Vote on the Barotseland Agreement of 1964 halted, as the issue is withdrawn at the Constitution Convention

The anticipated voting over the Barotseland Agreement of 1964 at the national Constitution Convention in Lusaka yesterday failed to take place after architects of the motion decided to have the voting called off.

Former Speaker of the National Assembly Amusaa Mwanamwambwa, just before the voting started, sought permission from chairperson of the convention Muyunda Mwanalushi to say something over the voting on the Barotseland Agreement.

Mr Mwanamwambwa moved a motion that voting on the Barotseland Agreement should not take place and that the matter should instead be referred to the parties concerned, the government and the Barotse Royal Establishment (BRE).

“The BRE and the government should dialogue over this matter and find a lasting solution. That is the reason I am asking that this gathering should not vote on it. This meeting can facilitate for a speedy resolution of this matter,” Mr Mwanambwambwa said at the Lusaka Mulungushi conference Centre where the convention has been held since April 10, 2013.

Mr Mwanamwamba’s motion was seconded prompting chairperson Professor Mwanalushi to put it to a vote.

Those against taking a vote overwhelmingly won against those for voting and Prof Mwanalushi called on the Electoral Commission of Zambia (ECZ) officials to instead conduct elections on three issues namely, the death penalty, the academic qualifications of the Speaker and deputy Speaker of the National Assembly and the age qualification of a presidential candidate.

The voting led by returning officer Lawrence Mulenga started just before 18.00 hours and by press time, the counting had not yet finished.

Earlier, the convention rejected a proposal that the Director of Public Prosecutions (DPP) should seek permission of the courts before entering a nolle prosequi as prescribed under Article 244 (4) of the first draft Constitution.

This was after Solicitor General Musa Mwenya had argued that there were instances that members of the public in a criminal matter approached the DPP with a complaint that the court was colluding with suspects and wondered how in such instances, the DPP could seek the court’s clearance before entering a nolle prosequi.

Heritage Party leader Godfrey Miyanda said he was a victim of the nolle prosequi himself but supported the proposal from the thematic group that the DPP should be making independent decisions on the nolle prosequi without consulting any authority.

He said while in political matters the nolle prosequi could be abused, he still maintained that the DPP’s office should be left to operate independently.

The convention was expected to be officially closed soon after the results of the voting were announced.

Nkoyas call for commission of Inquiry to solve the tribal disputes in Western Province

The Nkoya Royal Council called for the setting up of a Commission of Inquiry under the Ministry of Chiefs and Traditional Affairs to find a lasting solution to the tribal disputes in Western Province.

Speaking during a media briefing in Lusaka today, Nkoya Royal Council Chairman Edwin Nkomesha accused the Lozis of sidelining other ethnic groups in the province.

He noted that even the distribution of development projects in the province are unbalanced as areas occupied by other ethnic groups still have old colonial buildings.

Mr Nkomeshya said anarchy in the province is at the verge of taking center stage if tribal disputes continue to be entertained.

Meanwhile, the Kazanga Kabompo Traditional Ceremony has been scheduled for June 1st and 2nd.

The ceremony which is celebrated by the Nkoya people of North Western Province under Mweene Kangombe will be held in Kabompo district.

About Kr 100,000 will be required for the hosting of the ceremony.

Mopani Mines has commended the PF government for not succumbing to pressure to reintroduce the controversial mining windfall tax.

Mopani Board Chairman Emmanuel Mutati says the current tax regime in the mining sector is favourable enough to encourage fresh investments.

Mr. Mutati explained that the 2008 mining windfall tax would have destroyed the mining sector if it had not been repealed.

The Board Chairman said the structure of the windfall tax was damaging to the sector as it was imposed on gross revenue unlike other countries to tax net profits.

He said the current mining variable and the mineral loyalty taxes are adequate to encourage the growth of the mining sector.

Mr. Mutati was speaking today when he met selected Business Journalists at Mopani’s new corporate offices on Alick Nkhata road.

He said Mopani Mine’s parent company Glencore has today invested over 2 billion US dollars in its operations in Zambia.

