent that they wasted the first week serving summons. Oh, and they had the audacity to say their summon servers where beaten by State House soldiers when they clearly knew which lawyers where representing the president!
      Blame your legal team especially your menopausal Martha who is always hailing insults at anyone who dare challenge her! Better yet, cry me a river.

  16. Regardless of which Judge voted in favour or against, it is collective Constitutional Court decision & its final. Its not just numbers which speak on bench but also grounds for voting & they don’t vote on baseless grounds. Why participate in elections if you have no confidence in ECZ & also why go to Court if the final thing is to single out individual Judges who voted for & against? Fast track cases which have limitation of time need both petitioner & respondent to have facts at finger tips. The petition was lost when UPND disregarded ECZ decision & boycotted the proceedings. With due respect to our learned lawyers, this case has a time limit because the people are the ones that make a choice. If there was any shred of evidence that should have been flashed so that the court may see the need to rule otherwise and not face book postings. In steady of negotiating with the creditors of the party on favourable loan repayment terms they spent time following their hysterical lawyers’ style of handling issues.     This was the reason why Lungu was so excited to ascend and append his signature to this constitution because he knew he would have protection.

When you are a team player, winning is not only about you possessing what you wish for but extending the frontiers of the common cause. We have Mayors and Councils to constitute in our strongholds.     You cannot go to the High Court, not even the Supreme Court, after ConCourt’s ruling.

      HH argues and says, no I reject the case because 2 judges supported me; only 3 did not support me because they were wrong in their judgement.

      He concludes that because 2 out if 5 supported him, the case is still on because the two judges have spoken. Again here, he fails to accept the decision of the majority.

      All he says is ‘my right, my right’. Mr HH, there are no rights outside of the law.

      When the law says within reasonable time, it implies giving up to the maximum as stipulated by the constitution when such time has a limit by the law.

  31. Lusakatimes for August 30, 2016 carried a story with the headline: UPND will Accept and Respect the Final Verdict of the Constitutional court-GBM. So the verdict was passed. What are they consulting their legal time for? The last time I checked the verdict by the ConCourt is final. I only hope HH and GBM don’t get into treasonable acts.

Read the report by Barclays Africa last week: It would be easier and quicker for Zambia to reach agreement with IMF under PF than under UPND. Bwana Stephen Katuka, you have high lighted the inconsistency by the Concourt rulings according to you but deliberately you have not mentioned the 1st ruling on 14 days that the petitioner trial case will be conclude on Friday 2nd Sept, 2016 by 23:45hrs, but unfortunately the same night the Concourt misdirected themselves by extending petitioning case to Monday 5th Sept.2016. I was expecting you to include it in your analysis but deliberately left because it was against you.

God cannot be cheated or fooled… HH, give us a break… We are tired… Just take a five years leave and come back for 2026 elections… You are still young and you will be 63yrs and still eligible to contest…!! or better still start from Kabulonga Ward as a councilor and then, Lusaka City as Mayor, Lusaka Central as MP and then Minister of Local Government, the Finance or Foreign Affairs and the stand for Presidency… At least you would have gained some experience!!!   44. some times lucky of education matters…i thought HH went to school but he is proving to the entire nation that he is very dull…President Lungu has immunity now …to sue him first remove his immunity…that can only be done by parliament….but since he thinks is very intelligent…he has done the wrong thing again…does this guy got legal advisers?desperation is what is causing him do wrong things….i pity this man …..

  47. This case was NEVER heard. Intelligent people know that. There are many issues – not just the right to be heard. There was deliberate misinterpretation of the 14 day clause, refusal to have Lungu step aside for the speaker and frankly, having the matter presided over by some clueless and not only politically compromised set of judges, but without the necessary legal experience or integrity. Why should we be surprised anyway? We have sycophants at the helm, devoid of any aorta of decency, ready to usurp power at any cost, for capricious gain and no care for others or the need to plan for the country’s future socioeconomic sustenance.

  48. It is true that UPND supporters must remain calm and strong awaiting their leaders next move.
    The move will be fruitless so remain calm and strong in accepting the results.
