I can’t drop Chiluba’s case – Levy

President Mwanawasa says he will not drop criminal cases against Former President, Frederick Chiluba he would be interfering with the rule of law.

Dr. Mwanawasa also said he will not take action against Finance Deputy Minister, Jonas Shikafuswa, over his derogatory remarks against women, until parliament concludes investigations into the matter.

Mr. Shakafuswa is alleged to have uttered derogatory remarks demeaning women, at Parliament.

He said even though he is Head of State and has the constitutional power to drop the cases such a move would be seen as interfering with the judiciary.

Dr. Mwanawasa said this during a swearing in ceremony for newly appointed Deputy Chief Justice, Ireen mambilima and high Court Judge, Albert Wood.

The President said although Dr. Chiluba is a friend of his, he will not abrogate the law to please the second Republican President.

He said Dr. Chiluba is being prosecuted by the Director of Public Prosecution on behalf of the people.

And Dr. Mwanawasa said it would be prejudicial for him to fire Mr. Shakafuswa as Deputy Minister because Parliament is still investigating his case.

He said at the moment there is nothing more that he can do than to regret Mr. Shakafuswa’s reported behaviour.

What benefits come can we derive out of those cases? after all even you(Levy) you can not account for the money and property recovered by the task force on corruption.I cahllenge you to publish a report in the national press to account for these national resourses, just as you did when you went to parliament to announce the alleged cases of theft commited by your kingmarker-Chiluba. Moreover those cases are now in court and as a lawyer you are better armed to know the sensitivity of cases which are in court in court.

ZAMTROP was created by Kaunda for such purposes, no country on earth exposes the use of such organs. And no budgets are ever discussed. Only “man mountain”, “baobab tree” can do such damage to our international intelligence functions.

What I need to say here over the FTJ case is it must only be disposed by the courts to teach a lesson for leaders the whole Africa that Kuwiba is not nice at the expense of the mass. Taking money away meant for development is the second worst crime after Judas Iscariot betraying Jesus. Chiluba should know what he did to Zambians during his rule especially towards his end was murderers. Sorry blogger may I be aloud to say this ” Even God who is mercyful will not forgive all at the last judgement because they had time to repent. Remember the story of the rich man in the bible.     For all loving Zambians ” Its easy to bend a fresh stock than dry one” let us teach our children good behaviour for them to lead better lifes later. Good or bad Chiluba must be punished just like any other offender who is found guilty of an offence.

  17. May be I missed this, is anyone asking Levy to drop Chiluba case or he is just alluscinating or just trying to push Shakafuswa’s calls to resign or be fired in this case? Anyway, probably I missed the calls for Levy to drop Chiluba case. The sad part is that Levy with his law degree which he has failed to expand with higher degrees thinks he is so educated and knows more about the law than other lawyers. Was he the only one who went higher than form 5 in his family? Seems like.

  31. The constitution of Zambia is clear on discountinuing any criminal proceedings! The DPP has all the power to enter a Nolle Prosqui independently without any interferance ,not the President! For him to even think of comenting on the case that he can’t drop the case,shows how the executive in zambia thinks they are above all other wings of the Government!
    He’s the lawyer he must know all these issues! We don’t want the Bulaya saga! even though now the Nolle is questionable thanks to the late Dr Alfred Chanda for questioning the Nolle Prosqi!
    Today any case that is discountinued without serious screwtny Pipo will question and challenge since we have a precedent already!

Chiluba should answer all charges as a matter of fact we are delaying this whole process, let us administer justice he JJ way, put them on firing squad, the international community (i.e US) will talk all they want about human rights as they are being practiced in baghdad when at the bottom of it they will be laughing at how we managed to clear a short president than the current approach of abiding by international treaties!!!

  35. Bloggers, ask yourselves-how long has this case drugged on? You don’t need to be a professor in law to know that “justice delayed is justice denied”. I am neither a fan of ftj nor am i of levy. But given the circumstance, I would have liked chiluba’s case to have been done with a long time ago. What is happening now is that more money is being stollen through this abnormal delay as there are a few who are making huge allownces on this case-further stealing. This case is now meaningless and it smells a rat. Question is, is this the most complicated case on earth to warrant it such a long time, hence, expensive. Is this how long it will be taking to dispose off cases of stealing in Zambia?

  36. The law in Zambian does not confer upon Levy’s office the power to pardon accused persons. His office only enjoys power to pardon convicts. I choose to believe Levy was misquoted pantu I fail to understand how a state counsel (the highest honour in the legal profession) can miss such a basic legal point. Ki butata.
