Justice Minister Wynter Kabimba has vowed that the PF government will reverse all corruption tainted investment deals entered into by the previous MMD administration.

Mr. Kabimba said President Michael Sata’s government will not shy away from repossessing all previous state firms that were corruptly sold off by the MMD government.He said the PF government will leave no stone unturned when it comes to fighting corruption.

He also warned foreign investors that the government is not interested in those who come to Zambia to engage in acts of corruption. Mr. Kabimba said the PF government was elected to serve the interest of Zambians and not to serve the interest of foreign elements.

“One of the things that we made fundamentally clear during our campaign was that we were going to fight corruption and that, in fighting corruption, any transaction that was entered into by the previous [government], which was tainted with corruption to the detriment of the interest of the Zambian people,” Mr. Kabimba said.

“We shall reverse that transaction because it is not the job of any government to engage in acts of corruption against its own people.”

Finance Minister Alexander Chikwanda yesterday announced the Zambian Governments’ decision to compulsorily acquire the Concession Rights that were granted to the Railway Systems of Zambia in 2003.

He said the acquisition has been necessitated by mismanagement of Zambia Railways infrastructure and rolling stock, leading to deterioration of assets and resultant loss to the nation as a whole.

In a statement read on national television, Mr. Chikwanda affirmed that Government would ensure that it complied with the labour laws of Zambia in relation to the welfare of RSZ employees and will meet the obligations in relation to suppliers, customers, and other stakeholders.

CHIEF government spokesperson Kennedy Sakeni says Attorney General Mumba Malila was not served the court order allowing the United Party for National Development (UPND) to hold a rally on time, hence the decision by police to cancel the public meeting set for last Sunday.

Mr Sakeni said police were not party to the court action and service on them was irregular.

“As a government, we fully support the impartial manner in which the police handled this matter,” Mr Sakeni said.

Mr Sakeni, who is also Minister of Information and Broadcasting Services, said the order in question was not served on the Attorney General Mumba Malila as the respondent on September 7, 2012 when it was made but instead it was served on the Zambia Police Service on Saturday September 8, 2012.

“As matters stand, the police were not party to the court action and service on them was irregular. The Attorney General was likewise not properly served in time for him to advise the police.

The whole service process was fraught with irregularities which made the observance of the order difficult,” Mr Sakeni said.

The minister said the UPND should have served the order on Mr Malila on a working day.

Mr Sakeni said under the rules, service cannot be done on Sunday, Good Friday and Christmas day only, but also leaving a copy at the office of the Attorney-General on a Saturday afternoon or delivering a copy to the Attorney-General’s house after 21:00 hours on Saturday, is technically irregular.

“I wish to state that both the Attorney-General’s office and the Zambia Police respect any court order which is regular on the face of it, irrespective of whether they agree with the order or not. Such order must, however, be properly served on the right party and in the right manner,” Mr Sakeni said.

The minister also said since the matter is a judicial review, the police “should have been made party to the action because they made the decision and the order was directed at staying their decision.”

But LAZ president James Banda described the police action as a breach of law.
Mr Banda said LAZ is deeply concerned with police action which he described as intolerant.

“LAZ wishes to remind all stakeholders in the governance of our country, including the executive, that the right to freedom of assembly and freedom of association are inalienable and sacrosanct and that the same are guaranteed in the Bill of Rights as by the constitution,” Mr Banda said

He said every citizen has the legal duty to respect and implement the decisions of the courts, adding that the route taken by the police was wrong.

Police notified the UPND that they were unable to be at their rally due to a shortage of manpower.
The UPND went to court and obtained an ex parte order for leave to apply for judicial review on Friday.

Lime Hotspurs on Sunday opened up a 14-point lead at the top of the Faz Division North league table after thrashing Chindwin Sentries 4-nil at Kabwe’s President Stadium.

Isaac Namakau scored a brace while Brian Mwila and Misheck Phiri contributed a goal each as Lime routed Chindwin to increase their tally to 60 points.

Sunday’s 4-nil victory over Chindwin is expected to excite Lime coach Mathews Ndhlovu who complained last week after his side recorded a slender 2-1 win over Kalulushi Modern Stars.

