Journalists beaten outside Kitwe Magistrate court

Share

Journalists have continued to have a share of beatings at the Kitwe Magistrate Court for covering an aggravated robbery case involving a Kitwe businessman.

This is in a case where, Daniel Makina a Kitwe businessman and Director of Nkana College of Education is charged together with another man of aggravated robbery for stealing Copper cathodes.

Last week Friday, Makina’s sympathizers harassed journalists and beat up ZNBC camera Kashete Sinyangwe.

When the matter came up on Monday for a ruling on preliminary inquiry, unruly sympathizers besieged the Kitwe Magistrates grounds, hurled insults and threatened to deal with any journalists who had gone to cover the case.

The unruly sympathizers threatened to deal with anyone seen taking notes or taking pictures and wondered why they can’t cover other courts.

Makina 35, of Nkana East is co-accused with Chilufya Chipili, 32 of Chililabombwe a taxi driver.

Particulars are that the two accused persons in Kitwe, jointly and whilst armed with pistols, stole copper cathodes worth K1,850 150 the property of Polytra Zambia limited.

It is also alleged that at the time of theft, the duo used or threatened to use violence on Rajab Bashid Magwila.

The unruly and uncompromising sympathizers blocked the entrance of the court room to stop any journalists from covering the case, but the police contained the situation.

“We will deal with anyone seen taking notes, what’s so special about this case why not cover other cases, we (will) start dealing with them one by one,”one sympathizer shouted.

Some sympathizers started demanding for identity cards for those entering the court.

And in her ruling, Magistrate Kapinda Chipamu ordered for a preliminary inquiry to be conducted following an appeal from the defense team last week that the court order for a preliminary inquiry citing the length of period the accused had spent in custody before being taken to court.

Magistrate Chipamu ordered that a preliminary inquiry be conducted as soon as possible before the case is committed to the High Court for trial.

The court said the defense team raised issues which were valid for a preliminary inquiry to be conducted.

The state applied that the case come up on November 9 for mention and November 19 this year for commencement of preliminary inquiry stating that they needed time to organise witnesses.

But three defense lawyers objected, stating that it would defeat the reason to hold preliminary inquiry adding that setting the date in November was a sign that the state was not ready to commence the inquiry but was ready to detain the accused.

Magistrate Chipamu said her directive was to commence the inquiry as soon as possible and that the reason the defense applied for the inquiry was to speed up the case.

Magistrate Chipamu then set October 22nd and 23rd for a preliminary inquiry to be conducted.

Later, Makina’s friends looked in disbelief as he was taken to Kamfinsa Correctional facility where he is remanded.

He runs a school with so many trainee teachers who are promised help to find jobs once they graduate at these colleges. They’ve bought everyone, most police officers in Kitwe are not clean. I wonder if this case will even be fairly tried, it might just die in the corridors of justice. There are many similar cases that just went quiet.
