Zambia had multiple law associations before it became a one party state-Kelvin Sampa

THE proposed establishments of other law societies have nothing to do with the predicament in which the current Law Association of Zambia (LAZ) administration has found itself in, says PF Kasama Central MP Kelvin Sampa.

Mr Sampa said Zambia had multiple law associations before it became a one party state to which lawyers belonged.

Last week, Mr. Sampa drafted a Bill to facilitate the establishment of other law societies apart from the LAZ.

The bill provides legal practitioners a choice to belong to any association of their choice as long as they were ordinarily resident in Zambia and had been admitted as advocates and their names were entered into the roll of practitioners kept under section 5 of the Legal Practitioners Act.

According to the bill, notwithstanding subsection (1), no person in Zambia or anywhere else, who had been suspended from practice or whose name had been struck off a roll of practitioners shall be qualified to become a member unless the period of his suspension had expired or his name had been restored to such a roll.

Mr. Sampa said it was unfortunate that some people within LAZ had taken his drafted proposal as a political move aimed at suffocating its embattled leadership.

He said it was sad that there were people who never took time to read the history of Zambia and only jumped to misguided conclusions out of ignorance.

He said Zambia had many associations before it became a one party State and wondered why his proposal was taken as something alien to the country.

“You see, there is nothing new about my proposal and people should not align it to political interference because of what the current leadership at LAZ is going through,” he said.

  1. I have read Zambian history, I don’t encourage to go back to one party state, and close down The Post newspaper of close LAZ. Zambia shouldn’t have multiple Football associations like Kamanga & Simaata did in history.
    I don’t like Zambian elections history, which records Kelvin Sampa stealing votes from GBM daughter. Kelvin is evil.

      Sampa should just say that PF bandits what to create a fake katemba as an association. LAZ is here to stay, so is its president~Professional Linda Kasonde who respect the constitution & laws of the country & not bandit Sampa.

    • PF know they are corrupt brutal failures, hence the intention to silence any opposition. Post news paper, LAZ, The ICC etc etc and by the very same breath saying they are born again and born again in Israel and calling for endless prayers to deceive the dumb.
      By the very declaration that Zambia is a Christian country meant God has the final say. Lungu! Where is Ka tricky Ftj? RB? and KK?

    • Let’s say the truth on the Post please. Whatever has happened to the Post is for the good of the country and if you can remember the way the post was treating Zambians. I honestly don’t think any zambian can be sad with the on going. Let the post fight it’s own fight this is the reason GBM is not interested in fighting for the Post. For LAZ yes you right all lawyers must belong to one organ for the sack of togetherness.

  2. I thought Linda Kasonde herself acknowledged a few weeks ago that there is no law against forming other Law Associations in Zambia. So did she think people/MPs were bluffing when they intimated that this is coming? Why such a reaction when they think the current LAZ is perfect and has done no “wrong”?

    I think Linda and her ilk at LAZ realizes the “GRAVY TRAIN” they been able to abuse and use with impunity is about done. They are worried plenty of their members will leave to form or join other associations and leave LAZ high and dry. But some of these problems are LAZ’s own making. You can NOT behave like a political arm of some political parties and expect people to stay mute about it.     • Up to now LAZ President Ms Linda Kasonde and her entire Executive have failed to discipline Ms Martha Mushipe the lawyer for the Supreme Leader HH of the UPND for gross misconduct…and LAZ wants us to believe that they are not partisan…

    • There are some ethnic groups in Zambia who love chaos, create chaos, live in chaos and thrive in chaos. They will do anything to disturb the peace and create crises where there should be none. This Kelvin Sampa belongs to one such group.

