INSPECTOR General (IG) of Police Kakoma Kanganja has told a Lusaka magistrate’s court that he is still hurting from allegations made against him in Facebook posting by Chilufya Tayali that suggested he had something to do with the Mongu incident over which opposition leader Hakainde Hichilema has been accused of treason.
Mr Kanganja said Tayali’s posting made in April in the aftermath of the incident involving Mr Hakainde’s motorcade and that of President Edgar Lungu as they headed for the Kuomboka ceremony, was ” 100 per cent criminal” and a clear indictment of him to be charged with treason.
Mr Kanganja testified that the posting brought ridicule, hatred, contempt and uproar in society as most people were calling for his resignation.
“I was shocked when I read the article. It is still paining me. I swore to protect the Constitution of Zambia and the President as well as everyone, Hichilema included. This article brought hatred were people started calling for my resignation,” he said.
Tayali has been charged with the offence of libel, under section 191 of the Penal Code Chapter 87 of the Laws of Zambia.
This is a substituted offence and when the matter came up yesterday for opening of trial, the accused took a fresh plea and denied the charge.
Particulars are that Tayali on April 13, 2017 with intent to defame Mr Kanganja did unlawfully write and publish on social media, Facebook a defamatory statement saying:
“Kanganja is just covering his inefficiency to charge Hakainde Hichilema with treason, otherwise he should be an accomplice, where was his police to clear the way long before? “That should have never happened, but maybe Kanganja planned it that way to kill the President or frame Hichilema…which statement injured the reputation of Kanganja by exposing him to hatred, contempt and ridicule,” read the particulars of the offence.
The IG said he became aware about the writings through numerous phone calls from a cross-section of the society and was forced to ask for a printout from Zambia Information Communications Technology Authority (ZICTA).
And in cross-examination Tayali sent the court into laughter when he said that he felt not protected by the court as he felt intimidated to cross-examine the IG because of the way he was responding.
Magistrate Felix Kaoma then told him that he was protected by the court and asked him to go ahead.
The accused applied for an adjournment because he wanted to come with some audio and visual recordings to defend himself.
Matter comes up on July 17 this year for continued trial.
Everything Tayali wrote sounds true, except word “kill”. In a nutshell, its embarrassing for such a senior officer to be a witness in court.
No free speech in Zambia.
Tayali should be ashamed of accusing a man integrity in kanganja.

IG needs to be tried for all these crimes after PF leaves office. The fact that he has never charged any of these officers makes him an accessory to the crimes.

If Kanganja printed the Facebook post by himself then Tayali and his Lawyers were going to say that KANGANJA HAD EDITED THE POST. But if it come from ZICTA they can not dispute because it is the authorized body to compile such data.

Tayali is naive and confused. The Motorcade Incident is what triggered the Treason Charge. Why did the State drop the Charge thru a Nolle Prosqui? The State realised the Motorcade Incident cannot justify Treason and on Trial that would open a can of worms and embarass the State. HH’s Convoy was cleared to be on that Road. Why did Lungu’s Motorcade ambush HH’s Convoy on same Road? It was planned that way with an objective to frame HH and slap with a Treason Charge which is unbailable. The State wanted this unbailable charge so that they can hold HH in Jail to ransom and only release him from Jail on condition that HH has withdrawn the Petition from the Court and he has publicly recognized Lungu as President. HH credits himself to be an intelligent man. It’s common knowledge and part of your driving test to understand that when you hear sirens and see warning lights on emergency vehicles such as Ambulances, Police Cars and Fire Trucks you simply give way. Why didn’t HH simply stop his convoy to give way? Late President Mwanawasa was almost killed by such overzealous behavior. If HH refused to stop because he simply didn’t recognize Lungu as president then he is in the right place and rightly charged because it’s a treasonable offense to rebel against an elected head of state. HH till this day has failed to provide proof that he won the 2016 elections.

This indeed requires a public inquiry conducted by the Department of Public Prosecution (DPP) or its equivalent in Zambia so that the whole country is better informed of the wrongs that have been done.

The TRUTH has finally vindicated us! One thing for sure is the way ECL was moved in Mongu was extraordinary. That is no way you move a head of state. It was a very dangerous way to move a head of state where the motorcade is made to overtake mobile vehicles. We know there was enough manpower deployed who could have cleared the road of all moving vehicles. We also know that three Helicopters were on hand to airlift ECL. Its not the IG’s fault. Mr Kanganja is simply carrying out instructions from his Boss, the Commander in Chief (ECL ) who in turn carries out orders from the King Maker (KZ). This ambush was planned and Kanganja,Lungu and KZ are brains behind the Treason Trap. The IG is trying to shed some crocodile tears while intimidating his Critics and telling them to shut up. The State withdrew the Motorcade Charge to avoid the ambush being exposed during Cross Examination. I am baffled by the support Tayali is getting from some bloggers here. The truth is that Tayali libeled the Inspector General by making baseless and unsubstantiated allegations against him. Tayali, in my view, deserves no sympathy whatsoever from any balanced court of law or law abiding and patriotic Zambian citizens. Imagine him doing what he did to the Inspector General to you! Would you even enjoy your Mosi at Lusaka Club? As far as I am concerned, Tayali is just an egotistical, publicity – seeking narcissistic individual on an ego-trip who is a danger to many of us and needs to be caged.
