Opposition Front Party member in Mufulira has advised government not to condone the request by the National Constitution Conference (NCC) to extend it mandate for 12 months.
Kantanshi constituency secretary Dunacan Mubanga told ZANIS that the NCC is mandated to conclude its deliberations by 2009 and asking for an extension is not justifiable but costly.
Mubanga said holding of the conference has been expensive for the country and this has affected the implementation of developmental programmes such as health sectors during its tenure.
He said the ministry of finance and national planning should not allocate money for the NCC extension at the expense of other national programmes such as health and education.
He advised government not to condone the request by NCC to sit beyond the acceptable period of time as doing so will hurt a lot of people who have sacrificed to have the new constitution.
The opposition official was reacting to the NCC’s request to government to have its mandate extended for 12 months which will mean that its mandate will end in 2010.
The initial mandate is due to end next year in September.
And a civic leader in Mufulira has appealed to the national constitution conference (NCC) committee on local governance to amend the local government act to enable councilors eligible for emoluments at the end of their term of office.
Kafue ward councilor Kenneth Mubanga said since councilors are elected office bearers like members of parliament (MP) and go through the same electoral process they should be considered for gratuity as a token of appreciation for their work.
He said this can only be done if the local government act is reviewed and amended by the democratic governance and local government committee of the NCC.
Councilor Mubanga said was speaking to ZANIS in an interview today.
The Civic leader suggested that the new constitution should also stipulate the conditions of service for councilors.
Councilor Mubanga asked MPs sitting on the local governance committee to support the suggestion by councilors which he said is aimed at ensuring that elected leaders are accorded appreciation for the service rendered to the public and the nation.
He said councilors become destitute after leaving the office despite working hard for the people and the only way to help them leave honorably after is by rewarding them in the same way as MPs.
He noted that councilors do more work in wards than MPs yet they their contribution is not recognized by government because of lack of conditions of service to cater for their retirement.

We should not postpone the sitting of NCC. If they want to do it we Zambians should not pay them any renumeration for the period of the extension. All MPs should NOT be paid any extra money for participating in NCC as their salary as legislators is drawn on this basis – making laws. Sitting on NCC is part of their ligislative responsibilities. I have always opposed any Manager receiving a sitting allowance for negotiating with Unions. This is very similar. The only people we should apy are those stake holders who are sacrificing their own time to sit on NCC. Furthermore, there is no basis for any extension. The only annoying thing to me is that very few of these people actually read and analyse people’s submissions aand as a result only a few of them are actually useful to the exercise. Too many party cadres and resource wasters.
Does this Mubanga think that being a councillor is a career? Kwena tuli batutu sana. This man does not know that he needs to have his own before he can offer his services as a councillor. Well if the extension can be explained in terms of the loss of time that sitting was postponed during the funeral of the late president and the subsquent election period, I think that it would be irrational to simply call on the people to stick to the originally set completion dates. However, there would be nothing wrong if a quicker method of deliberating was found to still meet such deadlines as were originally set. But in all cases Zambians must not close their minds to the fact that time was lost, unless we say that even the originally set time was too much. If not, unless a much quicker method than that which was being used if found time will need to be regained.

In other countries civic leaders are held in high esteem because they are the ‘real’ government. In fact in olden days in Zambia you could only qualify to become a councillor if owned valuable property. So if you the people with good education are shunning councillorship then you continue living with pot holes, spewing sewers etc. Late Shamwana even proposed minimum education.
Fellow country men the only way we shall have real patriots running this country is to include in the consitituion a clause that will say that being a minster is voluntery and will not attract renumeration. Youn will see how many people will shun politics.

Constitution making process is not like a kitchen party that can speeded up, brought forward or postponed casually.
Constitution making process is serious process that takes time to carry out. Ours is in great mess at the moment, and most of the things people complain about on this site are a result of flows in our constitution. Now, to start demanding that the process be finished fast to save money is a lack of foresight. Because this same constitution if not done properly will cost the country more than what it would cost to fix it properly. Right now the issue of accountability for leeaders is very weak, and the law is equally weak and so the nations keeps losing huge revenues unstopably

The problem with those against the extension is that they are not offering alternative solutions.This is why i alwys have a problem with some cadres.If extending the Mandate will cost money are we gonig to save money by cutting the process short and having an incomplete document? The reason given for the extensions are clear and i would expect a sober mind to debate those reasons other than the period in isolation withoput relating it to the quality of the document we wish to have.Mind you the constitution does not only talk about elections it covers a wide range of issues more important than elections.PF has been in existance since 2001 and upto now they dont have a written constitution

When I look at NCC I see that those on the NCC represent a wider section of our society than those who decided to stay out of NCC.
Even those parties that said they would not participate they have more than 60% of their MPs attending. Even NGO’s, only a handfull of then if not one or two declined to attend but I have seen them acknowledging the NCC and I heard them during elections demanding to the candidates that whoever was elected need to continue with the constitution making process.
So I have difficulties in understanding where your statistics are based.