Zanaco this afternoon beat Forest Rangers 3-1 at Sunset Stadium in Lusaka to rocket from 12th into fifth place on the FAZ Super Division table.

The victory was the defending Super Division champions’ second of the season after beating Kalulushi Modern Stars 1-nil in Kitwe last Sunday.

Midfielder Larry Siakasipa put Forest ahead in the 16th minute.

The two sides went into the break at 1-1 after ex-Nchanga Rangers defender Moses Mulambi levelled for Zanaco in the 34th minute.

Roderick Kabwe scored his fourth goal of the season via a free kick in the 64th minute.

Forest were later reduced to 10 men after Rabson Tofa was sent-off in the 77th minute before Aubrey Funga cemented the three points for Zanaco two minutes later.

Zanaco supplant Zesco from fifth place until the weekend when they host Green Buffaloes at the same venue.

The Bankers usurp Zesco from the number five slot on goal difference with both sides tied on seven points from four matches.

Forest stays fourth from bottom in 13th place on three points ahead of this weekend’s trip to Kabwe Warriors.

More than 350 Police Officers have been mobilized for deployment to provide security during the 23rd April Kapiri Mposhi constituency by-election.

ZANIS reports from Kapiri Mponshi that Central Province Commissioner of Police Standwel Lungu who confirmed the development in an interview today.

Mr, Lungu said the police command has marshaled 300 police officers from other stations in the country to re-inforce the local force during the by-election.

He said police will stay alert and will crush anyone be it from the ruling party or the opposition political parties found perpetrating violence during the polls.

“The police is well prepared to handle the security demand for the by-elections in Kapiri Mposhi we will deployed adequate numbers of officers for this purpose,” Mr. Lungu.

The police commissioner warned participating political party members and their sympathizers to stay away from violence but conduct themselves peacefully and maturely.

“People should ensure that they do not operate outside the electoral code and the laws of Zambia during the elections otherwise they risk being professionally handled by police”, Mr. Lungu said.

The ruling PF and opposition UPND and UNIP are contesting the Kapiri Mposhi seat which fell vacant after the Supreme Court nullified the election of Lawrence Zimba as MP (MMD).

Mr. Zimba is re-contesting the seat on the UPND ticket.

The PF are fielding Eddie Musonda and UNIP are floating Francis Mwape.

Meanwhile, Mr. Lungu has commended political parties participating in the Kapiri Mposhi by-election for observing the electoral code and conducting their campaigns peacefully.

Mr. Lungu said the police have so-far not recorded any incident during the campaigns which have been going on for close to two weeks now.

“The political parties participating in the Kapiri Mposhi by-elections have behaved exemplary… they have continued to campaign peacefully this is encouraging and we hope they are going to ensure this continues even during and after the poll day,” Mr. Lungu said.

Southern Province Minister, Daniel Munkombwe, has warned that the UPND-controlled Choma Municipal Council risks being dissolved if it fails to implement the Patriotic Front (PF) government development agenda.

Mr Munkombwe says even if the local authority is run by the opposition councillors, it is duty bound to implement all developmental programmes initiated by the PF government without inertia.

He was speaking in Choma today when town Mayor, Geoffrey Makwamba, and Town Clerk, Mwiya Mwiya, took him on a conducted tour of sites for the proposed new bus terminus and housing complex.

Mr Munkombwe said government will not hesitate to dissolve the council if it is seen that the institution is blocking the PF government development agenda.

The minister said Government is in a hurry to provide necessary infrastructure in the new provincial capital of Choma.

The council has engaged an investor, Fallsway Timber Limited Group of companies, to construct a modern bus terminus, 250 housing units and other facilities in a project expected to gobble more than US$ 13 million.

Fallsway Timber Group of Companies chairman, Vora Shyam, informed Mr Munkombwe that the project will kick off immediately with the first batch of housing units being ready for occupation by December this year.

The company, which has sourced external financing, will implement the project under the Public Private Partnership concept.

Mr Shyam said the project will also include construction of a school, clinic, shopping complex, medium and low cost houses.

The minister directed the mayor and the town clerk to ensure the project is quickly implemented so that people and facilities can be moved from Livingstone to Choma without delay.

