UPND Secretary General Stephen Katuka(c) having an interview with
the Journalists
United Party for National Development (UPND) Secretary General Steven Katuka has expressed confidence that Chief Justice, Irene Mambilima will not swear in President elect, Edgar Chagwa Lungu and his running mate Inonge Wina tomorrow amid pending court matters filed by the UPND leader Hakainde Hichilema and his running mate Geoffrey Bwalya Mwamba in the courts of law, reports Pan African Radio Journalist Hermit Hachilonde.

In a statement made available to the media today the 12th September, 2016, Mr. Katuka stated that Chief Justice Irene Mambilima is among the best legal minds in Africa and it is common knowledge that she will not swear in President elect Edgar Lungu under the prevailing circumstances where a number of legal issues pertaining to the 2016 Presidential election have not been fully resolved by the Constitutional Court.

He said both Mr. Hichilema and Mr. Mwamba have maintained that Mr. Edgar Lungu and his running mate Inonge Wina, in collusion with the Electoral Commission of Zambia and other known stakeholders stole votes belonging to the UPND and the party have tangible evidence to substantiate the Presidential petition.

Mr. Katuka has since expressed his displeasure in the manner the Constitutional Court handled the petition, stating that concourt handled the petition in a sinister manner as evidenced by the party denied time to be heard or to produce evidence as enshrined in the constitution.

“We would like to strongly and confidently state here that knowing how credible, distinguished and law abiding Chief Justice Irene is, Lungu must forget about being sworn in as Republican President, but instead prepare to face the law because Justice Mambilima understands the law to the fullest” he said

Meanwhile, veteran Politician Vernon Mwanga has charged that the 11th August, 2016 General elections has left Zambia a deeply divided country, reports Pan African Radio Journalist Hermit Hachilonde.

Dr. Mwanga said half of Zambia’s population is celebrating and the other fifty percent is bitter and angry about the failure of the constitutional court to hear a petition.

He noted that the UPND was within its right to pursue a legal path by going to the concourt to present whatever evidence they had and let the matter be decided purely on its merit .

Dr. Mwanga said justice in Zambia has become a bridge too far due to the the path the concourt took which sadly denied UPND time to be heard.

He added that something has seriously gone wrong and national soul searching is called for in a country which has been acclaimed the world over as a beacon of peace and constitutionalism .

Dr. Mwanga also noted the election has left friends and family divided because of irresponsible statements by some of the political leaders who are fueling tribal animosity in a country.

“A deeply divided country is the last thing we want to see at this difficult time. Dialogue at the political level is desperately needed and even if it is promoted by SADC or the AU, to address the deep differences which have emerged and which will not go away on their own”

“Arrogance of power in situations like this will not bring us peace. we need dialogue for the better good of mother zambia, because peace once lost, is very difficult to re-establish as experience has shown in other countries”

“As the old adage goes “power corrupts and absolute power corrupts absolutely”. The country faces gigantic economic , social, political and constitutional problems which will require consensus building inside and outside parliament. We still have a very defective constitution which has be exercabated by the rejection of the referendum which would have introduced a new bill of rights” he said

    • Forget the 14 days, there is a different way of interpretation it.
That one we put to bed

      Here are the FACTS

UPND and the general public don’t know what the allegations that HH believes proves that the elections were forged and won by UPND.

Why the rush with High Court and the Concourt?

Why not hear what everyone else has to say and out this to bed?

      These elections are done YES
There are allegations which are NOT looked into.
Why swear someone when they may have fraudulently become the President?

What ought to happen is suspicions of the ceremony, go back to High court, listen to both sides of the argument and make a Judgement

If Lungu was democratically elected we will accept him, but the skims more of a scheme that was orchestrated prior to elections.

    • Let no one be cheated by the petitioners and their cardres, some of whom appear to be educated yet exhibit no noticeable integrity.

As for UPND’s petition, the matter should not be taken out of context. The judges made the right decision to correct the mistake they had made on Friday of allowing an illegal extension of time beyond what is constitutionally stipulated.

In order to uphold the constitution the judges realised the need to reverse the extension of the 14 days constitutional limit to the petition.

