Chizhyuka’s injunction still active, says lawyer

THE Lusaka High Court has restored an injuction case involving United Party for National Development (UPND) Namwala Member of Parliament (MP), Robbie Chizhyuka.

Major Chizyuka’s lawyer Lisimba Mutakela confirmed in an interview yesterday that the case was active and that they were just waiting for Judge Evans Hamaundu to communicate to them on the dates to commence hearing.

“This case is very active in court, it was struck out but we managed to file for the restoration which the court accepted and allowed the restoration, we speak with my client and we are just waiting for the dates to commence hearing,” he said.

The MP had applied for an injunction restraining acting party secretary general, Winstone Chibwe from banning him from the party.

He is seeking an order restraining party agents, servants or anybody else from suspending him from the party until determination of the matter by the court.

He is also seeking another order that dissenting views should be accommodated in a democratic country such as Zambia and another order that any party member is entitled to be heard before any disciplinary decision is made.

In a statement of claim, Maj Chizhyuka contended that the party entered into a political alliance with another party called Patriotic Front (PF) which he did not support.

“That I now pray to this honourable court and entreat it to grant me an order of injunction restraining the secretary general, his agents or servants and whomsoever from suspending me until the determination of the main matter.

“That unless the acting party secretary general is restrained, irreparable damage would result as right thinking people of society will no longer hold me in high esteem. There are no grounds for any charge or disciplinary action to be instituted against me,” he said.

He states that the UPND, through the defendant, viewed his dissenting views as not in line with its democracy and yet the Zambian Constitution enshrined the right and freedom of speech of all individuals.

And in an affidavit, Maj Chizhyuka states that he only saw an article in the Sunday Post in which it was alleged that he had spoken against the alliance of his party and the PF, which led to his suspension.

  1. Chizhyuka U practice ancient POLITICS like polygamous Daniel Munkombwe’s. U have refused to work with the PF on flimsy grounds. U insult HH and u expect those insults to be seen as diverging views. No bwana UPND has expelled u. Accept your fate and re-contest on whatever other party can stupidly adapt you. Meet UPND in the Battle ground. Why have you refused to do this. The answer is fear of losing and MMD throwing you out. The MMD can only use u as long as You are in UPND.

  2. this Chizhyuka is wasting people’s time if u think u are popular just prove it like Milupi did he resigned and met all the political parties on the battle field and still won dispite the presence of 14 ministers plus RB and the Vip fighting for Mwangala Maopu to win but they lost pants down.

  3. Why does he still want to be in a party he obviously hates. Could it be gratuity. What he is failing to see is that he is only useful to MMD because of his title of UPND MP. They want to continue using that in their papers Times of Zambia and Daily Mail and ZNBC. Once that is taken away from him he will be discarded to the rubbish heap of failed politicians.

  6. Machunga and co. Chizyuka. They will not be expelled because they shave the backing of RB’s party. Mpombo and Magande will be expelled because they are RB’s contendors. No opposition is allowed within MMD.

  11. In MMD we have Magande, Mpombo, Shakafusa raising contrary views to that of the party. In the pact we have the expelled section of PF Rebels, and one UPND MP. Though am told the likes of Hachipuka, Muntanga, Matongo, and Hamududu are simply awaiting gratuity before they can speak out. When we look at the situation holistically, you would be dishonest to condemn Chizyuka, and not Mpombo or Magande. As #5 has put it, you would be a hypocrite to set a stand for the opposition different from that of the rulling. In short am saying all these parties have rebels within their camps, its just a matter of tolerance exhibitted by the parties. It is clear the Pact lacks tolerance in comparison to MMD. Going by Luxon’s statement on the other link, if Kalusa were an MPhe would soon be facing…

  12. Let Chizhyuka enjoy his democratic right of opposing that which is wrong in his eyes. Why should he be forced to accept that which he thinks is wrong. Actually what he stood for is becoming a reality it is only those who are fooled by deception can not not see what the Maj. saw when he opposed the pact.In my honest appeal I urge the UPND top leadership to exercise restrain, forgiveness and tolerance on certain issues. Maj. Chizhyuka loves his party UPND and if he was not in love with UPND he could have resigned and joined MMD.

  13. If you are in Zambia, you would know that this is good news for HH and UPND. With Sata’s and PF’s recent behaviour towards UPND, a loss in Namwala will spell doom for the party’s political life and hopes of leading the pact. A loss here will simply confirm the theory that HH is loosing his strong holds. I know HH loyalist will attack me for saying this, believe me we were with people from Namwala, this Chizyuka man may not get the landslide he got in 2006, but its said he will retain his seat, just like Milupi did. If this is the case, HH is better off without a by-election.

  14. Why rush to the court for injunction.Take a leaf from real men like Milupi who resigned his post and retook it without any court injuctions. Chizyuka you are not factor in Namwala. People are just waiting for a by-election.Stop waisting peoples times.

Did you know that Zambia has a population of about 12 million? And out of 12 million people, only 500, 000 are in gainful employment leaving about 11.5million unemployed? Be reminded that Zambia has produced millions of college and university graduates who also, due to lack of jobs, join the so called bakaponya. So, most of those young men and women are intellectuals.   19. from #22…Rikki Ililonga’s song, “Osa museke…”? You people learn to respect others even if they did not have the opportunity to go to school and earn descent education to earn them descent jobs. After Walubita, how would we know that you are from affluent family if all were affluent? So, be reminded that the poor also serve a purpose of making you stand out as affluent. From this reasoning, they deserve some respect.
