Justice Minister Given Lubinda’s move to revisit the constitution welcomed

The Southern Center for Constructive Resolution of Disputes (SACCORD) has called on Justice Minister Given Lubinda to ensure he consults widely before making possible amendments to the current Republican Constitution.

SACCORD Executive Director Boniface Cheembe says the indication by Mr Lubinda that he wants to revisit the constitution is welcoming, but that this exercise will not yield positive results if stakeholders are not widely consulted.

Mr. Cheembe says it is motivating to note that the government has noticed that the current constitution which was signed into law in January this year needs a retouch.

He notes that there are so many clauses that are conflicting with other existing pieces of legislation, thus the need to harmonize them for best results.

Mr Cheembe adds that Mr. Lubinda should also keep an open door policy so that stakeholders can easily go to his office for input on which clauses should be revisited.

    • UPND, MMD, PF and FDD MPs sent that constitution to the president’s desk. Even the ones that absconded the constitution accepted it. Please rant on though, you are showing us your intelligence.

  1. 1. We as country have a bad reading culture
    2. The same people who are condemning ECL for the Constitution did not contribute a single paragraph on that document.
    =>Way forward: The constitution we have in place is one step ahead in fact two steps ahead. One we have a document. two it requires fine tuning.
    Due to poor reading culture, we are learning the HARD way. We saw what the ambiguity contained in the document can do for the one month the nation on stand still. We need simple English and remove ambiguous & duplicated clauses in stage processes.

    • What ambiguity are you referring to? The Constitution was very clear…Edgar was supposed to hand over to the Speaker until the petition was disposed of. But he defied the law. Cabinet ministers were suposed to vacate office but decided to stay on against the law. The law is supposed to be obeyed by all. You cannot finetune the law to suit the misdeeds and iniquities of those in power. This is the law of the land and is supposed to reflect the will of the people. No one is above the law. This revisiting of the constitution is suspect. The people of Zambia put those clauses in the Constitution. So for whom are they going to finetune? These chaps have failed to adhere to the checks and balances the constitution has put in place. They want it to suit the injustices they have committed. It…

  2. You can not start tempering with the supreme law of the land which is a people driven constitution unless you want it to be a Pf driven constitution.

  3. Also add a provision which states that “candidate who has previously lost an election as a presidential candidate cannot stand for a subsequent election”. Let us bring order to our political system and fast-track the youth into governance!

  4. Let’s keep the 50+1, tighten the Petition rules to ensure 14 days. Remove any handing over power to Speaker.

  5. This SACCORD must realise that there is nothing wrong with the Constitution. The wrong thing is that those in positions of power are failing to obey the Constitution. So revisiting it is not being done in good faith because all they want to do is fine tune it to suit their current conduct; to justify their wrongs and misdeeds. The Constitution is ok. For instance, the Ministers knew very well about the clauses in the Constitution that barred them from remaining in office. What did we see? They defied this law and went ahead and continued in office because it suited them at that time for the sake of using government resources to campaign.
