
THE Ruling Patriotic Front (PF) has said it was an illusion for Kasama Central Member of Parliament, Geoffrey Mwamba to rush to court to block his purported expulsion from the party.
Party Secretary General, Wynter Kabimba said the Northern Province PF committee had been in constant touch with Mr Mwamba from the day he was charged and suspended from the party but he neglected to respond to the charge.
Mr Mwamba was expelled by Northern Province disciplinary committee for conduct likely to bring the name of the party into ridicule, contempt, disrepute and acting dis-respectively to the party and officials pursuant to regulations of the party disciplinary code.
“It was an illusion for Mr Mwamba to conclude and pray to the court to find that the purported expulsion was illegal by reason of procedural impropriety and ought to know that the PF’s Northern Province committee had authority under the party’s disciplinary code to expel any member of the party,” Mr Kabimba said.
Mr Kabimba in response to an affidavit in support of summons to an interlocutory injunction not to expel Mr Mwamba from the party said the plaintiff’s application before court was unattainable because he flouted the party disciplinary procedure.
He further submitted that Mr Mwamba was not supposed to challenge the decision of the Provincial PF disciplinary committee that expelled him because he refused to appear before it and resorted to responding through the press.
“I have been informed that by Northern Province senior party officials that throughout the procedure when Mr Mwamba was slapped with a charge and subsequent suspension, he has refused, failed or neglected to respond to the charge or attend the meetings and the disciplinary hearings,” Mr Kabimba said.
He said Mr Mwamba was a senior party official who ought to have known that the decision of the provincial committee was not final as they were expected to submit their recommendations to the party’s Central Committee for further hearing and final decisions.
Mr Kabimba added that Mr Mwamba further neglected to adhere or to invoke the provisions of the PF disciplinary code to which he was duly bound as both member of the party and as Kasama MP.
Mr Kabimba also indicated that it was unattainable for Mr Mwamba to seek the Court to declare that the purported suspension and expulsion were null and void.
He said Mr Mwamba had not exhausted the normal administrative procedure by appealing before the disciplinary committee which would have submitted its new recommendations to the Central Committee.

Does anyone expect GBM to get a fair hearing when this muppet, Kabimba is not only the ruling party’s Secretary General but also Minister of Justice? Under PF, The Judiciary is very much compromised!
GBM made a very serious mistake.PF is a Club which has rules and regulations to conduct its affairs.Membership to this club is voluntary.A member who does not follow these regulations hardly gets a sympathetic hearing from the courts. GBM should have attended the the Provincial disciplinary committee meetings after which if he was not satisfied should have appealed to Central Committee.This he did not do.He is simply DONE WITH PF and should therefore brace for a by-election in Kasama Central.

What is Kabimba saying? He seems not to be sure of what to do with GBM. One moment he is insinuating that he is as good as expelled and in the same breath he is talking of possibilities of appealing to the top leadership. Kabimba knows that GBM is a major threat to his ambitions of taking over PF, hence he wants him close and in a disadvantaged position of appealing to a body he has so much influence.
Is it not the same Kabimba who encouraged Siamunene,Monde,etc to get court order from being expelled from UPND?
Kabimba we are tired of this,reduce fuel,meal meal,food stuffs and the sky rocketing depreciation of Kwacha as the major work Zambian needs.
Kabimba is right.You might hate the man or even worse stoop as low as wishing him to die so that the malilo satisfies your personal ego and interests, but it still won`t change the fact that his interpretation of the law in this case is in order.GBM broke the partys rules and it is folly of him to run to the court before his case is even tabled before the party’s Central Committee.The provincial committee that expelled him has no maximum authority to drop him which means that his parliamentary position is still safe.Hence his logic of rushing to the courts of law leaves a lot to be desired.
Hatred is not healthy. It makes one blind to fairness and truth. Some bloggers have become so allergic to the name Kabimba that they cant even see when he is talking sense. GBM had been boasting about his wealth and popularity and when the expulsion comes he rushes to the courts. GBM’s actions are the ones that appear to be senseless to me and not Kabimba’s arguments on the matter. Why should GBM disregard the rules of the same party that put him in parliament? That’s contempt and indiscipline of the worst order, deserving an expulsion.

Don’t try and give credit to a man who has lost all manner of integrity through his endless lies. What LAW is Kabimba interpreting here? There is no LAW to interpret here so please stop hallucinating about your heavenly sent “Kabimba” being right but consider the facts; GBM did NOT do any wrong by resigning his ministerial position, Did he? But the PF wanted to discipline him for bringing the “name of the President into disrepute” but he rightly challenged the dimwits to lay out what exactly he had done to “bring the name of the president into disrepute”. They failed to state that but opted to expel him (according to the media). Hence he sought the said injunction. Now the liars are out and you are fully behind them. Can I also challenge you to state what rules GBM broke?
Am no sympathiser of gbm, but plz leave INTERPRETATION of the Law to the Court. Mr. kabimba is not the right person to do that because he has obvious and biased interest in the matter. So, know when to glorify a point of view or better still, keep quiet to avoid exposing your ignorance.

We should centre our arguements on whether Kabimba is right or wrong in interpretting the law. He is merely responding to what GBM himself wrote.
I don’t like Kabimba’s tactics especailly over the constitution but this does not mean that I should lose my objectiveness in analysing issues.
I also don’t like GBM because of his arrogance and low calibre in analysing issues but inspite of this he has a right to defend himself and to be responded to.
I don’t like either men (GBM & KABIMBA) but they are within their rights in what they are doing. Let us be objective.

In Australia Julia Gillard and Kevin Rudd spent most of their term fighting and trying to oust each other. The end result is that come election time they were ousted right out of government. If PF is not careful they are heading the same route plus the Zambian tradition of dragging ex-leaders to courts of law.
When things turn sour for Kabimba he will play his usual tramp card i.e. tribalism. Unfortunately GBM cannot use the same card.

On a side note, it is only in Zambia that I have seen ministers or individuals put a 20-30 liter water dispensers INSIDE their offices! How much water can one person drink in the course of a day to want to have a 30 liter dispense in your office? Elsewhere, these things are put in a central place for staff and visitors to use!! They are public water fountains. But I see this setting every time a picture of a senior government or party official is taken of their office! I bet there is one each in the Presdient’s and the Vuce President’s offices too! Only in Zambia!
Wynter Kabimba is so obsessed to attacking GBM. Yet this is the man (Kabimba) who is secretly building an underground political party that is programmed to surprise Sata at some calculated time.
