Government has started phasing out contractual jobs for Local Court Presiding Justices, a measure meant to place them on permanent and pensionable basis in the Judiciary, Parliament has heard.
Vice President, George Kunda, informed the House that government is expected to save substantial financial resources once the abolition of contractual employment of Presiding Justices is fully implemented.
Mr Kunda, who is also Justice Minister, said government is losing huge sums of money to engage local court presiding justices to handle cases.
Mr. Kunda said seeks to employ persons, not less than the age of 40, with adequate knowledge of criminal and customary law to enable them effectively handle proceedings premised on such grounds.
“We are moving away from employing Local Court Presiding Officers in the judicial on contracts because we want to save some resources and we have started engaging Local Court Presiding Justices on permanent and pensionable basis. These officers should be 40 years of age that are well vest in criminal and customary proceeding because we realise that at a tender age of 25 years, they will not be able to handle such cases,” Mr. Kunda said.
And Mr. Kunda has maintained that the judiciary is operating as an autonomous body and that it remains determined to undertake the judicial process conclusively.
Mr. Kunda was responding to a question raised by Katombora Member of Parliament, Regina Musokotwane, who wanted to know whether government has intentions to lower the age limit requirement for Local Court Presiding Justices from 40 years to 25 years noting that the officers only served for 15 years before retirement.
He also advised members of public to report local court justices, who disregards principles governing their operation, to Judicial Complaints Authority.
He said this in response to a concern raised by Roan MP, Chishimba Kambwili, who expressed concern over judicial personnel in the habit of insulting people appearing before them in the courts of law.

Are thess changes really inevitable or it’s just a formality? May some lawyers out there please enlighten us. So far all the comments reflect that there is no one conversant enough with judicial matters.
Oh! No wonder they take so long to dispose some simple civil cases which can only take 2months maximum time to resolve.
I hope we will see some changes in the way they handle some cases now that they will be getting pensions @ the end of service to the pipo of Zed.
# 8,there is nothing wrong in a blogger using a local language,in human interactions, what is important is to pass a message or in short communication,so as long as this blogger is able to relate to someone in one way or another ,in a way that can be understood then there is no problem.South africa and botswana should not be the only countrries where people are proud to speak in their local tongues come on tv or offices.So dont mind much about it,you can also even blogg in greek or tobolilo language as long as your message will be understood. 😕
not only the judiciary all govt wings must return to permanent and pensionable employment as this increases the security of the employee and no doubts govt will save more money and also they shud stop unecessary workshops and crying loud as mwanawasa has built them a very nice complex near uth
I will answer to G Kakundula later as there seems to be double standards here. In other wings of GRZ like defence & security services pipo aged over 55yrs are on contract why discriminate to local courts. Most of them who are contract are retirees and handle cases competently. Does it mean these pipo get Millions each per month. Why renengage someone over 55yrs on permanet basis. Kakundula please spare this type of double standard, we are still dealing with Dorika/Zamtel scandle. Let us be treated to issue at a time not continues commentries like soccer by Denis Liwewe.

Can someone please explain to me why Kunda continues to hold on to the Justice Ministry? Aren’t there other qualified people for that job?
Kunda is off side the local court justces are well experienced regardless of their age.In Western countries retirement is at 65 or 70 years in the civil and judiciary.Please reconsider your move ba kunda dont be persueded by MPs who never worked in the judiciary or civil service.