  4. History is not going to repeat itself for the sake of repeating itself. Each LAZ executive needs to be free to run the affairs of LAZ members without undue influence from politicians. The political myopia of divide and rule tactics has hit a snag. LAZ will emerge stronger than ever. The law profession is a noble profession. LAZ does not condone violence. LAZ stands for the rule of law and respect of human rights. In a democracy, it is necessary to provide comprehensive checks and balances. Among interest groups in the country, LAZ is very special to all advocates of justice, lawyers and non lawyers. This person who is championing this bill and his sponsors should wake up to reality. We have already wasted a lot of time and the economy is in decline,

  7. The UPND rally must go ahead in Kanyama. We are in a democracy, everybody has a right to choose which ever medium they want to address their supporters. Zambia is not in a state of Emergency and therefore the Police have got ABSOLUTELY NO powers to stop a rally. The President must be the first to scream at the Police for this nonsense. I have no faith in both the PF and UPND, but the police must be CIVILISED and stop this stone age tactics for a party that wants to advance its party programmes.

  10. Name the multiple associations that existed before one party. Does the circumstances that existed then the same now? To assume that people dont read history is the same excuse used over the constitution when the President was signing at Heroes stadium.
    The biggest problems with the current politicians is that they claim to have more knowledge than any other and what they say must be religiously obeyed without opposing view.
    I cease to trust them because very soon we shall provide legal services to have their rights protected from their made laws…… Wait….. See…..

  11. Dear Mr. Sampa. It is not true that before the one party state there were multiple parties. FTJ did what you are doing to the Trade Unions. It is because of this approach that the media has refused to be regulated by the likes of you. I am not sure that LAZ has got its act altogether but it would be interesting if you also help re-write how one gets a practicing license maybe allow for multi zailes so we churn out more lawyers. Or better still lets have multiple constitutional courts, high courts etc. Last you have NOT drafted a new bill you have simple written into the existing act what you wish to see. Anyway enjoy the money from your contracts to supply poles all the way to Zims we are watching. 2021 Zambia forward under new leadership

  12. Kelvin Sampa is not clear on what he wants to achieve. Can the Government go to fight Linda Kasonde like that? They can surely do better than that. Don’t they have intelligent department which can help them fight Linda Kasonde? No wonder people are behaving as if there is no govnt. Deal with them. Do not use unnecessary force to fight small items.

    Some comments made above seem to suggest that the situation of having many law associations was during the one party era, according to Hon Kelvin Samoa this was BEFORE the one party era.

Sampa, stop behaving like a thug and behave like a person who represents people of your constituency. Is this what the people voted you for? Instead of tackling poverty in your area you are fighting people of integrity and uprightness. You are trying so hard to impress the visionless one, ask your friend Ichimbwili. But we are in a mercy with these dull MPs who want to please one person called Edgar Lungu, SAMPA look regardless of how you triy to defend your intentions with your PF Zambians know what you want to turn this Country into, but remember God is watching no matter how evil can seem to rule, there is always the truth that comes to expose the evil whatever you are doing this time you think you are clever but the time of reckoning is coming soon for God never forsakes his own children he shall surely liberate us from the torment that we have gone through with PF.   17. Kelvin, that was then. Let’s not destroy what’s good because of one person (Linda). If Linda is compromised time will catch up with her, it always does. But for the time let’s forget about disturbing what we have. Remember FTJ destroyed all parastatals because of his hatred for KK. Result is we lost thousands of jobs. This is still haunting us and will for the foreseeable future.

    • Ndanje, i see it more of fixing a loophole that should not be exploited by other lawyers in the future rather than a political ploy to silence and destroy dissenting views. Even if Linda was removed or the entire executive, in it’s current form, LAZ is susceptable to exploitation by crooked and cunning lawyers and politicians. I feel better to fix now and prevent a similar situation in the future. Because if LAZ was leaning toward PF, the opposition would cry and when they come to power would do the same. Your thoughts?

