Late FTJ Chiluba’s property forfieted to the State

Share

Late Frederick Chiluba

The Anti-Corruption Commission (ACC) has forfeited properties of late second Republican President Dr. Frederick Chiluba to the State.

The properties are valued at over K40 million.

ACC Public Relations Manager (PRM) Timothy Moono confirmed in a statement to ZANIS today.

Mr. Moono said the properties in question have been on rent to various tenants from the time the Commission seized them and the rentals have been kept by the Commission pending the outcome of the Supreme Court proceedings.

The rentals accrued so far amount to over K14 million of which over K4million in the Kwacha Account while over $1.2 million in the Dollar Account.

“Dr. Chiluba did not make any claim for the property when the investigations were proceeding and at the time the gazette notice was issued.

” The current estimated market value of these properties is K40m and the judgment of the Supreme Court is that these properties and the money have been forfeited to the State,” he said.

Mr. Moono said the case involved Tedworth Properties Incorporation whose matter had been in the public domain and has over the years, attracted significant public interest.

In 2002, the ACC instituted investigations into suspected corruption in the manner Tedworth Properties Incorporation Limited, a company incorporated in Panama, acquired properties in Zambia.

The property acquired by Tedworth Properties are Plot No. 4828, Alberg Court, located along Addis Ababa Drive, Longacres, Lusaka which also comprises 21 residential flats.

Others are Plot No. F/488a/26/C, Horizon House, located along Leopards Hill Road, in Kabulonga, Plot No. F/488a/26/D, Chibote House, located along Leopards Hill Road, in Kabulonga in the Capital City, Lusaka.

The ACC public relations officer said the properties were suspected proceeds of crime and thus in the course of investigations, recovered and seized by the Commission.

He revealed that during investigations, it was established that the properties were being managed by local property managers namely Access Financial Services Limited and S.P Mulenga and Associates.

“On 30th September 2010, the High Court ruled in favour of Tedworth Properties Incorporated but the Commission appealed the judgment of the High Court but the Supreme Court overturned the judgement.

On 29th December 2016 the Supreme Court awarded with Costs to the State.

Mr. Moono however, regretted that the matter had taken long to reach conclusion.

Mr. Moono said fighting corruption requires a lot of commitment, patience, courage and professionalism in the face of adversity.

“The Commission will continue and has placed a lot of emphasis on prosecuting and recovery of ill-gotten wealth, regardless of the persons or entities involved,” he said.

PRESS BRIEFING

SUPREME COURT AWARDS TEDWOTH PROPERTIES TO THE STATE

I wish to thank you all for coming to this Press Briefing. The briefing has been called to highlight one of the major cases that the Anti-Corruption Commission has been pursuing and which has now been concluded by virtue of a Judgement in its favor, by the Supreme Court of Zambia. The case involves Tedworth Properties Incorporation which matter has been in the public domain and has over the years, attracted significant public interest.

In 2002, the Commission instituted investigations into suspected corruption in the manner Tedworth Properties Incorporation Limited, a company incorporated in Panama, acquired properties in Zambia. The Acquisition of these properties was done before Tedworth Properties Incorporation was duly registered with the Patents and Companies Registration Agency (PACRA) as a foreign company in Zambia, contrary to the law.

The properties that Tedworth Properties acquires included the following:

  1. Plot No. 4828, Alberg Court, located along Addis Ababa Drive, Longacres, Lusaka. This property comprises 21 residential flats.

  2. Plot No. F/488a/26/C, Horizon House, located along Leopards Hill Road, in Kabulonga, Lusaka.

  3. Plot No. F/488a/26/D, Chibote House, located along Leopards Hill Road, in Kabulonga, Lusaka.

During investigations, it was established that the properties were being managed by local property managers namely Access Financial Services Limited and S.P Mulenga and Associates. However, the said property managers were unable to disclose the real beneficiaries of the said properties and it was suspected that they were unlawfully acquired using public funds disguised as a loan. The properties were therefore suspected proceeds of crime and thus in the course of investigations, recovered and seized by the Commission. A Gazette Notice was issued on 4th February 2002 to Tedworth Properties Incorporation informing the company that the properties would be forfeited to the state within three (3) months from the date of the publication of the Notice if there was no claim to the properties.

Three months elapsed and no claim was made on the properties hence the Commission issued an Order for the Properties to be forfeited to the State pursuant to the Corrupt Practices (Disposal of Recovered Property) Regulations of 1986.