Elsewhere, Modern Stars stayed second despite a 1-1 home draw against third placed Ndola United at Independence Stadium in Kalulushi.

Zambia Were Lucky to Beat Us-Onyango

Uganda keeper Dennis Onyango  believes Zambia were lucky to beat The Cranes in Saturday’s Africa Cup qualifier at Levy Mwanawasa Stadium in Ndola.

The Africa Champions struggled to beat Uganda in the first leg of the final round match scoring a first half lone goal via skipper Christopher Katongo to silence the vistors.
Onyango said Uganda can overturn the 1-nil defeat and qualify for the 2013 Africa Cup to be hosted by South Africa.

“Obviously, we knew it was not going to be easy playing against the African Champions. But we managed to contain them, they scored one goal and to be honest they were lucky. Katongo was there on the right time to score,” he claimed.

Onyango added that the 1-nil away loss in Ndola was not a bad result.

” 1-nil away is not bad. It is still 50-50, we will be playing at home and we know we can do it. We can beat them (Zambia),” he said.
On 13 October, Chipolopolo will confront The Cranes away in Kampala in the decisive return leg.

Police in Mongu has nabbed 12 Barotseland activists involved in the tearing of about 500 copies of the Lozi Zambian draft constitution booklets that were torn at the district Administration Office Last week.

Western Province Police Commissioner Fanwell Siandenge confirmed the arrest to ZANIS in Mongu today and named them as Liseli Lingolwe 24, Crispin Mulonda 44, Mushokabanji Wamuwi 24, Mutawa Pumulo 25.Morgan Lubinda 42, Munyinda Munukayumbwa 18, Pumulo Silumesi 26, Mashato Sihanda 36, Robert Kalezhi 34, Wakunguma Mulope 32, Inambao Mwananyabe 26 and Mwiya Aungola 36.

He said the suspects have since been charged with malicious damage and conduct likely to breach peace and are currently detained at Mongu central Prisons remand.

“We have arrested 12 Barotseland activists in connection with the tearing up of the Zambian Constitution last week and they have been charged with malicious damage and conducts likely to breach peace. They have put in Mongu central Prisons remand for security reasons” he said.

And Mr. Siandenge has cautioned youths in Western Province to be aware of selfish people whose aim is to breach peace in the country.

He noted that they are people in the back ground that have a tendency of encouraging the young people to conduct themselves in a manner that is likely to breach peace of the country.

Mr. Siandenge has warned that Police will ensure that anyone found involved in violent behaviour in the province will be prosecuted and brought to book.

“Most of the suspects are youth, we know that these youths are just being used by some old people in the background and we will soon find out and when we do let warn that they will be brought to book” Siandenge said.

Meanwhile, Police in Mongu has launched a manhunt for Barotse Freedom Movement (BFM) Secretary General Mulasikwanda Chazele who has been on the run since yesterday.

Mr. Siandenge said Mulaikwanda together with three other group leaders of the Barotseland independence groups will be charged and prosecuted once found.

On Thursday last week, over 60 irate Barotseland Activist yesterday stormed Mongu District administration Office and tore up over 500 copies of the Silozi draft constitutional booklets stressing that Western Province was no longer of a part of Zambia and hence participation in the ongoing constitution making process was irrelevant.

Transparency International Zambia has advised that the country should approach cautiously, the issue of mounting calls to remove immunity from prosecution of former President Rupiah Banda.

TIZ Executive Director Goodwell Lungu said Mr. Banda’s immunity should only be removed after law enforcement agencies establish a prima facie case against the former President.

“We should learn lessons from the prosecution of late Dr. Chiluba. We should avoid adding a lot of emotions to this issue because emotions should cloud out our object judgements,” Mr. Lungu said.

He said the fact that a number of Mr. Banda’s close associates and his family members are facing corruption charges does not mean that he should also be charged.

Mr. Lungu said it is clear in the court of public opinion that Mr. Banda presided over a corrupt administration but that law enforcement should not be swayed by public comments on the matter.

He was speaking last evening when he featured on ZNBC TV’s Sunday Interview programme.

Mr. Lungu also raised concerns over the lack of action on the numerous corruption cases that have happened in the first year of the PF government.

