Former Zambia Security Intelligence Services – ZSIS- Director General Xavier Chungu has been ordered to pay 500 million kwacha for breaching his bail conditions when he fled the Country four years ago.
Mr. Chungu has been ordered to pay 500 million Kwacha within 14 days or face a 6 months imprisonment.
Ndola High Court Registrar, Jones Chinyama made the ruling in Lusaka on Tuesday.
This was despite Mr. Chungu’s explanation that he fled the Country because his life was in danger.
He informed Mr. Chinyama that he was tipped off and advised by his colleagues in the intelligence to flee as his life was in danger.
Mr. Chungu said he returned from his self imposed exile to clear the charges leveled against him as he felt his life is no longer in danger.
Earlier Chungu asked Mr. Chinyama to exercise his discretion to reduce the 500 million Kwacha bail saying his properties had been seized by the state and that government had not yet paid him his terminal benefits.
But Mr. Chinyama refused to reduce the bail saying he does not have such discretionary powers.
Chungu fled the country while on bail four years ago.

Every blogging on this page,Can anyone of define corruption in more broader perspective? When u done ,then look at ur so called mwanawasa and what he did.
Mwanawasa was very short of a leader, he could have easily brought about anarchy in country cos of his practice of nepotism(corruption).
The best would have been to jail Chungu and deny him bail.
This was not a bail case, he has been convicted of skipping bail (contempt of court) and sentenced to a fine or in six months in jail.
The prosecutor will have to re-arrest him (since they stayed the original charges when he fled) and charge him agian, then he can apply for bail. In normal circumstances he can never make bail because he has a record of flight so he probably will not show up again.
The reasons why the cases were stayed is they were joing charges with Chiluba and others, so it was impossible for the state to proceed prosecuting charges with the absence of the co-accused. They can now join the charge (more delays) or proceed with separate trials for him.

#93/94, yes that’s why the others were happy he fled because the crimes were being tried together so they thought there would be a mistrial because an important co-accused would not be available to defend himself and by default they would all be acquited.
However, the state was smart. They dropped all the charges (nolle prosequi) and re-arrested the remaining accused with amended counts excluding Chungu’s participation. As it is Chungu, has no charge pending in court apart for this contempt conviction, the Task force are legally allowed to recharge him separately or enter a nolle in the ongoing cases and re-charge all of them like before. Joint charges would likely be the best to prove.
May be let’s wait and see.
Very interesting! I hope Chinyama’s ruling set a precedence to would be bail breachers. We don’t care were he gets the money, we should uphold the Laws of the Land and make people understand that a bail is a privilege and can be revoked at the judges discretion. If you mean State/republican president then I must say that the criterion is already there; the president is chosen by way of national presidential elections from individuals that will have been chosen by their parties to stand on party tickets.
If you are talking about criteria in individual parties then that is a variable which may not be the same from party to party depending on their respective constitutions. But generally majority of the parties use the ballot to elect their party presidents who in most cases become their republican presidential candidates.

Chungu is right. He worked in Inteligence and he knows how ‘politically affected’ prisoners are treated. Have you noticed that anyone who has been imprisoned for such offences ends up sick after release? Only those who refused to eat food in prison like KK, Sata and Chungu himself have remained healthy. Shamwana, Kapwepwe, the Solos etc, Mungomba are all dead or ailing. The communist trained security forces all over the world poison people with dioxines, polonium etc. It is not always HIV/AIDS you know. Chungu knows the system.

Chungu is a criminal – period. He may have assisted Levy or not but that too is criminal. He could have helped his cause if he had challenged Levy while he was alive to prove that if Levy thought he was a saint there were people who criminally helped him to be president. The Zambian government defaulted on payments to System Innovations for installation of a security system at the Airport.