After the Order was issued, Tedworth Properties Incorporated through its lawyers commenced an action in the High Court seeking a declaration that:

  1. It was the rightful owner of the properties in issue

  2. That the declaration that the Notices Issued pursuant to the Corrupt Practices (Disposal of Recovered Property) Regulations were illegal

  3. That there be an order reversing the Notices issued by the Director General of the Anti-Corruption Commission for the forfeiture of the said properties and costs.

On 30th September 2010, the High Court ruled in favour of Tedworth Properties Incorporated. An order was also issued for the Commission to hand back the Properties to Tedworth Properties Incorporation and to also render an account of the management of the same properties.

The Commission appealed the judgement of the High Court to the Supreme Court of Zambia.

On 29th December 2016, the Supreme Court delivered its judgement allowing the appeal with Costs to the State. The decision of the High Court was overturned and it was stated as follows:

  1. That the Corrupt Practices Regulations were legal

  2. That the Gazette Notices Issued pursuant to the Corrupt Practices Regulations were legally issued

  3. The disputed properties were effectively and legally forfeited to the State.

You may wish to note that although the property managers refused to disclose the details of the persons who were claiming ownership of the properties in question, the lawyers for Tedworth Properties Incorporated later and in Court, disclosed that the purported beneficial owner was the late Republican President Dr. Frederick Chiluba. However, it was noted that Dr. Chiluba did not make any claim for the property when the investigations were proceeding and at the time the gazette notice was issued.

The current estimated market value of these properties is over K40 million. The said properties have been on rent to various tenants from the time the Commission seized them and the rentals have been kept by the Commission pending the outcome of the Court Proceedings.

The rentals accrued so far amount to over K14 million broken down as follows:

  • Over K4million in the kwacha account

  • Over $1.2 million in the dollar account.

The import of the Judgment of the Supreme Court is that these properties and the money have been forfeited to the State.

The matter has admittedly taken long to reach conclusion. Fighting corruption requires a lot of commitment, patience, courage and professionalism in the face of adversity. The Commission will continue and has placed a lot of emphasis on prosecuting and recovery of ill-gotten wealth, regardless of the persons or entities involved.

The Commission would like to thank all the stakeholders who were involved in assisting to bring this matter to finality and these are the Drug Enforcement Commission, the Zambia Police Service, the Security wings and you the media for keeping the matter alive in the public domain.

The Commission would also like to take this opportunity to once again call upon members of the public with information on any persons involved in corrupt activities to report them the Commission. The Commission values the support it continues to receive from the public and all stakeholders and will continue to execute its mandate for the benefit of all in Zambia.

    • Zambia has got back it’s money???

Do you know how much Mwanawasa’s friends got out of the prosecution?

Mtembo Nchito alone was getting K2bn (K2m rebased) a month to 7 years. An you all you can celebrate about is K40m??

Do you know how much Mwanawasa gave to Mmembe and Mtembo Nchito??

Through DBZ alone they got K14bn (K14m rebased) , and K27bn (K27m rebased) through NAC, and K9bm (K9m rebased), among many other things.

These are some of the things Mwanawasa did as part of his legacy.

Those of us who understand economics, investments and policy will tell you that Mwanawasa enjoyed the fruit of Chiluba policies, sacrifice, and effort, but did considerable damage such as what has been stated above.

    • Kafupi was a conman and a crook and he was directly responsible for enriching another crook by the title of Hungry Hyena (HH) – HH was Kafupis chola boy during privitisation as well as a Zamtroop advisor but these dunderheads from the United Party for National Destruction already know that yet they pretend- what 1mbeciles!

    • PF have been controlling the ACC for 6 years now and have not proven a single charge against HH. Is it incompetence or there’s no substance to their mudslinging? Either stay quiet or prove your rumours, you cowards. That’s no room for incompetence when running govt.

    • I have never agreed with you except in this case. I hate people who have canonized this little thief. Same for, HH and Banda and his clan. I thief is a thief

    • Report someone corrupt to the Commission? How about you start with Lungu? He never disclosed how he got the increase in assets, from K10 million to K23 million in 16 months. Why don’t you start with him? And recently he announced that his ministers were already looting the national coffers. Get to them too. Check their bank accounts. Check their salaries and double check with what’s in their bank accounts. If you see that their bank accounts are getting fatter than their salaries, then you’ll know they’re up to no good. Drill them till they disclose where they’re getting the extra monies from. If they can’t explain seize their accounts, and have them arrested and prosecuted for corruption. Then send them to prison for a minimum of 15 years. If you do that, you’ll earn the…

    • (Continued)… country’s respect. Now we’re waiting, to see whether you’ll do it on not. Come on Commission. You can do it. Don’t let anyone intimidate you! We got your back guys. Go get them.