He revealed that TIZ will this week write to government expressing displeasure over the handling of the recent Fertiliser Input Support Programme (FISP) contacts.

“We have a strong feeling that the contracts were corruptly procured and this one just one of the many cases we have observed during the first year of the PF where we feel corruption could have occurred.”

“We raised concerns over the fuel contracts. We are still challenging government to come out clean and tell the people how the contract awarded to Trafigura was handled,” Mr. Lungu said.

MMD President Dr. Nevers Mumba has condemned the decision by the PF government to nationalize the Railway Systems of Zambia.

Addressing Journalists in Lusaka, Dr. Mumba said the policy of grabbing private enterprises will hurt the Zambian economy.

He said the decision to target some private businesses by the state will also erode investor confidence.

Dr. Mumba also observed that some of the decisions being reversed today were initiated during the time that President Michael Sata served in the MMD government.

He said reduced investor confidence will negate government’s efforts to create jobs and reduce employment.

This morning, in a national address on ZNBC TV and Radio, Finance Minister Alexander Chikwanda said cancellation of the RSZ concession agreement with immediate effect.

“I would like to assure the nation and our partners in development that the Government remains committed to ensuring that Zambia remained a destination which is conducive for genuine investment whilst ensuring that the interests of the nation are not undermined by impropriety,” said Mr. Chikwanda.

The Minister listed the following shortcomings by RSZ;

a) Abandonment of the inter-mine railway network resulting in heavy inter-mine cargo moving by road;

b) High railway transportation costs resulting in excessive road usage for heavy cargo, and minimal or non-utilization of railway transportation;

c) Failure to meet minimum service levels for passenger freight despite being a beneficiary of a substantial Government subsidy;

d) Unacceptably high levels of derailments, loss of life and property leading to enormous cost to Government; and

e) Blatant disregard of the provisions of the concession agreement and unsatisfactory performance, resulting in great risks to the sustainability of railway transport in Zambia.

“The measure is necessary because any additional delays would result in further destruction of the railway assets, therefore making it more expensive for the planned upgrade of the railway necessary for it to meet regional and international standards,” said the Minister.

The Government has prepared resources for the continued operations and rehabilitation of the railway line, assured the Minister.

And Railway Systems of Zambia Managing Director Benjamin Even said his firm is still studying the turn of events and will respond in due course.

Government has finally announced its compulsory acquisition of the concession rights that were granted to the Railway Systems of Zambia (RSZ) Limited.

Finance Minister, Alexander Chikwanda, made the disclosure when he addressed the nation on the National Broadcaster saying the compulsory acquisition of the concession rights has been necessitated by the consistence of RSZ acting in a manner prejudicial to the interests of the Zambians.

Mr Chikwanda said the compulsory acquisition of the concession rights has been done due to high unacceptable levels of derailments, loss of life and property.

He stated that the decision has been arrived at in accordance with cabinet’s mandate to safeguard the interest of the people of Zambia, adding that to this effect Zambia Railways Limited takes over the operations and management of the railway network which was the subject of the concession Agreement in 2003.

The Finance Minister cited mismanagement of the Zambia Railways infrastructure and the rolling stock which in turn led to the deterioration of the Zambia Railways assets and resultant loss to the country as a whole.

Mr Chikwanda further noted that government observed, among other concerns, that the objectives of the concession had not been met and such as the exorbitant railway transport costs as compared to road transport which had for some time now led to non utilization of rail transportation.

He assured that government remains determined to safeguard the safety and interest in the country%u2019s railway sector and to ensure sustainability for the Zambian people.

The minister explained that government is committed to ensuring that there are sustainable and cost effective measures in place to manage the railway infrastructure.

Other stand out performances were Jason Statham , especially his scene in the church .The greatest performance in the movie has to be Jean-Claude Van Damme ! His villainous portrayal was excellent .
The Expendables 2 is a testosterone-fueled blockbuster that will leave all action movie fans with a smile on their faces.

INVESTIGATIONS into the planned assassination of President Michael Sata have revealed that two retired army generals have been paid K100 million each by a named opposition political party to implement the plot.

Defence Minister Geoffrey Mwamba disclosed to the Times of Zambia in an interview yesterday that he had information from security investigative wings that two retired generals received K100 million from an opposition political party.

