Communications and Transport Minister Dora Siliya has said former State House aide David Kombe told her that former first lady Maureen Mwanawasa wanted the ministry to favorably consider a specific firm for an e-governance tender.
Ms Siliya told the tribunal probing her conduct that Mr Kombe who claimed to be Mrs Mwanawasa’s emissary had consistently asked her and other officials in the ministry to consider ZTE which was not one of the companies short-listed for the e-governance tender.
Ms Siliya, in her defence had on Monday alluded to the fact that her ministry was in the past considered to be corrupt because an official from State House had interfered with a tender on e-governance at the ministry.
At this point, the petitioner’s lawyer Bonaventure Mutale said the official should be named but Ms Siliya’s lawyer Eric Silwamba objected saying such names could only be revealed in camera.
But yesterday when defence resumed, chairperson of the tribunal, Supreme Court Judge Dennis Chirwa said the name of the State House official should be revealed because he could not be protected like a whistle-blower.
The minister is alleged to have unilaterally cancelled a duly awarded contract by the Zambian National Tender Board (ZNTB) for the supply, installation and commissioning of Air Traffic Management Surveillance Radar Systems at Lusaka and Livingstone airports.
She is also alleged to have awarded RP Capital Partners a US$2-million contract to value Zamtel assets disregarding legal advice from the attorney general and in the last allegation she is said to have abused constituency development funds (CDFs) in Petauke.
In her explanation yesterday, Ms Siliya named the official from State House as Mr Kombe who in the first instance went to her home and said that a Chinese company, ZTE, should be considered on the e-governance tender.
The minister said that although Mr Kombe, who was chief analyst for Press and public relations, maintained that he was sent by the former first lady, she never confirmed if he was an emissary of Mrs Mwanawasa.
She said ZTE was not among the six companies that were earlier short-listed for the tender but Mr Kombe told her that it was important to consider the company and once that was done, she would be well-looked after.
The same company after re-evaluation of the tender ended up being the preferred company and the one that was chosen earlier, Hua Wei was placed at the bottom of the list.
“He also made reference to the former first lady, Maureen Mwanawasa that she was a friend to ZTE, making it sound like the issue was above him,” she said.
She said when she told Mr Kombe that she was new at the ministry and was not aware of the tender in question, he still made follow-ups by phone.
She said the then permanent secretary Eustern Mambwe and director of procurement Isaac Mukupa also admitted having been under intense pressure from Mr Kombe over the same matter.
In her continued defence, she said that she signed the memorandum of understanding (MoU) with RP Capital Partners of Caymans Island with the blessings of the solicitor general.
She said when she signed the MoU on December 22, 2008, consultations with the attorney general continued, leading to the signing of another MoU on January 9, 2009.
“We signed another agreement this year because even when we signed the first one in December, 2008 we continued to consult because we wanted to have a clearer role of the Zambia Development Agency (ZDA) in the evaluation of Zamtel assets,” she said.
She said when the solicitor general wrote to Ms Siliya making suggestions, she instructed the permanent secretary and the director of communications to consider the advice when signing the MoU.
She said then a meeting was held with Commerce, Trade and Industry Minister Felix Mutati, Zamtel board chairman, and RP Capital Partners officials while the minister of Finance sent apologies.
The meeting was held with a view of coming up with a joint Cabinet memorandum and to explain problems Zamtel was facing before seeking advice on the partial privatisation.
In cross-examination by Mr Mutale, she said that RP Capital Partners was the only company that came up with an offer to value Zamtel assets which the ministry was interested in.
Ms Siliya said from August 2008, the issue of Zamtel came up several times in Parliament while several Press queries were also received and a number of companies expressed interest to buy the company or partly the Cell Z.
“Other than the outright purchase of shares in Zamtel, towards the end of September, RP Capital Partners presented a different proposal of evaluation which met our agenda at the time,” she said.
On the Petauke allegation, she said that she had advanced K12.5 million to the council for the drilling of two boreholes before the CDF was disbursed.
She said on October 29, 2008, she was approached by several women in her constituency who complained of water shortage because two pumps had broken down.
She said when she asked the council secretary, Boyd Mboyi on the state of affairs she was told that there was a problem of water and the CDF had not been released.
“After meeting Mr Mboyi and the council chairman Osman Musa, they told me that a water department drilling machine was in Petauke and the officers were only asking for an advance to sink the boreholes,” she said.
The minister said that since she was going back to Lusaka and she only had K7 million, she gave Mr Mboyi K6 million with an assurance that she would add another K6.5 million when she returned to Lusaka. The hearing continues.