What can the examiner mark if you choose not to write the exam, when you choose to take a nap in the exam until time is up? Nothing. This petition lost its allowable time as petitioners avoided discussing their petition until time up.

    • So it was as good as a student who chooses not to write an exam while in the exam room due to a lack of preparedness.

Coming to power handover; which constitution provides for handing over power to the speaker following a petition under INITIAL ballot?

      It appears HH is quite a good music composer. He composes a song;

      ” A eeeh, a eeeh;
      handover power, a eeeh!
      A eeeh, a eeeh,
      To the speaker, a eeeh!”

And amazingly, within 14 days, it is a hit, and everyone of his cadres is singing it.

Come on, there is no handing over of power following a petition under the initial ballot, covered by Articles 101 and 102.

The handing over of power comes following a petition done subsequent to second ballot, or simply put round two (2) of elections, dealt with under Articles 103 and 104…

    • The handing over of power comes following a petition done subsequent to second ballot, or simply put round two (2) of elections, dealt with under Articles 103 and 104.

The petitioners and their cadres have all decided to deceptively cite Articles 103, and 104, knowing well that the two articles apply to the second ballot, hoping they should catch the ignorant in our citizenry.

Please read the constitution, don’t rely on HH. He read it only in one day, no wonder most of the issues are taken out of context.

On the bill of rights, HH thinks where the constitution stipulates 14 days, using the bill of rights Article 18(9) you can sit under a mango tree and extend it to 90 days if you feel that that is what is reasonable to you.

The bill of rights is part of the constitution. It…

    • The bill of rights is part of the constitution. It will not break the constitutionally stipulated timeframe in order to give you more “reasonable time”.

Still regarding the said “reasonable time” legal subjectivity may only arise where no timeframe has been stipulated by the constitution.

Otherwise you have to obtain your “reasonable time” within the confines of the constitution. And the best scenario you can get is to reach the maximum stipulated timeframe, as being the most reasonable.

Baba even in an exam, you can’t say I have a lot bubling in me so give me more time to offload. No, just learn to summarise your knowledge so you can offload it within 3 hours.

Single-sighted HH keeps saying “reasonable time, reasonable time”.

    • He has become very vulnerable at this time and as a result trainee lawyers are misguiding him.

Now, where time limit is specified or stipulated in the constitution, the meaning of “reasonable time” means allowing up to the maximum allowable time within the confines of the constitution.

It does not mean reasonable time based on individual views, feelings, opinion, or perception but what the constitution provides.

You do not go outside of the constitutionally stipulated timeframe to get a subjective ‘reasonable time”, No!

And it beats me to hears losers who say in advance that if I lose I will not accept. If I win I will accept.

They lose 47% to 50.35% they refuse to accept. They say the zambians want me this time around.

    • They say the election had so many irregularities such as G12 forms .

But then they ask for a recount, and say that in the same election if the recount shows that I won I will accept, despite the said G12 form issues they have raised.

They petition, but waste theirs including the court’s time, celebrating that they have managed to petition; bringing all manner of preliminaries.

The petition fails through a majority rule by judges, 3-2. He says no I will not accept because 2 judges have supported me, even though 3 mischievous ones have not. Those 2 who have agreed with me are noble. Those who have not gone my way are crooked and mischievous.

Just how do you handle a person like that?

    • To me, either something has terribly gone wrong with him or he is merely a trouble maker.

Revisiting the fourteen days, I wish to comment on an extra scenario that I heard on radio some people saying the petition sitting excluded the weekends. That there were only 10 days’ sitting instead of 14 days.

The constitution does not say there shall be 14 days of sitting.
Look, it is not about the number of sittings; it is about the timeframe allocated. The court can even sit once or twice, etc. but hearing must be done within 14 days.

Still other people are saying, by hearing within 14 days, the constitution implies starting the hearing within 14 days! Come on, do people think that ‘to hear’ means ‘to commence hearing’?

    • What do you understand by the statement:
“Students must write their exams within 14 days”?

Does the above sentence imply “students must commence their exams within 14 days”? or,

does it mean “students must finish writing their exams before or on the 14th day”?

So don’t try to twist law to support your view. If you have no case, you have no case!!!

