UPND to challenge Speaker’s 30-day ban in court

The opposition UPND has announced that it will challenge the decision by Speaker of the National Assembly Patrick Matibini to suspend 48 of its members for 30 days without pay for missing President Edgar Lungu’s speech to Parliament.

In an interview, UPND Chairman for Legal Affairs Jack Mwiimbu explained that the MPs will take the matter to court as they believe that the Speaker acted ultra vires by suspending them for 30 days.

Mr Mwiimbu said the party will be seeking a judicial review to challenge the decision of Dr Matibini.

And UPND Parliamentary Chief Whip Garry Nkombo says posterity will judge Dr Matibini for his emotional decision to suspend 48 opposition MPs.

Mr. Nkombo has charged that the Patriotic Front wants to manipulate the Constitution in the absence of the UPND MPs.

Speaking at a press briefing at the UPND Secretariat last evening in Lusaka soon after the suspension, Mr. Nkombo said the suspension would not deter the MPs  but that they would emerge stronger.

Mr. Nkombo reminded the speaker that the suspected MPs were elected members and not appointed or nominated.

“For now, it is 1-0 in favour of the Speaker but we are sure that posterity is going to give a judgment to the manner in which he has handled not only ourselves, it is the manner he has handled the country. It is not about an individual Member of Parliament, the manner he has handled the country today, the emotions he has displayed leaves much to be desired. But we stand firm and we will serve his suspension and this will not change us in a single bit. Instead it will emerge us even stronger,” Mr. Nkombo said.

“That’s how defective this ruling is, when you apply emotions to the decision. Posterity will judge the Speaker when that time comes and there is no hiding from that fact. We are people’s representatives, so as things stand, he will represent all of us in our constituencies, 48 of them. It should never be forgotten that we are elected Members of Parliament, elected not appointed or nominated, we are elected.”

Mr Nkombo who is the Mazabuka Central MP said the 48 were suspended because the UPND has refused to recognize President Edgar Lungu as Head of State.

“But we will take this issue as it comes because we stand resolute to tell the nation that even the issue which was itching in his ruling, the issue that came very very prominent…I think that based on his own imagination that the matter is squarely sitting on the square of recognition of President Edgar Lungu. It is a confirmation that is the matter which continues to keep PF scared of the truth. The truth has no disguise, the truth can germinate even on concrete, it is really just a question of time,” Mr Nkombo said.

He charged that the suspension was a planned move by the PF to manipulate the Constitution.

“We are convinced that the incarceration of our leader was all planned (i) because they knew there would be sparks there and so the easier way was to do what has happened (ii) and also we know that now we are sitting without the opposition. The function of the opposition political party is to provide checks and balances, the country has heard from time to time how the PF want to re-make the world. They have been advocating to change the Constitution over and over again. Countrymen and women, beware that when we go back after one month, we will probably find a totally different Constitution and if that happens, I think that the decision that was made today will be part of the posterity judgment,” Mr. Nkombo said.

He added, “They want to manipulate the Constitution, just a year ago they were celebrating in the stadium that they have produced a document that is going to stand a test of time and no sooner as we settled in the 12th National Assembly they started tinkering around with the articles of the same Constitution they were actually praising. Zambians beware they want to manipulate your document so that at the end of it all, it will not be a recognizable document.”

Mr. Nkombo also asked Zambians to open their eyes and watch how the country was being turned into a dictatorship.

“This is how dictatorship begins, this is how the dictatorship asserts itself. And for now maybe to also just say on behalf of all the constituencies that are represented by the members affected here is to say just be steadfast, we are coming home for a month, it will be such a joyful thing to be with yourselves,” he said.

“And finally it always a good thing to remember that when you are half way up, it means you are halfway down. UPND is holding half of the seats in this country. We can only appeal to all right minded people of this country to see what is going on, to see that the state institutions are being manipulated on a daily basis so that by the time they finish with us if they ever manage, there will be no country to talk about,” said Mr. Nkombo.

He also announced that the MPs will use the period of the suspension to go back into the constituencies and mobilise the party.

      These court cases are too many! They were going to boycott parliament even before the speaker made the announcement so what is this now??? Court again??? Very dull chaps…

    • We are Elected Members of parliament but we do not recognise the government that is suspending us from the government house which ECL officially opened.
      Why did they not stay away completely from the begining. This Double H syndrome is causing unnecessary tensions in the country. In Eastern province they say “kupha njoka nikudula mutu!’

      They are doing all these things because of a lack of maturity.

      For example, if there was at least one mature person to advise HH, he would not have behaved the way immaturely behaved in Money.

