Sata-Levy defamation Case in new twist

The Lusaka Magistrate Court has rejected an application seeking to stay the defamation of President Mwanawasa’s case against Patriotic Front leader, Michael Sata.

Mr. Sata’s lawyers, Bonaventure Mutale and Edgar Lungu sought the suspension of the case in the Magistrate Court pending the determination of an appeal hearing in the Supreme Court emanating from the same matter.

Principal Resident Magistrate, Charles Kafunda has instead ordered that trial resumes before him on May 23.

Meanwhile, Mr. Sata and his co accused Patriotic Front Vice president, Guy Scot and Police Officer, CLement Andeleki have pleaded not guilty against charges of defaming President Mwanawasa in January 2006.

They are accused of brining the president’s name into scandal and ridicule as well as portraying the Head of State as a dictator and tin pot lawyer.

The three accused persons are alleged to have accused President Mwanawasa of ordering police officers to arrest patriotic front cadres that lined up along
the parliament road as he went to officially open parliament in January 2006.

Magistrate Kafunda rejected the application on grounds that High Court Judge, Charles Kajimanga after hearing Mr. Sata’s appeal ordered that trial proceeds in the subordinate Court.

Magistrate Kafunda was displeased and disappointed that Mr. Sata’s lawyers did not inform the court in yesterday’s application about the High Court’s order.

  1. Reading the above editorial, honestly, I dont see any defamation whatsoever. In Zambia money is wasted on rubbish.

    So, people involved in this case are even being paid. This case has no basis and I think it should be closed to serve money which is supposed to go to viable ventures such as aleviating poverty in Zambia.

  6. # 10 ba Brenda can`t U see these guys are just wasting resources? U are even happy about it sure? Don`t be fooled. What justice which misses LPM`s favourites? To me ba LPM benu is just planting the seed of vengance and hatred in U guys and U seem happy about it. Beware LPM`s behavour can be transfered to some of U young and upcoming leaders. These things are spiritual sometimes. Instead pray for these guys that they may show love for one another for the seek of mother ZED. for example see how KK and FTJ have failed to love one another. to the extent that some of their followers also don`t love each other sometimes. If that money was put to good use are you telling me that some of your relatives that have died because of luck of medcines could have died? or the prices of fuel can be on the continuese increase.   10. Laws like this have no place in a democratic society. One should be able to publicly insult the president without being hauled before a court of law. Most people on this blog have their opinions coloured by their hate for Sata that they fail to see what is going on. If this case is thrown out by a higher court then a precedence will be set and the law will have to be repealed. The MMD government know that this is an unjust law, so they are too scared to have it tested in a higher court. Remember the ‘Chiluba is a thief’ debacle? This law should have been repealed then. The other laws that need to be reformed are the treason laws.

  11. Chiluba was a thief no doubt about that. Sata is a thud no question about that. Levi is democrat….so he thinks. But one thing is for real……they are all the same.

Do not let your personal hate of certan individuals influence the way you rason. Other wise has 1 blogger pointed out this nation will be doomed as ur upcomin young 1s will be reasoing in the similar manner of hate. For sure, if you can’t see the sheer waste of resources supposed to be employed in meaninful developmental projects then small wonder that Zambia has little or no idea of lon term implications of the contracts they sign with foreign investors such as China. Or do they?

  16. Let Sata and Scott dance sinjonjo this time. Sata’s mouth has been running wildly loose since he accused KK of piling weapons of mass destruction in Sindamisala, an accusation he failed to substantiate even when offered a helicopter to go and fish the weapons out (sounds like George Bush and the Iraqi WMD) Now that he is on the hook for his stinking lies, he should be fished out and taught a lesson.