TAZARA resumes operations after 13 days

Tanzania-Zambia Railway Authority (TAZARA) yesterday resumed its full main line operations following a successful re-railing of the de-railed rescue crane.

TAZARA Head of Public Relations Conrad Simuchile told ZANIS in a statement today that both passenger and freight operations have reverted to full gear.

Mr. Simuchile said the express passenger train was dispatched from Dar es Salaam at 15:50 hours yesterday while two freight trains carrying copper and maize from Zambia reached Dar es Salaam last night.

He explained that threes trains will today be dispatched from Dar es Salaam, with one carrying fuel destined for Malawi and two others carrying fertilizer, cooking oil and other mixed goods all consigned to Zambia.

He said other transit trains that have resumed rolling from Malimba, Tunduma and Mpika include three trains carrying copper cathodes and maize all headed to Dar es Salaam from Zambia.

Mainland operations at TAZARA were suspended 13 days ago following the derailment of a rescue crane, about 64.6 kilometres from Dar es Salaam while attempting to salvage wagons that were involved in an accident.

Government begins school curriculum revision

The Ministry of Education, Science, Vocational Training and Early Education has started revising the current school curriculum in order to meet the emerging labour market demands.

Ministry of Education Permanent Secretary Patrick Nkanza said the Patriotic Front (PF) government was determined to address all the weaknesses in the current school curriculum that hinder the meaningful contribution of pupils to national development.

Dr. Nkanza said this in his address to pupils drawn from selected schools in Lusaka district who are attending a three day career guide talk organised by Lafarge Cement Company and the National Council for Construction (NCC) in Lusaka today.

He explained that after the revision of the current curriculum, the new one will provide a two tier system that will include the career path and vocational technical path for pupils from Grade 8 to 12.

Dr. Nkanza further explained that the new school curriculum was expected to address bottlenecks identified in the old curriculum that forced pupils to take an academic path even if they were not good in the academy subjects but were better in technical subjects.

And National Council for Construction (NCC) Board Member, Festo Musonda observed that technical jobs offer the best alternative to the current high unemployment levels in the country.

Mr. Musonda said technical jobs, unlike white collar jobs, offer life saving skills hence were the best solution to the existing unemployment levels in Zambia.

He explained that Zambia was slowly following the footprints of developed countries where people with technical jobs were well enumerated compared to those with white collar jobs.

Earlier, Lafarge Cement Zambia Head of Innovation and Extramile, Muchanga Mudenda said his company was happy to associate itself with programmes that were aimed at nurturing young people into responsible citizens.

Ms. Mudenda said Lafarge was ready to provide technical assistance to schools and initiatives in order to promote innovation among the young people.

President Michael Sata is tomorrow is expected to visit three Districts in Western Province to launch some developmental projects.

In a programme prepared by the provincial administration in Western Province, President Sata will arrive at Mongu Airport at 09:00 hours.

President Sata will later proceed to a ground breaking ceremony and lay a foundation stone at Kasima where the site for the Mongu ultra- modern stadium will be constructed.

The Head of State will thereafter depart for Shangombo around 10:40hrs where he will officially open the Shangombo Hospital.

At 12:00 Hours, President Sata will head for Muoyo in Nalolo District where he will pay a courtesy call at her royal Highness Litunga La Mboela and then proceed to launch the water project.

Heads of government departments are to join the president in most of the launch of the said development projects.
The President will depart for Lusaka the same day in the evening.

Meanwhile, On Saturday, which is the day scheduled for Kuomboka, Vice President Guy Scott will arrive in Limulunga for the ceremony at which he will be the Guest of honour.

Rupiah’s ‘political comeback’ scares PF – Chipimo

National Restoration Party (NAREP) President Elias Chipimo says it is possible that the prosecution of former President Rupiah Banda on corruption charges is aimed at completely ruling out any political comeback by the former president.

Mr Chipimo says it is possible that the PF are scared that Mr Banda, who only served 3-years of late President Mwanawasa’s final five year term could make a political comeback and decide to run for the presidency again.

He cited the way former late President Fredrick Chiluba stopped first republic president Kenneth Kaunda from making a political comeback in 1996.

