
Government has warned that it will revoke operating licences of all radio stations airing political campaign songs before the date for this year’s tripartite elections is announced.
Minister of Information and Broadcasting Services Ronnie Shikapwasha said in Lusaka on April 8 that Government will not take kindly to some radio stations airing political campaign messages because it is against the Electoral Code of Conduct.
“Both public and private radio stations are bound by the provisions of the code not to air campaign materials before the President announces the election date,” Lieutenant General Shikapwasha, who is also chief Government spokesperson, said.
He was reacting to a Patriotic Front campaign song aired by Radio Phoenix yesterday at the end of a special programme featuring PF president Michael Sata.
Lt-Gen Shikapwasha said President Banda has not yet announced the date for the 2011 polls and Government will, therefore, revoke operating licences for radio stations currently airing political campaign messages for breaching the Electoral Code of Conduct.
“It is wrong for radio stations to air political campaign messages, including songs, when the date for elections is not yet known.
“I have also heard that there is a radio station in Northern Province which has started airing political campaign material. This is against the electoral code of conduct and Government will be left with no choice but to revoke operating licences,” he said.
Lt-Gen Shikapwasha said all radio stations should stop airing campaign materials and wait for the Republican President to announce the election date.
He said all media houses must adhere to the rules specified in their operating licences.
“I want to advise all media houses in the country to stick to the rules and regulations contained in their operating licences as well as the code of conduct to avoid conflicts with the licensing authority, which happens to be my ministry.
“Government has stated that it won’t interfere in the operations of media institutions, including radio stations, but let me make it clear that it is against the law for radio stations to air political campaign songs before the date of elections is announced by the President,” Lt-Gen Shikapwasha said.
He appealed to Zambians to remain calm and peaceful as the nation goes to the polls.
The PF campaign song alleges that Zambia has been destroyed by the MMD government and urges citizens to vote for the opposition party.
The song goes on to state that Government has sold Zamtel and alleges that the money has not been seen to benefit Zambians.
At the end of the programme, Mr Sata insisted that the campaign song be aired.
“Excuse me, can you put our advert. It is not over, put our advert,” Mr Sata prodded the host of the programme as he wound up the discussion.

Michael Sata has urged Zambians not give up their fight for change.
And Sata says he agrees with the Oasis Forum, which is demanding for the resignation of George Kunda who had been misleading successive Republican presidents on the constitution making process.
Featuring on a Patriotic (PF) Front sponsored live programme on Radio Phoenix yesterday, Sata said Zambians had suffered enough at the hands of the MMD and they should not give up their call for the change of government.

Has MMD itself been acting in compliance with the electoral code of conduct and if not, what has Gov’t done about it? Wouldn’t it make more sense to fine parties violating the code of conduct instead of revoking licences of the radio stations and banning campaign songs? This would not only be cynical, it would be creating an atmosphere of political intimidation which would ultimately result in civil disobedience and revolt. The masses on the continent now tend to dislike and distrust authoritative rulers.
I have avoided making comments on this matter until now. The reason was that I was of two minds. I strongly suspected that Hon Shikapwasha was wrong but at the same time I thought that he would not open his mouth and ridicule himself by speaking without facts. So I decided to do some research into the Electoral Act of 2006 as well as the Electoral Code of Conduct 2006 (the code has been revised 2010 but the aspects relevant to this case will be the same). I also looked at the Code for the 2004 Presidential campaign in Afghanistan, just to understand the concept better. It turns out that Hon Shikas is right after all, and sorry but the vocal majority of bloggers above are all wrong, baseless arguments. Now let me share my search results with you by quoting excerpts from the Law.

THE SAINT at #52 came close by stating “…..The Electoral code of conduct forbids campaigning outside the 90 days but that means a person saying ‘Vote for Michael’….”. But he also missed the point by assuming that the code only refers to campaigning for an individual and not a party. The concept behind the Code of Conduct in election campaigns is for the Law to give protection, rights, AND obligations to both PERSONS and PARTIES who have successfully been nominated (CANDIDATES) in order to campaign freely and use election campaign materials (Vote for …) DURING the campaign period stipulated by law, the 90 days.

In order to get those rights and obligations, parties are even obliged to fill in Form ECC1 under the Code otherwise it is illegal for them to campaign. This code has been formulated, agreed and accepted by all registered political parties in Zambia, it is actually a world standard even in USA, and Afghanistan which was helped by the UN. Because of the lengthy nature of these legal documents, I cannot quote them all but just refer you to the relevant sections of the Law. These must be read together as they are cross referenced.

accordance with the Constitution, the President shall, by statutory instrument prescribe the date of the polling day for a general election.
(2) The President, when determining the polling day under subsection (1), shall not set a date later than ninety days from the date of the dissolution of Parliament.
26. (1) The Commission shall, immediately after the polling day is prescribed under section thirty-five—
(a) compile an election timetable for each election to provide for the following:
(i) the date and method for the submission of nominations;

Mr Sata is an experienced politician (not an underfive) and he definitely knows these rules and codes. Mr Sata or his party appended their signature to these rules when they were formulated before they were made Law. It is unfortunate that he should be the one to break the Law that he helped create. And he knows that he can be disqualified from the elections (God forbid!) or be the subject of a solid election petition in the event that he won. So is it ignorance on his part, or ill motive to create anarchy in the nation? Anarchy? You only have to read the ignorant comments in the many blogs today, where most people are “convinced” with untruths.
#102 Nine Chale, you raise very pertinent issues which are the things we should be debating in order to respond intelligently to Hon Shikapwasha. For examplem, what exactly constitutes campaign material? Vote me for or Vote my party is definitely a no question answer. As for the banning of radio stations and songs, I would consider that unfortunate but a “government of laws and not men” (coined by Levy, MHSRIEP) can take that action. It is the easiest way to send a strong message to truant radio stations and other unruly media, rather than dragging each other to lengthy court sessions by sueing Mr Sata and risk riots. Even if Mr Sata has committed enough offences to clear him off the political scene, MMD may want to save him for what promises to be a savoury electoral defeat of Mr Sata.
