The Supreme Court in Zambia has reserved ruling in a case where the opposition Patriotic Front (PF) has applied for a presidential vote recount in last year’s poll.
Acting Chief Justice Irene Mambilima, sitting with other four Supreme Court Judges Marvin Mwanamwambwa, Sandson Silomba and Dennis Chirwa reserved ruling to March 11th, 2009.
This was after the matter came up for hearing before her Tuesday morning.
PF leader Michael Sata’s lawyer Bonaventure Mutale submitted that some of the constituencies and polling stations were allegedly supervised by unauthorized persons who had no legal mandate to do so.
Mutale alleged Chisamba, Mwembeshi, Michinga, Serenje, Milenji, Nakonde, Mbala and Senga Hills as some of the constituencies where returning officers were not legally mandated to supervise the elections.
He also submitted that the affidavit by the respondents stated that some names were merely transposed, saying this was an admission that there was a serious error.
But Solicitor General Dominic Sichinga submitted that the court should dismiss the application for a recount as it had insufficient evidence.
And Christopher Mundia submitted that it was extravagant for the petitioner to apply for a recount in all 150 constituencies when no evidence had been adduced.
There was tight police security at the supreme court grounds as the presidential application for a recount was been heard.
Meanwhile, Mr. Sata urged PF cadres after the hearing to remain calm and peaceful as they proceeded to their respective places.

Its unfortunate observing how deep politics have divided the country. You bloggers are a true reflection of current Zambia- a tribalistic Zambia. Guess what, all of you arguing are tribalists together with your political leaders, and will only plunge the once peaceful mother Zambia into a genocide den. When I wrote Mwanawasa left the country divided in tribal lines, some saw him otherwise a saint in all areas. I respected LM, but in the state of union, he failed, evident from his ill devised endless corruption charges, against political opponents of one tribe and other moderates. There is a thin line, but Zambia should watch this growing tribal and political rift, to abate genocide.
One of these political leaders comes from my hometown, the president was my MP while at Munali, and both were my Lusaka governors! Talking about election, first of all, they were unnecesary and a waste tax payers money. The election must be changed for the autonomous accendance of the vice, to president, in the event of the death of the president.
With the current election impasse, however, I would rather the president picks Sata vice president, recognise HH a with a high profile cabinet position, forming a government of national unity. It is not too late, because obviously, elections were rigged, if not, the comfort zone of less 1% is too narrow for RB holding on to power.
Sorry I meant, the constitution must be changed so the vice president automatically becomes president, in the event of the death of a sitting president. Verdict: It would be costly to hold another election. Let the incumbent rule until 2011, after all, it’s only 2 years to go. We do not want to spend another K247Billion when this can be diverted to education and health (thought it never does). Besides, we have entered into another financial period 2009-2010. The Budget does not provide. We can only provide for the 2010-2011 period in which case it may have been late as the elections will only be around the corner.

UPND Performance Analysis of 2006 and 2008 elections aftermath:
The dwindled but now better UPND performance in Western Province was due to Mr Sakkwiba Sikota’s accusations that UPND was tribal out of pride when he lost the UPND presidency elections to HH. The Northwestern performance is not bad though Minister Tetamashimba’s joining the MMD and the opening of booming late LPM time MINES reduced the UPND’s support there because people have food on their tables now. The Central Province support was lost largely because late LPM hailed from there together with the Shakafuswas who left the UPND I think. Lusaka Province isn’t bad at all only that the ….

Lusaka Province isn’t bad at all only that the … late Mtonga and Given Lubinda shifted camps to stand on PF ticket in the 2006 elections. However, the margins of election vote numbers are not any bad compared to both MMD and PF except that the MPs and Councillors seats are lost to the others.

The 2008 Presidential elction was the most transparent ever. I observed the elction at close quarters and voted. It was tightly fought but the truth is that Bashi Chilufya lost. It was a small margin but he lost. The whole election was swamped by observers and none of the observers has indicated any malpractices. In fact they praised the election. Bashi Chilufya is petitioning just to cool down his sponsors, that is all. He knows himself that he lost by 35,000 votes. The most important thing for Zambians now is to learn to trust our electoral system and to learn to accept election results.

Under normal circumstance, if Americans had voted for the president of their choice by looking at race, Barrack Hussein Obama would not have won!