Mr Chipimo said the State’s case against Mr Banda could face some problems looking at the way the charge has been framed, and that the fact that he has been charged with something which was not an offence at the time it is alleged to have been committed.

He added that the former President’s cases raises serious constitutional issues which he says the High Court will have to determine.

Mr Chipimo stated that from the outset, the signs are not looking good for the Director of Public Prosecutions office.

He said the continued investigation of the former president while he has already been charged, is to stop him in his tracts.

And Mr Chipimo implored all media personnel in Zambia to ensure that they accurately and diligently deliver factual information to the public.

Mr. Chipimo explained that the media plays a very important role in the enhancement of democracy and are generally trusted by sources even when some of them would adopt a partisan stance in their profession.

He said that the public has so much confidence in the media hence the more reason why there is need for all media professionals to remain honest, trust worthy and uphold the media ethics at all times.

The NAREP president stressed that the power that the media holds is very considerable and should always be used in service of the country not for character assassination or to promote a divisive agenda, but to allow the free flow of opposing ideas and views to be debated and considered against the back drop of some common concerns.

ZESCO’s Kariba North Bank extension power project reaches 80 % completion point

THE upgrading of electricity generation capacity at Kariba North Bank extension power project has reached 80 per cent completion point and one new generator is expected to be commissioned by the end of this year, ZESCO acting managing director Christopher Mubemba has said.

Over the last two years, ZESCO has been spending about US$420 million at the 360 Mega Watts (MW) Kariba North Bank extension power project in adding two new generators to the existing four.

Mr Mubemba said generator number five was expected be spinning and commissioned by the end of this year while generator number six would be commissioned and operational by early next year.

He said this in Livingstone on Tuesday during his presentations at the Energy Regulation Board (ERB)’s public hearing on ZESCO’s application to revise electricity tariffs by an average of 26 per cent across all customer categories.

Mr Mubemba said ZESCO was intending to invest heavily on electricity generation to meet continued increment in the demand for electricity.

“This year, we have an approved budget under US$ 750 million (KR3.62 billion) to boost power supply.

Over the next five years, we will spend about US$ 5.3 billion on generation expansion, transmission expansion and distribution expansion among others which translates to about KR26.4 billion,” Mr Mubemba said.

On the 120 MW Itezhi-tezhi hydro power project where ZESCO was adding two machines, Mr Mubemba said access roads and offices had already been built at the site while houses for contractors were currently being built.

He said ZESCO was currently concentrating on tunnelling works on the US$ 250 million project where which was 20 per cent complete and was expected to be completed in the year 2015.

On the 750 MW Kafue Gorge lower power project, Mr Mumemba said more works would be done in the next five years.

“This is our biggest project which we will we need to deal with in the next five years as the project will cost us US$2 billion.

Without projects like the Kafue Gorge Lower, we will have power deficits of about 1, 000 Mega Watts by 2020,” he said.

On transmission side, Mr Mubemba said ZESCO had started building 330 kv a line from Pensulo to Kasama as well as another line from Pensulo to Chipata to boost power supply in the surrounding provinces.

“These works are ongoing and once projects are completed within next 18 to 24 months and they will immediately address the current low voltage problems in Northern, Muchinga, Luapula, and Eastern Provinces.

They also will help investors set up projects. It is not a secret within Eastern Province that investors have been interested to invest in so many areas but they can’t so because of low voltage problems,” he said.

In Luapula and Muchinga, investors have also been interested to set up large mines but such projects could not take off due to inadequate power supply.

Out of the US$ 750 million which the Government raised from the euro bond, ZESCO has received US$ 255 million.

About $186 million would be ZESCO’s equity contribution towards the Kafue Lower Gorge project while about US$ 69 million would be for improving electricity distribution and rehabilitation.

Delegates want the Government to get parliament approval for any borrowing

One Zambia , One Nation

The on-going National Constitution Convention has retained an article in the First Draft Constitution on the borrowing and lending by government to permit it to borrow money from any source but subject to parliament authorization.

Clause (1) of Article 282 provides that Government may borrow money from any source and further in clause (2) of the same article explains that government shall not borrow, guarantee or raise a loan on behalf of itself or any state organ, state institution, authority or person except as authorized by or under an Act of Parliament.