    • Kleptomaniac pygmie. Zambians must have been watching The God’s Must have Been Crazy to elect this one~

    • Thanks should go to the right person MWANAWASA….unfortunately if you ask me I am just saddened that these assets are being handed over to the wrong Government. And there were people saying Levy was wasting resources as if fighting crime is a profit making cause …I feel sorry for us the Government has been noticeably quiet about this significant ruling. ECL was quick to say ACC are not working, well if you leave them to do their work they will deliver…you are just corrupt boss

    • @PoP You’re right levy’s fight against corruption was both vindictive and a smoke screen to hide his own wheel dealing.

    • @PoZ You’re right levy’s fight against corruption was both vindictive and a smoke screen to hide his own wheel dealing.

    • Lack of vision Chiluba was a bemba tribalist and would never have appointed HH his chola boy.If HH was his chola boy where do you place V. chitalu and F Kaunda who was even convicted for stealing from privatization.Chiluba was so tribal that all ministers of finance he appointed in the 10yrs of his rule had to be bemba. On retirement GRZ seconded a qualified lozi guy as his personal secretary he rejected him and looked for a green horn bemba chap to be his secretary. You are just jealous of HHs achievements.

    • @1.10 Nubian Princess

“Kleptomaniac pygmie. Zambians must have been watching The God’s Must have Been Crazy to elect this one~” You mean that one?

    • @1.5 nono

I wonder who it is you refer to whom you “…have never agreed with except in this case”? Is it the author of the article?

    • Chiluba surrounded himself with bad people. Bad company corrupts morals. He was not only a thief, himself, he swam with the sharks.

    • @2020vision, are you sure about your insinuations on the HH and FTJ or you just loathe HH? Let me assist you. Investigate a one time powerful Organisation called the Zambia Privatization Agency under the leadership of one Valentine Chitalu, you will soon know who stole from Zambian people. After that you turn to Francis Kaunda, former ZCCM CEO and Chairman who was leading a team on Mines privation and assisted by people like Enock Kavindele as Commerce Minister then, Ronald Penza as Finance Finance Minister then and other like Luke Mwansnshiku, then you will realize that kanshi you are pointing an accusing finger on an innocent man (HH). TRY THIS EXCERCISE. I bet you will be shocked with what you will discover.

  1. For the first time in a long time, Zambia has got it money back. Give some of the money to Lusaka city council and Kitwe City councils. Dirtiest cities in Zambia.

    Viva President Nawakwi.

  2. If this is true, may signal a new dawn for sanity, & development in our nation that has been r@ped by bandits at the top without consequence or deterrent.
All you ex- Presidents, know Your corrupt activities WILL NOT PAY!!

    • However I still believe justice should be swift, so these embezzlers/ economic saboteurs languish in Chimbokaila, & Mukobeko.
Only then will the trend of getting into plot 1, owning one suit, a pair of shoes, & a spoon like Dead Kafupi, & this current plunderer, then within months mysteriously become so wealthy to able to buy a Jet plane STOP!!

    • The tearing apart of Chiluba’s “legacy” is the only thing Mmembe will be remembered for. This is a warning to Lungu and his tandem of PFhieves that Zambia will get even with you, however long it takes, even from your graves.

    • @Buck Teeth Lungu, your hatred for anything PF is really making you go CRAZY! I thought the one who refused to register the London Case was President Rupiah Banda and not Sata. I may be mistaken, but I think you wrong on this one.

  3. Next is Kambwili properties in Luanshya, Ndola, Kitwe, Lusaka and here in UK registered under the wife. The UK Serious Crime Department already confiscated properties of Nigerians who bought them from stolen monies. Zambia is already on radar known to have corrupt leaders intending to launder the stolen money through properties acquisition in UK. Kambwili and others on UK watch list.

  4. This is nothing compared to what ruphia and lungu have siphoned . We will only know the impact of their thefts once they have died. Any way they will.soon perish because thieves who steal elections and cause poverty to their own people don’t live long.

  5. Lungu is going to buy all of them off the state at a discount price. He has to keep up with CK’s appetite of accumulating properties.