    • @Ndanje am consent with you. I further do not agree with Kelvin Sampa that there were many associations. Pre-LAZ (1973) as taught at ZIALE (Professional Ethics course) there was only one Law Society. Thinking of it if there were many societies, who were its members as at the current the whole Zambia has only about 1,000 legal practitioners. At independence there may have been just a handful of lawyers (Mainza Chona and team). I can imagine how many lawyers were there pre-1973. As advised by Munshya, what needs to be looked at is not LAZ but increasing the number of Bar schools (ZIALEs). An increase in the number of practitioners will resolve all the contentious issues. Check whats happening with ZICA, EIZ, MIZ etc. These are sole regulators but even with very high numbers of members they…

  20. An appeal to all who use water from Nkana Water and Sewerage, let’s boycott paying bills until this company installs prepaid meters. Currently their billing system is a exploitative and a disaster.

  21. @Nez, I don’t normally want to talk to you. But just to update you on this : most these people were employed in Kaunda, Chiluba and Mwanawasa eras so how can they be PF. This has nothing to with politics please for once come out of political dreams to reality.

  22. The Law Association of Zambia (LAZ) is the successor of the Law Society of Zambia. LAZ is established by s. 3 of the LAZ Act, Cap. 31. The Law society was the organization to which lawyers belonged before LAZ was established in 1973. The Council, committees and membership of the Society became the Council, committees and membership of the Association when it was formed in 1973. Under s. 3 of Cap 31, LAZ is a body corporate, i.e. it has its own legal personality, capable of being sued and suing in its own name and can run its own affairs. It exists to fulfill its very wide-ranging objects that are set out in s. 4 of Cap. 31, and cut across both the legal and other aspects of life in Zambia.

  23. LAZ IS CAPTURED
    It no longer represents the views of its members but those of the Executive narrow political patronage. Many a time when something pops up that needs legal comments or opinion, overnight we get LAZ position on it. There is no consultation from within or its general membership. But we know that external people sponsor those opinion and push them through to the LAZ corrupted leadership to make them legit. And you if you did deeper that opinion was the work of few individuals who have captured the association with the help of their sponsors. And that not to mean that ruling past government regimes has not done the same in the past. If you are a member of LAZ and you give different opinion you are targeted for sanction that could include expulsion. Its therefore refreshing…

      in fact in the past ,LAZ members especially the Executive Team have always been the first ones to get rewarded with lucrative government jobs for the work done whenever there was change of regime. We are wise now, in this time and age we should not let Public associations to be dragged into politics and abused for the interest of a narrow and selfish group of persons. Lets have more LAZs , after all it will not hurt anyone more than a change of the law legally so in parliament. WHAT ARE YOU AFRAID OF????

    This piece of legislation is going work against them in the long run. Ask the unions if yo legal brains are stunted.
    Linda Kasonde is not going to stay there forever for a danderhead like Super (Sampa) to advocate for multiple societies. LAZ Presidents come and go. STOP THINKING WITH YO STOMACH SAMPA

The MP has not mentioned the advantages of dissolving LAZ and creating other law societies.Until he does explain in detail and convince the nation that the proposed plan is of the benefit for the better of the law profession and the public, the bill remains a cynical ploy with connotations of self interest,if not for himself for the ruling party or both.

  26. We need a strong LAZ not a splintering of our legal systems. Splitting will weaken our legal system and further expose it to manipulation and set the associations to fight each other. A good example is what happened to the labour union, Frederick Chiluba dismantled it,he came from the same Union and new their strength so he had to weaken them.The same goes for LAZ our president being a lawyer feels threatened so use the same method,weaken them.

  27. A good example is USA which has multiple law associations. LAZ should not be scared of this. Even ZIALE needs to have competition. It’s a school run by a cartel.

  28. Lazarus, please take a leaf from the various Teachers’ Unions that sprang during the Chiluba Era. They were encouraged by Chiluba to dilute the strong bargaining power ZNUT had. Look now, they want to unit and go back to one Union. LAZ, please ignore Kelvin Sampa. Let’s have the interest of Zambia at heart.