But clause (3) has categorically explained that notwithstanding clause (2) the government shall lay before the National Assembly the terms and conditions of the loan which shall not come into operation unless approved by a simple majority vote of National Assembly and pay any money received in respect of the loan paid into the consolidated Fund or into some other public fund which exists or is created for the purpose of the loan.

In this case Government will be required to lay before the National Assembly terms and conditions that includes the source of the loan, the extent of the total indebtedness by the way of principal and accumulated interests, the provisions made for servicing or repaying of the loan and the utilization and performance of the loan.

Meanwhile , the house has adopted Article 279 (1) to provide that the president shall subject to clause (2) cause to be prepared and laid before the National Assembly in each financial year, not later than ninety days before the commencement of the financial year, estimates of revenues and expenditure of the government for the next financial year.

And clause (2) of the same article has been adopted which provides that the Minister shall, when presenting the estimates of revenue and expenditure under clause (1) specify the maximum limits that the government intends to borrow or lend in that financial year.

While clause (3) states that in any year where a general election takes place, the president shall cause to be prepared and laid before the National Assembly, within ninety days of the swearing in of the president, estimates of revenues and expenditure of the government for next financial year.

The group justified that the clause would ensure that the government-elect could implement their plans and policies in the following year.

The Draft Constitution has further mandated Parliament in article 280, to enact legislation relating to the annual budget and estimates of expenditure including the method for the preparation of the budget, the preparation of medium and long term development plans indicating corresponding sources of financing.

The house adopted the recommendations by the thematic group on Public Finance that the article be adopted without amendment after it was explained that the amendments would be provided for in an Act of Parliament.

But the house agreed that the marginal note on article 280 be amended by introducing the words ‘planning and ‘ , so that it could read as planning and budget legislation after amendment.

THE National Constitution Convention sitting in Lusaka have rejected a proposal from the thematic group that looked at the Executive and Executive Power that a presidential candidate should have a minimum qualification of a first degree.

After a heated and protracted vote, the delegates agreed that the presidential candidate’s minimum would be grade 12 qualification.

Another proposal that the President, upon attaining the age of 80, should not continue to hold that office was rejected as other provisions of the law were clear on non-discrimination on age.

The delegates also adopted 107 the proposal that a Vice President shall be a running-mate to the presidential candidate during elections.

And after a vote, the convention adopted the proposal that the quorum for a meeting of the National Assembly shall be 50 per cent from the current one- third.

Article 148 of the first draft Constitution had recommended that the one-third majority should continue as stated in the current Constitution.

But after a lot of debate, the matter was taken to a vote and the new proposal for 50 per cent quorum was unanimously voted for.

The convention also rejected a proposal that parliamentary committee chairpersons should be ranked with a number of delegates.

They argued that the chairpersons were ordinary Members of Parliament (MPs) and were already being given some incentives for chairing the committee meetings.

The convention rejected a recommendation that the Speaker of the National Assembly should have a minimum of a first degree qualification before being appointed to the position.

The delegates endorsed Article 157 (1) under General Parliamentary Matters that the President, shall by-annually, attend and address the National Assembly.

It was resolved to delete Article 158 (1) in the draft Constitution that stated:”the National Assembly may pass a vote of no confidence in a Minister, provincial Minister or parliamentary secretary by resolution supported by two thirds of the votes of the MPs, in accordance with this Article.”

Under the General Provisions in Part XXI of the draft Constitution, the convention retained Article 309 (1) which provides that the English language remains the official language of Zambia.

Meanwhile, the National Constitution Convention which was expected to come to a close yesterday has been extended by a day and would now end today.

Chairperson of the Convention Professor Muyunda Mwanalushi announced yesterday that he expected that by end of yesterday, the convention would have completed deliberations on all contentious issues so that today the convention would come to the close.

The convention taking place at Mulungushi International Conference Centre (MICC) started sitting on April 10, 2013 and was scheduled to be closed yesterday by Justice Minister Wynter Kabimba.

But due to the high volumes of work involved, the technical committee on drafting the Constitution decided to extend the deliberations by one day.