  6. Zambia has got back it’s money???

    • Whether you like it or not President Mwanawasa has been vindicated even in his death. The man you trying to defend has been convicted even in his death.

    • @ 12.1 Chalobantu,

Say what you want it won’t change facts.

It is a fact Mwanawasa thrived on chiluba’s policies and effort.

It is a fact, it was Mwanawasa who gave Mmembe and Mtembo Nchito the money’s stated above.

It was Mwanawasa, instructing Magande, who gave Mmembe and Mtembo Nchito illegal tax breaks, cases of which RB began to follow up in 2009, but which were promoted by Sata, and now have seen the post liquidated

These are facts, whether people are blinded or not, facts don’t change. People can only be deceived but facts won’t change.

Even if you and I may choose to agree wrongly and apeace ourselves and smile the widest we can, all will be futile if we are not in tandem with facts.

So what is the use of arguing if a choice has already been made to…

    • Other circles will criticise you about Mwanawasa but that’s the truth, hypothetically let’s say if Mwanawasa Was properly vetted would he have been president? The answer is simply NO, this is simply because he had corrupt relationships with the likes of Issa Galedou & the rest. Mmembe & his allies benefitted a lot and yet now we re celebrating the seizure of FTJ’s estate not that it’s wrong. Kafupi had so many skeletons imagine that he made us believe that Moses Katumbi was Zambian & sold him the rights to fish from the lates at the expense of his fellow tubulus. The list is endless however this is a good start.

  7. How is it that Mushota is always one if the first people to comment on a post? She is always on the Lusaka times page standing by waiting to comment on every new article?
Or maybe she is just a fictional character created by LT . To get more people to comment.

  8. Well done Mr lungu.

But can we now get down to the topic at hand, the Malawian maize scandal. Can you please say something.

Announcing work that should have been done will not make the Malawian maze scandal delinquent from your name. You need to say something.

  9. …these are proceeding sliding from one corrupt right hand pocket straight into another corrupt left hand pocket….the corruptees are rubbing their hands…swallowing saliva on the so called forfeited properties…by the end of this 5 year term ask me who the owner of these properties shall be…in disguise of auctioning….

  10. Shameless *****s stealing from a dead man. Can a president fail to have $1.2m? Really? This was repeated by Sata when he confiscated $1m Mpundu trust from Mrs RB who got a loan and built flats.

    • Its called recovering contraband from A Stiff Dead Thief!!!
This little short cowboy only had One suit, One pair of shoes, & a spoon to his name when he came to power.
      Use your Brains Joseph please!!
With your type of reasoning any wonder Africa has become the Cesspit it is after the Colonialists left us??

    • You re missing the point Joseph, it’s not that a president can’t have that kind of money but the pointer is that it’s money gotten from criminal activities. Infact they must pass a law to forbid these crooks registering property in their wives names, how on earth can a house wife accrue millions of dollars? On this part the law protects these thugs in suits.

  11. Shameless *****s stealing from a dead man. Can a president fail to have $1.2m? Really? This was repeated by Sata when he confiscated $1m Mpundu trust from Mrs RB who got a loan and built flats. There is no investigation by ACC. They just follow instructions from politicians in power.

  12. All the while this little Dead short Corrupt weevil “Kiluba” was attending Church, & busy declaring Zambia “A Christian Nation”
Biggest Serpents are seen & hide in Churches, & synagogues of the Demagogues

    • Imagine! If the devil declared Zambia a Christian nation the citizens would still blindly go ahead and rejoice and recognise this. Africans and their blind loyalty

  13. No dig that thing out of those sacred Embassy Park grounds he is desecrating! Give him back to his relatives in Kolwezi in Katanga to do with his remains are they wish. And this is the scam of the world Rupiah let off the hook and arranged with Judge Chinyama to acquit on other stinking thieving cases! I mean, I was walking past his grave two years ago and it was still stinking bad so long after his demise that I celebrated. That was how bad that little crook was.

  14. HELLO, it looks that you have forgotten US$ 46,000,000 against Chiluba awarded to Zambia by judgement of the High Court of England which RB, Sata and ECL have refused to register in the High Court of Zambia and thus deprived treasury of substantial amount of hard cash.