“I have just received an update from our investigative wings and I am talking from facts with an informed point of view that two retired army generals have received K100 million from an opposition party to carry out the assassination plot.

“This is a serious development and I have also directed these investigative wings to go deeper and give more information so that we bring to book these people and the opposition party behind this,’’ Mr Mwamba said

Mr Mwamba said the matter would be probed further to verify the reports and bring culprits to book as this was a grave offence.

Mr Mwamba recently disclosed that an opposition political party was working with some retired army generals to assassinate President Sata.

An unverified alteration on the Wikipedia early this year alleged that President Sata had been assassinated on a Sunday morning in January.

To this effect, Mr Mwamba directed the investigative wings to institute thorough investigations involving the army generals and the political party.

The Minister explained that the two retired army generals had received the monies as part of payments to carry out the intended assassination on the President’s life.

He has warned that Government would not rest but ensure that the culprits working to eliminate the Head of State were apprehended and faced the law.

Mr Mwamba said it was not a threat that Government would deal with the perpetrators squarely because assassinating a Head of State was a serious offence under the laws of Zambia.

NEWLY-Appointed Minister of Justice Wynter Kabimba says he will not relent on Government’s decision to effect judicial reforms in a bid to enhance justice delivery in the country.

Mr Kabimba said the reforms are meant to make the delivery of justice more effective.

He said in an interview in Lusaka yesterday that an effective justice system is fundamental to the Patriotic Front government, which is aware of the need to effect such reforms.

“We will effect judicial reforms in accordance with the demands of the people. We know that the judiciary needs reforms and you will find that the issue of reforms is central and fundamental to the PF, as is enshrined in the party’s manifesto,” he said.

He said it is important that members of the public have an input into how they want justice to be delivered by participating in putting in place judicial reforms.

And Mr Kabimba said to come up with a people-driven constitution that will stand the test of time, the public needs an understanding of the contents of the draft constitution.

He said the technical committee has a task to explain what is contained in the draft and ensure that it meets the peoples’ demand.

Mr Kabimba said Government will not allow any section of society to import a Constitution that is influenced by foreign interests.

“We will not allow any section of society to import a Constitution influenced by foreigners and impose it on the people because such a document will not project the views and demands of the Zambian people,” Mr Kabimba said.

He said the constitution should reflect only the desires and culture of the people of Zambia.

Mr Kabimba said the PF like any other political party, has its own position on certain issues and these will be submitted to the technical committee on drafting the Zambian constitution.

KK predicts Zambia as next southern African economic hub

FIRST President Kenneth Kaunda says he is hopeful that Zambia will soon be one of the economic hubs of southern Africa following President Sata’s intentions to revamp most of the defunct industries.

Dr Kaunda was speaking during a service at the United Church of Zambia(UCZ) Northrise congregation in Ndola yesterday.

“We are lucky that our President is a true son of Zambia and knows the importance of reviving and maintaining the industries we once had,” he said.

He said the problem of unemployment will be solved once industries like Mwinilunga Pineapple Plant, Mansa Batteries, Luangwa Bicycle Assembly in Eastern Province and Nitrogen Chemicals of Zambia in Kafue are revamped.

“We are suffering because investors are enriching their countries when we have the capacity to improve our lives,” he said.

Dr Kaunda, who also took time to interact with Sunday schoolchildren, did not leave out his usual message of peace.

He said Zambia is one of the few countries that enjoy peace, making it an envy of the region.

He said the motto “One Zambia, one Nation” should be the foundation on which the country should stand.

And congregants, especially children and youths, were happy that Dr Kaunda spared time to attend the service with them.

Busaka Kalima, a member of the girls brigade, said it was her first time to see Dr Kaunda whom she described as her hero.

“I am very excited to see him in person. I have always just seen him on television,”she said.

Nawakwi threatens citizen’s arrest on RSZ management

FORUM for Democracy and Development president Edith Nawakwi has threatened the Railway Systems of Zambia (RSZ) management with a citizen’s arrest if they continue to issue statements to justify their alleged failure to run the railway system in the country.

Ms Nawakwi has demanded that the RSZ restores the railway infrastructure to its original condition before engaging government on the planned repossession of Zambia Railways.