  6. There is overwhelming evidence that everyone saw the Harker at ECZ server who got access to ECZ IP address and started manipulating Lusaka election results from a room at Pamozi. Secondly Frank small god jamason refused to handover power to the speaker making the ConCourt more vulnerable to Pfools dictators, of which gave them powers to comp at the court and open a bar to psychologically defeat the judges. Thirdly, jamason illegally allowed his ministers to be in office during campaigns to give them advantage to state machinery.

She is obliged by the law to do the right job.
If she feels it is personal better her deputy does the job; finish by the she does what the office tells her according to stipulations.

Expressing the people who voted for upnd as a percentage of the estimated zambian population(about 15 million), approximately 12% wanted HH to be president.if we extrapolate this percentage to the rest of the population to the rest of zambia and not forgeting that some people for the who didn’t registered might have increased this percentage, I can safely say with confidence that only about 15%±4 people would have voted for HH. 22. How will Lungu deal with the legitimacy issue without resolving the Concourt Petetion? This issue will not go away until the Petetion is properly disposed off. Until this is resolved thru a Petetion Hearing properly held the perception that Lungu stole this election will linger on with or without inauguration. Lungu just has to come clean on the Petetion issue. The International Community will not recognize Lungu until he demonstrates openly that he genuinely won this election. Even multi-lateral institutions like IMF and World Bank should not bailout the illegitimate Lungu govt until the Petetion is resolved thru the Courts. Lungu cannot expect to get way with this electoral theft and be rewarded for stealing the elections. International sanctions beckons.

  31. The strategy by UPND is to pressure Chief Justice with appeal in a court of emotions. UPND had their day in court of law but failed to effectively & efficiently use it. Chief Justice is governed by law not emotions based on unverified claims. Contrary to claims of UPND all respectable independent monitors have confirmed that elections were free & fair. ConCourt process could’ve been handled better but still that court made its final & correct decision as required by constitution. What is basis of asking Chief Justice not to perform her Constitutional functions, because UPND can’t accept loss? How can you hope for order by relying on anachy? Its really childish & selfish for grown ups to act that!

It’s sad when leaders take advantage of their popularity to force people in a direction they don’t want to go but go there just for them. Many people’s lives in the south will not change overnight even if UPND were to takeover tomorrow so they are tired of this acrimony. They want their lives back. H H please allow them to live their lives. Stop telling them to fight for you. They did that already and it failed. Let them live to fight another day. The constitution of any country is supreme nobody has the right to change it to suit the environment at a particular moment
Having said that hh’s lawyers failed him by not concertrating on submitting the main issue. They were so emotional that they ended up bringing up 101irrelevant issues instead of concertrating on the main point . The defendant’s lawyers knew about the time limit to the petition thus capitalized on lapse
In a nut she’ll HH should place the blame on his lawyers and concide defeat let the nation carry on.

  38. Simply say put is that about 47 to 50% Zambians have lost it into a drain, its not HH or GBM, or Dr Mumba or me to say the least, but those figures of abour 1 700,000 million zambians who voted, while about 1,800,000 plus stolen votes went to your ECL. Fine its game over but it has not finished. At least, I can earn about USD 400 per day, which is the salary for you and your dununa Mr Phiri.
Let the game begin now after Tuesday the 13, called a devils day. It will be PAY BACK TIME.

HH has nothing to lose anyway, the man is already rich and so is GBM. Its you bloggers who are cerbrating on a pack of shake- shake, or bulky chibuku while miners are crying foul.
Ok Inaugurate him lets see if manner will fall from heaven for you feed your empty stomach.

  41. @bystander 51. be real the Tanzania president is not coming due to the earthquake which has killed 16 people so far confirmed. That’s how cheat yourselves in Upnd by creating situations which don’t exist.

  43. UPND is always wrong. They predict that the President will not be sworn in. Again they are wrong. How do we have leaders with such myopia vision of events. I am glad they are history from this afternoon and should shut up. Otherwise we start locking them up one by one to preserve peace and Zambian sanity.

  44. Katuka you are right since your HH and GBM have been ill advised to cite her in matter to be heard on the 28th however they can be no vacuum in judicial functions so he will be sworn in and your constiturional gymnastics defeated