  15. We are going after Chiluba now so when will we be going after Kambwili? I strongly believe Ka Lungu is afraid of Kambwili because he has something on him. The proof is there so why are we delaying? How long does it take to go to court? There is something Kambwili knows that Lungu is fearful of. Lungu went to the Copperbelt but just to show he has muscle but in fact he is a scaredy cat. Even a kid can put two and two together in this case. How much is Kambwili’s salary and what are his expenses and what is remaining (net income). All those properties combined plus other assets, how did he get them? Ba Lungu bakai nyelawila nga landa ichishinka!

  16. It’s a LESSON to LUNGU & his cronies. We already know your properties in Lusaka, Johannesburg & Dubai.

It’s not only Kambwili with dubiously acquired properties. African leaders are a shame. Amidst poverty, they steal big without impunity.

Just look at the son to Equatorial Guinea President, Teodoro Obiang Nguema Mbasogo: How do you buy a house in Paris for 100 million euros plus Rolls-Royces, racing cars, private jets, bespoke suits etc when your people are in poverty?

How do you take another woman’s husband & his mother & his Ex-Girlfriend to Las Vegas when the people who voted for you are in abject poverty?

    • So you let a corrupt man go because fighting him/her will be expensive.
Every war has got a cost and only fools can expect a profit out of a war.

  17. Now tell your vision less leader that his time is also coming. Chiluba thought that he was god. Its very retrogressive that we should allow such callous behavior from our leaders to amass wealth at the expense of the poor. Chagwa has amassed more tha K 23million in less than 2 years in office and you morons the ACC are watching, had it not been for the true son of Zambia Levy Mwanawasa these properties would not have been recovered. PF, today you think you are untouchable but your day of reckoning is coming. Where is Regina by the way and the loot the was discovered in Europe, we want that money as well, cage these criminals and send the to the gallows. Bapompwe imwe.

  18. Chiluba was Zambia’s greatest con man. Declared Zambia a christian nation and while people closed their eyes in prayer he looted. But Zambians are naturally stup!d, they never learn anything. Another thief, Lungu, has burst on the scene, with a track record of dishonesty, a shameless thief, and this is public knowledge, but that’s who they have allowed to govern them. Are they going to be shocked, when they discover he has plundered?

  19. uhmmm……leaders of nowadays are very alert. They hide the loot in other people’s names or companies. It’s difficult to catch them. But for someone accumulating more than K10m in 16 months I think can be properly investigated and how he got that wealth clearly established unless a ‘friendly’ President succeeds him.

    • Just imagine! Someone was ‘acquitted’ but today the government has seized what he had stolen. What kind of a country are we?

  20. its a shame and I feel sorry for the kids. But how does govt expect Chiluba to defend himself in his Grave? What a Lame conclusion.

Lungu is the worst thief I have ever known in my Whole entire life.

  21. Just a question from a layman. If Chiluba was acquitted by the same Supreme Court of theft, how come the same properties in question are then forfeited to the state. Were the same properties not part of the Criminal case? Can some learned person please clarify for me.

  22. The court fortified the assets to the state ,this means that the have just fortified them to another blunder, from chiluba to lungu,

  23. If forfeited to the state, what will happen to them? Will they be sold? Can the money be given back to tax payers in the form of say a 1% tax shield? Etc, many questions to be answered.

  24. A good win for the ACC. They deserve a morale booster. That agency is perpetually under attack and at last this is a positive step for them. So congratulations ACC.

  25. This is a waste of time … this property will probably be auctioned in a closed bid to benifit a few corrupt individuals in GRZ

  26. CONGRATULATIONS ACC, NOW LISTEN. THE GOVERNMENT HAVE TO CONSIDER THE FOLLOWING OPTIONS:
    1. USE PART OF THE MONEY TO BAIL OUT CONCIL RETIREES
    2. RESTOCK SKILLS CENTRES THAT ARE CURRENTLY STRUGGLING WITH EQUIPMENT
3.SPONSOR GENUINE VULNERABLE STUDENTS AT UNIVERSITIES AND COLLEGES WITHIN ZAMBIA
    4. KEEP THOSE PROPERTIES FOR INCOME GENERATION FOR CONTINUED SPONSORSHIP TO OTHER NEEDY AREAS OF EDUCATION, SKILLS CENTRES AND HEALTH CENTRES.

  27. FTJ stole for his own sake not his tribe. Just come to our village Musangu it’s like it never produced a president. It’s worse than a place that produced a house boy.

  28. Some people are thinking K40million is not a lot of money, do you knw how much it was in 2002 when these property were been seized??
