IT is up to Mr Hichilema and other UPND members in incarceration to ask for amnesty from Government if they really need it, whoever goes to justice must go with clean hands, minister of Justice Given Lubinda has said.
Reacting to Green Party president Peter Sinkamba’s appeal for Mr Lubinda, in his capacity as minister of Justice to extend amnesty to UPND members in incarceration, he reiterated that it was up to the incarcerated to seek amnesty.
Mr Lubinda pointed out that the UPND members in incarceration would seek his amnesty and reconciliation if they so needed it. He noted that Mr Sinkamba’s call for healing and reconciliation was a progressive move but that there was need for both players in the process to be willing.
Mr Lubinda said the fact that the UPND were not willing to seek amnesty for themselves was a sign that they did not want reconciliation. “The appeal by Mr Sinkamba for reconciliation is really progressive, but this is not one sided because both parties should be willing. If the affected party really want my amnesty, then it is not for Mr Sinkamba to appeal but the aggrieved should do it themselves to show that they really mean it.
The fact that the UPND are not willing to seek amnesty for themselves is a sign that they do not want reconciliation,” he said. Mr Lubinda, however, disclosed that he had tabled Mr Sinkamba’s appeal with his justice advisors, and that he would give his position on the amnesty soon.
And PF Lusaka district chairman Stafford Kayame also noted that Mr Sinkamba’s appeal was done in good faith but that there was need for Mr Hichilema and Mr Mwamba to conform to the rule of law.
Mr Kayame reiterated that the UPND leaders needed to accept the legitimacy of the electoral process and stop demeaning the Head of State. He advised Mr Sinkamba to first counsel Mr Hichilema and Mr Mwamba to embrace peace and respect the Republican President. Mr Kayame emphasised that President Edgar Lungu had already started the reconciliation process by instructing all PF members to co-exist with other opposition supporters.
“Mr Sinkamba should first counsel HH and GBM so that these two UPND leaders and their party members accept the legitimacy of the electoral process. HH and GBM should then conform to the rule of law and stop demeaning the Head of State. President Edgar Lungu has already started the reconciliation process by instructing all PF members to co-exist with other opposition supporters,” he said.

Amnesty can be used to show good will on the part of the government, whether it is asked for or not. Either party can come up with a set of conditions if necessary, but the common understanding would be that the law should be followed just as everyone’s rights should be respected and protected. As a country we lose nothing by dropping these charges. If people break the law again then we take it a step further. Whatever these people did was done under very unusual circumstances in our country coming from a complex historical process, and it is doubtful that they will do it again upon release.

So what amnesty are you talking about when they believe that they are above the rest of the laws & don’t mind as long as they can pay ZMW 25,000.00 Police Bond charge each & walk out of cells, they are ok. It will only become an issue when their offenses become unbaileable. For now the they are happy to pay bail charges, the Police are happy to issue receipts for Police Bonds, lawyers are happy to represent them at lightning speed. Its just sad for poor citizens are being jailed for simple social crimes.

Nothing could have happened. Rules of the game govern each game. Just like the then Lundazi PF aspiring candidate, Dr John Phiri and Muchinga PF aspiring candidate Dr Ngosa Simbyakula were disqualified from contesting their seats after arriving late by electoral officers at the Nomination Centres. These two gentlemen despite being PF pillars and ministers, PF or ECL could not save them from their own problems of failing to respect rules of the game, deadlines, time even if it meant easily giving away 2 seats for PF. Even PF could have been history by now just like John Phiri, Simbyakula, Sir Roy Welensky, UNIP, MMD. Rules of the game are greater than the game itself, players, referees & officials.