In a court of law this is inadmissable evidence. Dora is in hot water. Look at her weak explanation as to how she picked on RP Capital. The whole story is that a Zambian businessman by the name of Mwanamuke approached her and told her about RP capital. She met two representatives from RP Capital and two other Israelis the same Steinberg gang that has been looting DRC. So in Dora’s logic a Mwanamuke introducing her to RP Capital is not corruption but it is if it is Maureen.

This Maureen/ Kombe arrangement is typical of deals in Govt and parastatals. Dora was even luck that Kombe mentioned Maureen’s name. Otherwise, the style is just someone giving you instructions and tell you it’s from higher offices. You will be luck to get confirmation from that office.

if the tribunal bulletins in the Post are to go by Dora seems to have won this case, the contracts alleged to have been cancelled are in progress meaning they were not cancelled, Petauke district seems to have under refunded her contrary to what was alleged, the attorney generals later that was said to have been a directive against signing of the MOU has the last paragraph reading “you may proceed subject to the above concerns” the question is, is this a directive?The most interesting was the K12m refund for pumps that cost K5m. the witness was asked who installed the boreholes and if 2 boleholes would cost K12m. it was later found that infact the council owes dora K500. Bwana, that is how every case is handled in a court of law. If her lawyer do not bring up such issues, then he will be failing in defending his client. You throw as many darts as possible and you see which ones stick. It is up to the other side to redirect, and if they are not as smart, their case go bye bye. It appears that the consolidation on the MMD possible presidency and ultimately presidential candidate for 2011 elections by President RB Banda has a lot to do with bringing down all serious opponents in the MMD. Sad enough Mrs Maureen Mwanawasa seems to be among the threats to the MMD presidency and slowly she might be brought down especially after the comment she passed that people must be allowed to air the views in MMD without being stopped by the the current MMD leadership that appeared in the POST a while ago.

Why is that whenever Dora Siliya becomes aware that a corrupt act is about to be committed she never bothers to report the culprits to relevant institutions. Instead she uses it as a justification to circumvent government rules and regulations. I think she is a corrupt liar.
I agree with you. Didn’t she know her role as a minister? If she acted because Kombe told her that she would be well looked after – isn’t that corruption? Can she produce documentary evidence of all these deliberations with Kombe? Surely, could she ask Kombe or the former first lady to put their requests in writing? I think she is not only corrupt but utterly incompetent as well. Does she understand the importance of keeping documentary evidence for continuity of govt operations? And above all, she had the President as her boss, why didn’t she consult?

Siliya’s defence is very weak, without any written or recorded evidence to support her allegations. Let’s assume she telling the whole truth. How much, does president Banda know? And why is he, RB, so keen to see the post collapse?

DORA Siliya yesterday told the judge Dennis Chirwa Tribunal that she did not understand what the word “nullity” meant as highlighted in the Attorney General’s legal opinion over the RP Capital memorandum of understanding (MoU).
And we appoint someone without the most basic of knowledge in that Ministry, what a joke. She can’t understand the word ‘Nullity’ and signs contracts without reading them. And we continue to pay such an embecile as Cabinet Minister. What a lot of nonsense. But we believe she gave ‘yakumbuyo’ to someone desparately high up there. Lishamo sana pa Zambia. No wonder people over throw govts. You cant have such nonsense going forever.
Pa Zambia Zo ona! yalula nkani. But the truth is since the chiluba regime a mafia type of operation existed in Zambia where wealth circulated among a chosen few with serious barriers to entry, if you were not ba so and so forget progress. So what Dora is revealing whether true or not is actually what happens in government, there are cartels at tender board, zra, ministeries etc so let the rot come out so that the ordinary citizen would for once have a voice pa zed.
This tribunal has exposed Dora’s plain stupidity. If a “nullity” can spook her such big time, how can she comprehend complex negotiations with Israelis and Chinese? See, both Kombe and Mwanamuke were lobbying, why nail only Kombe to the cross? Why is she so receptive to Mwanamuke whom we know to be Victor Mbumwae’s cousin!
Makani abija badala, its strange that Dora is now spilling the beans this time, why was she all this time

I wonder why this whore called Dora hasnt been suspended or put on leave.She actually spends all the day at the tribunal and she hasnt got any time to be in the office.
Dora is just shooting in the air.She wants to divert the attention from her to Maureen. In todays Times of Zambia, Dora has now mentioned Ntembo Nchito. She says Nchito told her that the ex-PS Eustan Mambwe was corrupt. This whore doesnt have any documentary evidence and the tribunal has really exposed how dull Dora is. Nowonder she used bottom power to excel at UNZA for her BA and Msc. This this calibre of ministers-no wonder Zambia still lags behind in terms of development.
Dora says ” I did not read the MOU for RP Capital when i signed it in December”. Can a normal person sign something without reading it, to me this statement shows you are not good enough to be a minister madam. if you can just weak up, go to your office and start signing things you find on your desk without knowing what you are signing for….lol…what a jok
