Chiluba case fails to take off

Trial in the case involving Second Republican president Frederick Chiluba failled to take off in the Lusaka Magistrates Court.

Ndola based High Court Deputy Registra, Jones Chinyama who is handling the matter was not presnt in Court.

Journalists at the court were not given reasons.

The Former president was scheduled to start his defence after he and two others were found with a case to answer on 12 counts of theft and were put on their defence.

Dr. Chiluba who was accompanied by his wife Regina was seen in court as early as 08:30 hrs.

Chiluba and Access Financial Services AFS Directors Faustin Kabwe and Aaron Chungu are charged with theft after for allegedly stole public funds from the ZAMTROP account.

  1. What a waste of someone’s time. Will Jones Chinyama be disciplined? Oh, he was getting some pep talk from Levy. Somehow the state has failed to handle these cases competently.

  2. #2, it doesn’t sound like “Nolle prosequi!” to me. I can assure you its another gimmick for the chaps to prolong the case further in order to make more allowances on the case. This case has become meaningless. Chiluba might just as well be acqitted to stop this plunder of tax payers’ money by the GRZ.

Bashi Chipo should be the one who had asked Chinyama to be technically absent today!

  4. There is no bribe and I can assure you that Judge Chinyama can do anything to nail chiluba and the co-accussed for his benefit. However, Let us remind ourselves that the law is not legalised as we think. The foreign court had access to the Financial Charter of the Intelligence service and here we are getting the President refusing to owner the true and justy legal outcome. In the essence of this arguement Chiluba is judged by the Govt and not the Court as possible to be. Chiluba was the president and had access to this charter.Why is the president refusing? It to deny his predessor the fair trail or just to make it hard to the judges? Im not a lawyer by professional but I can see this as

Sangwa and co they know the content of the Financial Charter and want to base their argument on the integrity of the Foreign judgement over this issue.However, Im not a suppoerter of any wrong doing by those who hold high public positions. This is basic simple mathematics, if HH cannot win in Barotseland, how can he ever dream of winning in Eastern, Central of Luapula?     I think time for being tribal is long gone. Us, Tongas and the Southern Province have done alot for our nation Zambia. As someone has already alluded to, we produce food for most of the country supplies. We even harbour ZESCO’s most powerful electicity generation plants. Indeed many more aspects of how we contribute to Zambia can be listed, but I will leave you all who want more data to do some research.

    Many more are coming. HH may not have come at the right time to lead the UPND, but he is so far the only democratically elected president among of presidents in all current political parties in Zambia. My President Levy Mwanawasa comes in second. The rest are self-appointed opportunists who have been consistent as Poor Finishers (PFs) in our country presidential elections held recently.
    You may not like HH in his individual capacity, I remind you that u ain’t 11mil Zambians.

    Back to the topic at hand, I strongly believe there was a valid reason for Jones Chinyama’s absence.
    My take on the Chiluba issue is that let us bury the hatchet and ocus on developing Zambia. I for one wants to drive a CAR made in Zambia with a Zambian name, watch and listern to a TV with a Zambian brand name, use a PC with a Zambian name and an operatng system which works in my local language so that a person who struggles with English can follow what I am doing on it, etc.
    We need to advance our own technology!

    The case being handled by Jones Chinyama pertains to a case of theft (abuse of ZAMTROP), paying lawyers from Government coffers…..

    Another case before High court judge Japhet Banda pertains to the registration of a London Court judgment. It is in that case that the financial charter is being sought by the defense team

  38. #51, the best you can do is acknowledge that it is his time to lead. This is what I did as regards to my President LPM. The options I had were to renounce my Zambian Citizenship and wonder all over the world like a lost sheep or accept the situation and take President LPM has my President hoping that he will do his part to move Zambia forward in the meantime.

    The Holy Bible records that there is time for everything in Ecclesiastes 3:1-8, I think. And so, there is no need to insult or lose heart for it is simply not necessary. Someone said, “there is more that life, just life, has to offer.”

After almost 45 years of independence i never thought i’d see a day when someone would be proudly talking about tribe as being a factor in Zambia.I mean,all my friends are from different tribes none from my tribe exempt my young brother.Don’t know may be its ’cause i was born & raised in Lusaka, i’m in my 30s & tribe was not a factor even when i was marrying a lady from another tribe.To me & i know to many other Zambians especially those born after independence we are a mixtures of many tribes,some of us don’t even know how to speak our parents language.HH is a powerful politician,i’m no Tonga but i feel the man is one of the best politician this land has ever produced.Currently the best!!!!

  59. Tribalism has always been there in Zambia. KK knew this and devised a remedy of sending children qualifying to go technical boarding schools, in areas others than their provinces of origin to promote fusion and learning each other’s cultures. Today these schools have a higher pecentage of apamwamba’s children/dependants originating from that particular province, regardless of where they currently live. This is a complete move from the original concept and it has made the youth to believe these institutions are made only for a particular orientation and not all Zambians.

My maternal grandmother was Lunda and her husband was Lozi. I am married to a someone who is partly Tumbuka and Tonga. What are my children? They are Zambian. So stop that tribal nonesense NOW! Also remember no swearing. When you swear you insult us your elders.