      If there was at least one mature advisor for UPND, the MPs would have understood the legal implications of the parliamentary procedures.

    • Nation building is a continuous process. Though the need to enforce discipline in the August House cannot be over emphasized, I believe the Speaker has applied a hash punishment. Most of these legislators staging up childish political stunts are victims of blind Groupthink. As such, Dr. Matibini should have just withdrawn their emoluments for 2 months and keep doors to Parliament open. As citizens we do know that their political stunts are useless convulsions. They’re inconsequential to the functionality of the state. That is the reason they would never build a critical mass among sober Zambians.     • These chaps are contradicting themselves. “Preliminary Jack” says we shall take the matter to court. Nkombo after being slapped on 10th April says we will serve the 30 days and come back strong. He further says they should provide checks and balances. Checks and balances to who? Government? Government on the executive side consists of the Head of State, Ministers Permanent Secretaries and so on. Now you don’t recognize the Head. Which government are you going to check. Silly thinking. they should just stay home instead of displaying f00lishness publicly

    • Tribal and regional politics have permeated parliament. Speaker thinks only a particular region pays tax. Why are we to pay only people of half Zambia when we are all taxed. This is the saddest stage of our country’s history. Hopefully we do not go beyond this point.

Well as I predicted and you heard it here from me first, they are going to the court, but that court session will be full of preliminaries that will last 3 months before they get even to the real case, as is typical of UPND’s day in court circus..more so if their chief whip issues a satirical sentence like:

    Really? Half the seats in this country? Which “this” country is this guy talking about? Is there a new country called South Western Zambia or what? I thought there were 150 seats and UPND hold 49. How did that translate into half the seats.

Honestly these cretins can clearly see that matibini cant be answerable to the judiciary and they wish to proceed with that meaning the case will now move from their one month expulsion to indefinite. This party is the joke of our politics in the 21st century . They break rules and laws with impunity and goes to the international community to cry fowl.

      That’s not right, UPND, in fact, have 58 seats in Parliament, not 49. You just added Keith Mukata to the 48 suspended MPs and assumed they hold 49 seats.

    • @ the chosen one, 58 is still not half of 150.. it is 38% and since the suspended are 48 that gives us 32%… so we still have 68% representation which is very okay since this percentage is willing to work.

      every workplace has rules and if you break them you can be suspended which is also okay.

    Donors should not waste money on this busket case of a republic. Take the AID to other countries in need of aid until the time Zambia’s democracy shall be restored by a more progressive party that shall unseat PF. All institutions have been infiltrated by clueless cadres.What a shame!

    Ok since they have come to you judiciary , please dont give them any special privile?e, let their appeal go on the long quee and finish off off with pending matters before attending to them. UPND is indeed rotten from the head…From the start when they were given chance to exculpate themselves they rushed to the court to restrain the Honorable Mr Speaker which was a big mistake…A court should be a last resort after all procedures in the organisation are followed but they refused to respond to the charge they were given by the Speaker and hence the punishment meted out to them and any court cannot rule in their favour because they refused to respond to the Speaker in the first place and that it was the second time they had committed the offence having been pardoned the first time after apologising…UPND are headed for self destruction due to blind loyalty to their Supreme Leader…

  15. Zambia is now a fully fledged Dictatorship and the Rule of Law has broken down. There is no law in our Constitution which requires these UPND MPs to recognize Lungu as President so the suspension is illegal. The Speaker knows this but wants to use the 30 day Suspension of UPND MPs from Parliament to pass Bills favourable to PF. Such laws will always be illegal , Null and Void coz the Suspension of the UPND MPs is ultravires the Zambian Constitution. IMF and Aid Donors cannot finance this lawlessness and Dictatorship.Period.

    I can’t resist to express my opinion in this matter. Though I am not biased to any party in special, but I can’t hate opposition more, for now,- also the level of stupidity in their raison de e’tat, is remarkable. Heavens knows if they ever have self-assessed themselves for the situation they are leading our country into.
    First things:
    1. Is Parliament a temple ? By the conduct of MPs boycotting, were they in a way obstructing business of the house? (** in the house or out of the house) and what are the rules? Was Is it ethical?
    2. How much of my money tax goes to the cost of running these parliament sessions? And if there are disruptions how much loss?
    I admonish & I am not of the idea either, of the speaker’s suspension…

      When you don’t go for work at your work place without delegation, without handover, without anyone acting in your position, do you in any way disrupt or obstruct company business?

      Let us not be too lazy. Asking questions about every little matter only denies our brains the chance to think on our own.

