UPND says it is confident that Chief Justice will not Swear in President-Elect Lungu

United Party for National Development (UPND) Secretary General Steven Katuka has expressed confidence that Chief Justice, Irene Mambilima will not swear in President elect, Edgar Chagwa Lungu and his running mate Inonge Wina tomorrow amid pending court matters filed by the UPND leader Hakainde Hichilema and his running mate Geoffrey Bwalya Mwamba in the courts of law, reports Pan African Radio Journalist Hermit Hachilonde.

In a statement made available to the media today the 12th September, 2016, Mr. Katuka stated that Chief Justice Irene Mambilima is among the best legal minds in Africa and it is common knowledge that she will not swear in President elect Edgar Lungu under the prevailing circumstances where a number of legal issues pertaining to the 2016 Presidential election have not been fully resolved by the Constitutional Court.

He said both Mr. Hichilema and Mr. Mwamba have maintained that Mr. Edgar Lungu and his running mate Inonge Wina, in collusion with the Electoral Commission of Zambia and other known stakeholders stole votes belonging to the UPND and the party have tangible evidence to substantiate the Presidential petition.

Mr. Katuka has since expressed his displeasure in the manner the Constitutional Court handled the petition, stating that concourt handled the petition in a sinister manner as evidenced by the party denied time to be heard or to produce evidence as enshrined in the constitution.

“We would like to strongly and confidently state here that knowing how credible, distinguished and law abiding Chief Justice Irene is, Lungu must forget about being sworn in as Republican President, but instead prepare to face the law because Justice Mambilima understands the law to the fullest” he said

Meanwhile, veteran Politician Vernon Mwanga has charged that the 11th August, 2016 General elections has left Zambia a deeply divided country, reports Pan African Radio Journalist Hermit Hachilonde.

Dr. Mwanga said half of Zambia’s population is celebrating and the other fifty percent is bitter and angry about the failure of the constitutional court to hear a petition.

He noted that the UPND was within its right to pursue a legal path by going to the concourt to present whatever evidence they had and let the matter be decided purely on its merit .

Dr. Mwanga said justice in Zambia has become a bridge too far due to the the path the concourt took which sadly denied UPND time to be heard.

He added that something has seriously gone wrong and national soul searching is called for in a country which has been acclaimed the world over as a beacon of peace and constitutionalism .

Dr. Mwanga also noted the election has left friends and family divided because of irresponsible statements by some of the political leaders who are fueling tribal animosity in a country.

“A deeply divided country is the last thing we want to see at this difficult time. Dialogue at the political level is desperately needed and even if it is promoted by SADC or the AU, to address the deep differences which have emerged and which will not go away on their own”

“Arrogance of power in situations like this will not bring us peace. we need dialogue for the better good of mother zambia, because peace once lost, is very difficult to re-establish as experience has shown in other countries”

“As the old adage goes “power corrupts and absolute power corrupts absolutely”. The country faces gigantic economic , social, political and constitutional problems which will require consensus building inside and outside parliament. We still have a very defective constitution which has be exercabated by the rejection of the referendum which would have introduced a new bill of rights” he said

      UPND and the general public don’t know what the allegations that HH believes proves that the elections were forged and won by UPND.

      Why the rush with High Court and the Concourt?

      Why not hear what everyone else has to say and out this to bed?

      These elections are done YES
      There are allegations which are NOT looked into.
      Why swear someone when they may have fraudulently become the President?

      What ought to happen is suspicions of the ceremony, go back to High court, listen to both sides of the argument and make a Judgement

      If Lungu was democratically elected we will accept him, but the skims more of a scheme that was orchestrated prior to elections.

    • Let no one be cheated by the petitioners and their cardres, some of whom appear to be educated yet exhibit no noticeable integrity.

      As for UPND’s petition, the matter should not be taken out of context. The judges made the right decision to correct the mistake they had made on Friday of allowing an illegal extension of time beyond what is constitutionally stipulated.

      In order to uphold the constitution the judges realised the need to reverse the extension of the 14 days constitutional limit to the petition.

      What can the examiner mark if you choose not to write the exam, when you choose to take a nap in the exam until time is up? Nothing. This petition lost its allowable time as petitioners avoided discussing their petition until time up.

      Still regarding the said “reasonable time” legal subjectivity may only arise where no timeframe has been stipulated by the constitution.

      Otherwise you have to obtain your “reasonable time” within the confines of the constitution. And the best scenario you can get is to reach the maximum stipulated timeframe, as being the most reasonable.

      Revisiting the fourteen days, I wish to comment on an extra scenario that I heard on radio some people saying the petition sitting excluded the weekends. That there were only 10 days’ sitting instead of 14 days.

      The constitution does not say there shall be 14 days of sitting.
      Look, it is not about the number of sittings; it is about the timeframe allocated. The court can even sit once or twice, etc. but hearing must be done within 14 days.

      Still other people are saying, by hearing within 14 days, the constitution implies starting the hearing within 14 days! Come on, do people think that ‘to hear’ means ‘to commence hearing’?

  21. How will Lungu deal with the legitimacy issue without resolving the Concourt Petetion? This issue will not go away until the Petetion is properly disposed off. Until this is resolved thru a Petetion Hearing properly held the perception that Lungu stole this election will linger on with or without inauguration. Lungu just has to come clean on the Petetion issue. The International Community will not recognize Lungu until he demonstrates openly that he genuinely won this election. Even multi-lateral institutions like IMF and World Bank should not bailout the illegitimate Lungu govt until the Petetion is resolved thru the Courts.   30. The strategy by UPND is to pressure Chief Justice with appeal in a court of emotions. UPND had their day in court of law but failed to effectively & efficiently use it. Chief Justice is governed by law not emotions based on unverified claims. Contrary to claims of UPND all respectable independent monitors have confirmed that elections were free & fair. ConCourt process could’ve been handled better but still that court made its final & correct decision as required by constitution. What is basis of asking Chief Justice not to perform her Constitutional functions, because UPND can’t accept loss? How can you hope for order by relying on anachy?   33. I am still surprised how we have moved from the election was rigged to UPND won. When did they win and by how much? Where are the source documents for those figures? How come none of the observers call this election disputed?
    It’s sad when leaders take advantage of their popularity to force people in a direction they don’t want to go but go there just for them. Many people’s lives in the south will not change overnight even if UPND were to takeover tomorrow so they are tired of this acrimony. They want their lives back. H H please allow them to live their lives. Stop telling them to fight for you. They did that already and it failed. Let them live to fight another day. Besides when it’s time to boot out ECL they will not do it alone. We will do it together like we’ve done before.

    The constitution of any country is supreme nobody has the right to change it to suit the environment at a particular moment
    Having said that hh’s lawyers failed him by not concertrating on submitting the main issue. They were so emotional that they ended up bringing up 101irrelevant issues instead of concertrating on the main point . The defendant’s lawyers knew about the time limit to the petition thus capitalized on lapse

  41. UPND is always wrong. They predict that the President will not be sworn in. Again they are wrong. How do we have leaders with such myopia vision of events. I am glad they are history from this afternoon and should shut up. Otherwise we start locking them up one by one to preserve peace and Zambian sanity.
