
Vice president, George Kunda, has warned serving and former ministers not to divulge confidential government information.
Mr. Kunda says both serving and former ministers are under oath to protect confidential government information.
He said in Parliament on Friday that those who leave government should maintain their sworn oath.
The Vice President also said ministers are not immune to investigations when in office.
He was responding to Luena MP, Charles Milupi, who wanted to know whether it is government trend to only investigate ministers when they leave office.
Mr. Milupi referred to calls for former Finance Minister, Ngandu Magande, and former Works and Supply Minister, Ludwig Sondashi, to be investigated for alleged corrupt practices while serving in government.

Yesterday I read Magande’s letter to Dora which I presume was confidential, and today I see a warning to both former and serving ministers about information. Am I missing something?

It is futile to warn the ministers because certain information will always leak out, no matter how confidential. The truth is an offence but not a sin.
There are some institutions that benefit from this leakage. The media call it ” gefundenes fressen” which means ” just what they are waiting for”!!

If it was MMD who had circulated the letter it was not going to be confidential now its the opposite because the truth has come out. So what do you expect. Mr Kunda is only saying what all the ministers and ex-ministers know!! He is also aware that these Ministers have their own channels where they ensure that information flows if there need be. It is the same as corruption!! you can not completely eradicate it and information leakage will also be there from time to time.

How else would we have known about Dora Sillier’s Zamtel saga if it were not for leaked documents? Mr. Kunda should encourage transparency in government dealings and stop condoning corruption.

o::o This is very interesting, why this warning after we saw the Magande to Dora letter on this site? Well, now we know our so called leaders want to hide the truth of us their bosses (voters). Remember you will face us in 2011 which is just 2 years from now and you need to be very transparent if you are to get our votes. Dont think the rural poor will remain ignorant forever but slowly they are getting enlightened and you will have a rough time explaining to them to win their confidence and support. Just be transparent and you will not be afraid of us your boss when we know and understand what you are doing especially if its done for the welbeing of the public

It is ironic that a few months ago when I wrote of Magande’s capabilities as a leader that have the interest of the Zambian people at heart I was attacked on this very site; the consensus then was that RB was the right man. Well in hindsight, now we are collective poorer than under LPM and Magande tenure. My hope is that come 2011 we will not sell out our country again for 1lb of milly meal and ½ lb of sugar. lets keep the pressure on this useless administration.

George Kunda behaves as if he is not a state counsel.(Positions given by who you know, not what you know). Magande is being scandalised and it has been said that he was fired because of corruption so the guy has to defend himself. Is if so difficult for Kunda to understand self defence? Mr Kunda said something that should be common sense to anyone who works for any organisation, even more so to any one who has signed an oath while in office. I do not see why this should be a cause for debate. Should confidential or even secret information be required to build a case for self defense, such information would be applied for and obtained in a court of law. This was the case in the Zanaco case, for example. Leaking information that is secret or confidential is not acceptable in any country and Zambia is not an exception, whether this is done by government official or those outside.

Accusations on their own are meaningless, and if the authorities do not follow that up with prosecutions to prove their case, the accused can rightly sue them for defamation of character etc. You are missing the point and the reference to the Iraq war is misplaced. If a person willingly signs an oath to keep information confidential, they have a duty to abide by the oath or they risk prosecution. They can apply to be allowed to divulge such information without facing this risk and they do this through the legal system, for which incidentally, the highest court of appeal is the Privy Council.
Ba Jaro, the problem is when these guys accuse their colleagues or former colleagues of wrong doing and public claim they have documents to prove it. This is what happens when the truth is not told by our leaders & only get the information from other sources which even prove their assertions were not right. Most of this information belongs to us the owners of the nation and not our servants (politians) for as long as there is nothing that endangers our security as a nation i believe its very health to provide (not even leakage as some say) to the rightful owners which are the people who put the Pres., Min. & MPs in office
As I stated, if the accusation are real, there will be a case to answer and all the relevant information will be available in court. It is not for Mr Magande to prove his innocence but for his accusers to prove his guilt. Parading confidential information in the media is unacceptable and those who sign oaths when they take office are not immune to the legal process when they disregard what they signed up to uphold.

Questioning whether the country has secrets or not is hardly the point. Doctors take the Hippocratic Oath and anyone who does not abide by it can be disqualified – there is a reason for that. Employers have confidentiality clauses in their contracts, and any one who flouts them can be fired and even prosecuted in the case of intellectual property rights. Yet you continue to argue that all this should not apply to Zambian government officials. You might have the beginnings of an argument if people were being jailed without recourse to due process.

Only last month, Kunda went to inform parliament that government is in the process of enacting a law to protect whistle blowers. His recent utterances contradicts this position. Mr. Kunda’s threats come at a time when the tribunal probing Dora Sillier’s conduct over Zamtel is currently in session. Is he trying to intimidate witnesses?
Whether someone took oath or secrecy or whatever, information that will help members of the public know what their servants are doing is good.
Of course, and that is why a democracy is with an open, independent, efficient and accountable judiciary is crucial. Zambia’s is not perfect is this regard but it is making very good strides towards it and we should seek to uphold the law and use the legal system to fight any malicious cases. Nothing I have stated here and in previous posts contradicts the point you have just made.

So, my plea is that this OATH thing MUST be extended to all those who have taken it in the Courts of law or at State House or whatever.
Also, 17 year old MMD GRZ, please stop indicating that you have documents to prove that your enemies in the MMD were planning to do this and that while you get worried when some people release data with the REAL TRUTH.