I would like to agree with you that the NCC is debating the same things that were submitted to the constitution review commision. In fact that is the mandate they have. The constitution review commision compiled a list of submisions which are now being discussed. You do not expect a constitution to be made up of disjointed list of submissions. A contitution must have harmonised articles which forms a single instrument with supportive non-conflicting or overlaping paragraphs or arcticles.
It is amazing that you say because the submisions are already there then we dont meed to debate them.

The Consttitution can never be made up of a compilation of submissions. Submissions are simply desires and aspirations from the citizens which must then be legally analysed and harmonised into Law.
A constitution is not a list of nice points, no rather it aught to be like a human body with many parts yet clearly cordinated and working at one entity. And you dont achieve such through mere submissions and subsquent compilation.

What sort of leaders do we have? The World is in recession yet we are venturing in activities that are doubling our expenditure such as the useless NCC and salary increments for public office holders. How sad and shameful for those who call themselves leaders. Anyway, what more can frail and sickly characters like George Kunda and VJ ask for, other than fattening their bank accounts before they are called to meet their creator? Zambia is a sorry country and it saddens me how a country like Botswana which is almost entirely a dessert and with the population of goats outdoing that of humans do better than us with vast land, waters and a thriving population-Manpower.
When the Catholic Church refused to be part of the NCC, many Zambians insulted the Church for taking such a stand…Know that the Church is well informed about all these matters, they are trained for this too. Elections came, many of you on the blog supported Rupia Banda and voted for him thinking that others like Sata and Hakainde could not deliver. Banda was voted on the legacy of Mwanawasa. The annual budget allocation to the NCC is approximately K350 billion and Ministers and MPs are paid to sit on the NCC. The proposed extension is coming whether you the blogger likes it or not for the simple reason that the same people to whom the appeal has been made are beneficiaries of these funds.
We all opposed the salary and allowance increments for constitutional office bearers but our cries fell on deaf ears. The opposition on NCC extension is no different.

Its not easy to make a constitution. The PF has been in existance since 2001 yet they neither have a constitution nor a written menifesto. in terms of the auditor generals report no matter how much ammendments you make, there is no institution in Zambia mandeted to prosecute cases arising from the auditor general report, mind you an Audit is not an investigation nor an enquiry its mearly an exercise to reconcile books. what we need is a law that compels an instituton to investigate anomalies arising from those books. Piece meal amendments will not help because they always change with gorvernments, we also need laws to make it difficult for piece meal ammendments.

Can someone wake up and disband this cow milking animal and set up a strong committee of serious Lawyers (excluding LAZ chairman) to consolidate the recommedations and come up with what the Nation needs. We cannot be dying from cholera at this age neither can we afford to lose those uneducated voters from the villages from hunger. The money saved can do alot to improve the economy and mitigate the sufferings of these rural dwellers who are hoodwinked by a packet of sugar

Countrymen the most important thing for now are not the allowances but the quality of the product(constitution). It will not be of any help to still have a minority acceptable constitution even if the people tasked to enact it did it for free. The issue of allowances is a tempral one and will fall away immediatly we NCC concludes its sittings. But the contents of the constition will always be with us and if we do not pay attention to the contents we shall always cry foul. Lets focus on the real issue WHICH IS CONTENT Period.

At first i thought extending was a great i dea now am not sure anymore.If during the times they were disturbed and did not get paid then they can extended according to the number of times missed and not more and they can be paid.and the extention should not reach 2011 atleat by the end of 2009.

This constitution is not welcome to the pf because it will disadvantage them a lot. Remember this is a party without any Manifesto, no copies of any documents in the party apart from the word of mouth. They will never be for the constitution because it is an insult to them. Things liike having an elected vice-president, this is what Mugabe is refusing and you know pf president Sata is exactly the same as Mugabe. Sata should rest assured that he will never become a president of zed. This man cannot do anything for himself apart from tax payers money,he is really power hungry.
Even when you ask Sata why he is not for the constitution he will never give you a concret answer. If sata is a well meaning person for zed he could have participated in the NCC to bring up his ideas and inteligence if at all he is. People are judged by their actions and what they say.

Why don’t we have constitution amendmentment during elections. Zambian citizens should vote on whether they want a certain law or not. This will save a lot of time and resources by having people who meet for their own benefit and we don’t even know the progress.