She said Zambians are unhappy with the dilapidated railway infrastructure and cautioned RSZ to deal with the matter carefully.

“All the slippers are gone. How do you explain such a situation?” Ms Nawakwi asked about the concessioning of Zambia Railways to RSZ in the year 2000.

Ms Nawakwi said in an interview yesterday that the RSZ management must desist from issuing statements on the matter, as many Zambians want the authorities to effectively deal with the concessioning of Zambia Railways.

“When a house is leased over a period of time, it should be handed over to the owner, in its original condition. If there are any damages during the period of lease, they must be repaired by the tenant, so the minimum we expect from them (RSZ) is to repair the damage to the railway infrastructure,” she said.

She said Minister of Justice Wynter Kabimba must expedite the review of the concession, saying the matter is straightforward.

Ms Nawakwi said it is unfortunate that the RSZ accused Zambians of vandalising railway infrastructure.

“They should be ashamed of themselves and hand over the assets because they are bankrupt. They are the major culprits for the deterioration of roads in this country. Let them keep quiet, we are not vandals, if the infrastructure was being stolen, why did they not report to the police?” she asked.

She said Zambians are going to speak and debate the concession on behalf of President Sata, following his instruction to Mr Kabimba to review it.

“We the people are now going to speak for the President,” Ms Nawakwi vowed.

She advised government to settle the matter as suggested by RSZ, after the company has replaced the damaged and stolen railway infrastructure.

“We can only discuss settlement after they have replaced the infrastructure. Do they think we live in the stone age where a train journey takes days over a short distance, when in other countries even in South Africa, trains can traverse hundreds of kilometres in a few minutes or hours?” she said.

THE Media Institute of Southern Africa (MISA) Zambia has written to Permanent Secretary in the Ministry of Information and Broadcasting Amos Malupenga, seeking an audience with him to discuss the controversy surrounding UNZA Radio.

This is according to a statement released by MISA on Friday.

Government has warned the radio station to desist from projecting partisan interests because its licence does not allow it to do so.

The Zambia Information, Communications Authority (ZICTA) has reportedly reduced the radius transmission of UNZA Radio from 1000 watts to 260 watts.

MISA Zambia vice chairperson Nalumino Nalumino, described the adjustment of radius for UNZA Radio as illegal.

But when contacted for a comment, Mr Malupenga described MISA’s claims as cheap lies designed to tarnish the image of Government.

Mr Malupenga said it is not true that Government is gagging UNZA Radio.

He explained that all community radio stations are required by law to broadcast 500 watts.

“MISA doesn’t mean well. You tune into UNZA Radio at the Daily Mail and you will be able to listen to the station,” Mr Malupenga said.

He wondered why MISA is issuing misleading statements to the public when there’s a pending meeting with the Ministry of Information today or tomorrow.

“It is not true that we have limited the radius of UNZA Radio because I was listening to it while in Chisamba. What ZICTA has done is regularising all community radio stations,” Mr Malupenga said.

Mr Malupenga said if MISA means well, they should have waited for a meeting with the ministry.

“MISA is misleading the public. And there’s no need for them to peddle such propaganda,” Mr Malupenga said.

In his statement, Mr Nalumino said MISA Zambia is appalled that the PF government which has on several occasions pledged to uphold freedom of expression to allow Zambians to freely express themselves on various issues, appears to be back-peddling.

“Government should realize that the Constitution provides for such freedom because it is a fundamental right which is even recognised by various international instruments that Zambia has ratified,” Mr Nalumino said.

“Recently, there have been unwarranted threats on media institutions by government, the latest one being the reduction of the radius of UNZA Radio, as well as the suspicious dismissal of Evelyn Hone College Journalism lecturer Clayson Hamasaka,” Mr Nalumino said.

He said the reduction in the UNZA Radio radius has put the radio station at a risk of breaching its contractual obligations with its advertisers.

He said MISA Zambia is calling for the implementation of the Independent Broadcasting Authority so that broadcast media regulation, can be independent of political interests.

Last week, the Ministry of Information expressed concern that UNZA Radio has departed from its core purpose of educational broadcasting to politics.