  17. PREVIOUS CONTINUATION} – I am not of the idea either, of the speaker suspension. He shouldn’t be making a mountain out of a molehill so as to prevent important bills and concerns from being discussed in the Parliament. The ruling party is as good as the opposition. Parliamentary system is designed to function based on debate and voting and not on lung power, and muscle power. Parliament is not a fish market.
    I am asking all bloggers-all, comments to be educative, and literate and not to lose objectivity of following the agenda or hollow the founding ethos of this great Zambesi nation.

UPND is a disgrace. They are slowly polluting Zambian politics with their rebellious behaviour. Why are campaigning all year round rather than highlight the suffering of the people you represent? Do you honestly think someone will stop everything and usher you into government? Even if Lungu was to go tomorrow, you do not have an automatic right to form government so why are you wasting your time and more importantly, the tax payers money?

Doesn’t Gary see that 50 seats out of a total of 150 is just a third, while passing any change in parliament requires a two-thirds majority which the PF has? While I DO NOT WANT OR WISH ANY ONE TO WATER DOWN OUR DEMOCRACY by reducing on democratic aspects of the constitution, I would also like to face the reality and advise the UPND to know that in BOTH,THEIR PRESENCE AND ABSENCE, the PF HAS THE NUMBERS TO VOTE AND PASS LAWS INCLUDING CHANGES TO THE CONSTITUTION! These guys appear to be LOST IN THE CONFUSIONS OF THEIR OWN MAKING!!

Mwanakatwe whose seats were nullified, all because they are Pf.   29. There is nothing wrong with enforcing the law but as you do so, you need to ensure that the same is applied fairly. I remember 2 PF female MPs who staged a fight at parliament, up to now, i don’t know what their charge was. selective application of the law leads to people calling you names as a leader. To tell the truth, if it was PF in UPND’s position today, this country would have been on fire by now. You all know what i mean.

Because next year they will protest by walking out when Lungu goes to address parliament. They will be expelled. Elections will be held.

  33. The whole episode is a joke. Both UPND and PF are jokers we have in this country. The speaker though a competent lawyer, has no mantle to handle PF and will only lean to discipline the opposition.
    The speaker is weak because his tenure is not guaranted by the ruling party. Let him suspend PF mps, he wont survive a minute. He knows the safety of his job lies with PF….
    Sometimes , I think he regrets leaving a position of a High Court judge and become a speaker. He is not yet 60 years and wishes he was at the bench…

A colleague who is a successful discovered that whilst our he was struggling to put food on the table a man would drive to a local suburb and feast on his wife’s friend. This went on for a long time. When he discovered what was happening the friend offered not an apology but denied he had and could ever do such a thing. Alas for him the wife confessed and sought forgiveness. As we speak the two are on the verge of divorce. Indeed you are right our friend has come back stronger he is a believer and his business success has grown.   40. Am sure these MPs were expecting kama allowance from parliament when they showed up there yesterday only to be ejected from the house and to be told to check out from parliament motel. I can see some of them leaving behind their guzzlers at parliament motel as they get on buses to get back to their constituencies as they will have no money for fuel. Those with nkongole with the banks will default on repayments and will pay more on interest. Bamene balibe food in their homes will look for kaloba.   52. MPs illegally stayed on in power after parliament was dissolved and got paid, but they lost the case in court and are supposed to pay back. So far they’re are untouchable Mwanakatwe and Luo lost their parliamentary petition cases in High the other year, but they’re still ministers and enjoy all parliamentary privileges UPND MPs stage a mere protest and exercise of their parliamentary constitution rights to show displeasure, but they have been banned for a month. “We are all equal the eyes of God but some are more important than others because they in Government of today.

  59. Can someone help me understand the logic by UPND? The UPND MPs do not boycott parliament when the Vice President is there. The question is: what is the difference between the electoral process that saw Mama Inonge become Vice President of Zambia and the one that made Edgar Lungu president? How do they differentiate between the two processes for them to accept one and reject the other?

  60. whether suspended for only one day or two weeks, the bottom thing is that what they are being punished for does NOT CHANGE. They are better off not going back because they have become irrelevant in the house. Actually I think they are more concerned on the loss of pecks than the chance to contribute to the house debates. 2021 is not far away and you shall register another loss if you continue threatening the peace we cherish.

If really these MPs are serious with their petition,, why in the first place, they took oath that they will uphold the constitution signed by the head of state, who is ECL, and sow allegiance to the government and president of the Republic of Zambia who is ECL and only to turn around after getting paid from the same cheque signed by ECL and say they do not recognize him as president!! double standards… It was going to make sense if they had stayed away from the beginning and not report to parliament.. why now… I do not understand these politicians of the belly!!!
