ZNBC Editors testify against Dr Mumba in the criminal trespass case

Dr Mumba confers with HH and GBM after the court appearance

ZNBC Editors yesterday testified against MMD leader Dr Nevers Mumba in a case he has been charged with criminal trespass and giving false information to a public officer.

During cross examination by state and defence lawyers, ZNBC Assistant News Manager Cosmas Chileshe told the court that he received a call from officers that Dr Mumba had visited the stations expressing his displeasure over a story which was aired concerning the presidential hearing.

He further said the newsroom staff informed him that Dr Mumba made running offensive remarks.

Mr Chileshe told the court that much as ZNBC is a public place, entry is restricted to safeguard security of the premises and the nation at large.

And ZNBC Sub-Editor Barbara Malilwe said she felt intimidated and shaken when Dr Mumba walked in the newsroom to inquire about an item which was carried out on the news and later asked her to speak out as she was the citizen of the country.

Mrs. Malilwe said the statement was intimidating as it was coming from an opposition leader and a Former Vice president.

And another Sub-Editor Arnold tutu also told the court how he felt belittled by Dr Mumba’s statement calling on him and others editor to speak out.

Mr Tutu said when walking out Dr Mumba threatened that he will make sure there was no inauguration on Tuesday and that he and other Editors were misleading the nation.

On 8th September 2016 in Lusaka, whilst and jointly acting together with other person unknown, Dr Mumba is said to have unlawfully enter into ZNBC newsroom with intent to intimidate and annoy the staff.

Meanwhile, UPND leader Hakainde Hichilema and his Vice President for Administration GBM were present in court to give solidarity to Dr Mumba.

The matter has since been adjourned to tomorrow for continued hearing.

And UPND leader Hakainde Hichilema who led his Vice President Geoffrey Mwamba to offer solidarity to Dr Mumba said they shall continue embracing the media as they have done in the past.

“We understand the numerous challenges that our Journalists go through in our country in terms of media freedoms and rights,” Mr Hichilema said.

    Donkeys hiho hiho hiho. Once respectable humans now turned three common criminals. And Matambo and Mwaliteta turned hardcore criminals, armed robbers. But all donkeys hiho hiho hiho hiho. But this government is really human, chief donkey is supposed to appear before woodlands police over his seditious remarks at his press conference, another lockable case. If such a caliber of people are allowed to rule this country, don't be surprised when Zambians start to flee to DRC as economic refugees. Who knew that one day a Zimbabwean teacher/lawyer/nurse/journalist would come & work as a prostitute in Lusaka? In the 80's when traveling to Zim, harrassment started at the border. You would be there the whole day just trying to cross into Zim whilst the immigration officers mocked, laughed at, threatened Zambians.       @Mop: you are right. This is the classic keep-them-busy in court so that they do not decampaign our crumbling rule. Nobody is going to jail over these feckless court cases and police harassment. What is sad is the amount of energy PF are spending on this instead of planning how to tackle IMF who will be seeking their pound of flesh. Why isn't PF concentrating on salvaging the little that is remaining of the economy, instead of harassing HH? It is not HH who is running the economy from police cells or courts.

    Where were the security officers when Nevers passed through the security? This means that the state is interested in mistreating opposition. If that is not the case then ZNBS is very irresponsible for not having a proper security. Mr. Kambwili and professor Luo stormed at ZNBS office last year and were not charged for trespass. Time for the state to stop the game of flip flop. If it PF member involved, it is flip, it is okay; if it is opposition or ordinary citizen not belonging to PF is flop, not okay. No wonder Zambia is not making progress, but sinking deep in economy." All citizens should be treated fairly, not selective.       @Ken, you've got it down pat. Supporters of these three in these court cases just do not understand the Law. There is a limit to how far one can go to register their displeasure, but breaking into a newsroom to incite employees to 'speak freely,' because you are going to make sure there is no Presidential inauguration, is plain bonkers when you have no authority in law.

      Mwamba Luchembe did not force himself into the newsroom. Maureen Nkandu, who was on duty that night, said they were used to soldiers coming in and out of the studio to check on security, she felt that everything was normal when Luchembe came in. Infact, she says they had some conversations, and she was very comfortable because he spoke to her very gently and nicely. He even asked her to play a song for him after having some discussions. It took a while for her to finally realise that he was serious when he asked to make his announcements. So, it was not like Luchembe just stormed the studios, no.

    Yesterday I attended this court session. If recall the National Airport, Bridges, Radio and TV Stations are classified buildings under the Security Act...therefore can you access them anyhow? Second Mumba says he went to lodge a complaint in the evening? What we will do in 2021 is we shall set up a Private Media Complaints Committee which will tend to such cases to water down the criminality associated with storming a studio.Anyway as we left Pretorious and Kelvin denied us access to say hello to our Leader HH. Today we are travelling to visit our colleagues in Solwezi on our continued search for the next direction for our party founded by AKM...

This is possibly the dumbest thing I have read in a week. We know you cannot "speak-out" against the ruling party but do us a favor and use excuses that actually make sense.

      It's not as dumb as your put down. You see, in law you must establish that you experienced some sort of damage, harm for the conduct you were subjected to to be seen as a crime. So if you say, 'yeah, he shouted at me, but I felt nothing emotionally,' then no crime has been committed as such. You must express what you felt so the law can redress the harm done you if it falls within intimidation, threat you must establish harm for a crime to be found.

    I thought this Mumbwe thing was jailed within fourteen days of trespass. Why are they delaying to arrest and put in him behind bars for treason. Whats the difference between him and Luchembe. Please arrest him - muchedya bwanji imwe!
