Zambian Airways Investigation to spread to other countries

THE Director of Public Prosecution (DPP) has advised investigative wings probing the operations of the defunct Zambian Airways to extend their investigative sphere to other countries to avoid piecemeal conclusions.

Transparency International Zambia (TIZ) welcomed the directive to extend the investigation to foreign countries, saying that it would ensure comprehensiveness in the investigation of the matter.

Inspector-General of Police, Francis Kabonde said officers from the Ministry of Finance and National Planning audit department had been called in to strengthen the team and would soon travel outside Zambia for investigations.

The combined investigating team had handed over to the DPP a preliminary report on the airline’s failure to remit about US$1,793,782 in passenger service charges.

Mr Kabonde said in an interview in Lusaka yesterday that in order to avoid inconclusive findings, it was imperative that the investigations were not only restricted to Zambia but spread out to other countries where the airline had offices.

The police chief said the investigation was complex but the probe team comprising officers from the police, Drug Enforcement Commission (DEC) and the Anti-Corruption Commission (ACC) had made headways.

Sources said the investigating team was pursuing the criminal charge of theft by agent against the airline’s directors, in contravention of Section 272 and 280 of the Penal Code, Chapter 87 of the Laws of Zambia.[quote]

The team was also investigating how the Zambian Airways in 2007 secured a $5.5 million loan through a consortium of financial lending institutions, which consisted of Investrust Bank, Intermarket Banking Corporation and the Development Bank of Zambia (DBZ).

Police have already recorded warn and caution statements from the directors of Zambian Airways in connection with the investigation into the operations of the airline.

TIZ president, Rueben Lifuka said the investigators and prosecutors should commit to doing a thorough job and thus enhance the chances of success of these cases in the courts of law.

Evangelical Fellowship of Zambia (EFZ) executive director, Paul Mususu welcomed the widening of the investigation but cautioned the probe team to ensure that they did not use more money than that would be recovered.

Zambian Airways early this year suspended operations citing the high cost of aviation fuel and other operating costs for the decision.

  1. Hope the investigative expenses do not surpass the amount allegedly to have been ‘stolen’ by the Directors & all those affiliated to Zambian Airways,to me it sounds like some chaps will start partying.

  2. Now zambia is run like akantemba. Anyone can do anything at any time. The cost of investigating this airline will be more than the debt itself. Hope it makes sense.

  3. It was obvious from onset that international offices would be reviewed as well. Realising now gives me an indication that people entrusted to do the audit have limited or no idea of what they are dealing thing. By the way, inquire about the permits of doing such work in respective countries before you venture there.

We simply can not afford to dismiss cases just because more money will be spent on investigations of small amounts to be recovered.

As for Zambian Airways Directors, it appears that nothing wrong in your dealing has been found yet to bring you to court following “The combined investigating team had handed over to the DPP a preliminary report on the airline’s failure to remit about US$1,793,782 in passenger service charges” and the words attributed to the Police Inspector-General .

    Sad how quick speaking by the President RB Banda may show that he had no good case over the Directors of Zambian Airways just like he failed on MP Ng’andu Magande.

LT you are letting us down,how come up to now you have not reported on the national power black out the whole country faced last nite into this morning.Fellow countrymen this country is being run like ka ntemba,i still have problems in understanding what the so called engineers we have at zesco do day in day out,our country has experienced three major national power blackouts in the last 36 months,and we seem not to be drawing any lessons from this.As if this is not enough our current govt doesn’t seem to show concern over this,its evident in there quietness on the matter,or is it that they are also overwhelmed shame on them,ha ha ha.naleka mukwai!

  7. # 1 you are right, so is the cost of investigating Kapokos 27 billion. And most of these funds will go to the investigators pockets in terms of allowances. they will drag the investigations til they finish building their houses and buy more cars. they too are civil servants.

  8. zambian plunder and corruption cases take a minimum of five years or so to dispose off, it will be ineresting to see how long this one will take.

  9. This Chiluba National Resources Plunder case has outlived its usefulness and needs to be disposed off immediately. If it is possible, please Mr President use your powers to pardon Mr Chiluba of all his alleged wrongs. I need to see Zambia progress now and money chanelled to developmental concerns.

  10. My bad, “This Chiluba National Resources Plunder case has outlived its usefulness and needs to be disposed off immediately. If it is possible, please Mr President use your powers to pardon Mr Chiluba of all his alleged wrongs. I need to see Zambia progress now and money chanelled to developmental concerns” is for the other thread. For this one, my reaction to 11’s “zambian plunder and corruption cases take a minimum of five years or so to dispose off, it will be ineresting to see how long this one will take” is that let us put a law in the Constitution to restrict all court cases to a term of office of a GRZ of 5 years.

  11. #7 The Zambia airways Directors are not innocent it’s just that white collar crime is very complicated. It needs specialised people to deal with it and unfortunately our boma doesn’t seem to realise this. An armed robbery case is easier to solve than white collar crime especially one commited by a lawyer. Hire an audit firm to carry out a forensic audit. I knew Zambian Airways was tricky the time they removed a qualified business person for the shareholder to run it. A lawyer running a corporate business….goodness me!!

  13. This issue is mixed with political feelings, There is nothing wrong in investigating cases outside the country. This not an ordinary case of theft. It requires detailed investigation so as to ascertain whether it can be tried in court or not. If cases were to be weighed based on “Trade offs” of costs Iinvolved then the majority of cases in Zambia would not be investigated. The amount of prosecuting a case of 1 million Kwacha theft is far more than the 1 million Kwacha itself considering overhead costs involved ie administration, wages for police, prosecutors, and judges involved. It is worse off for cases involving lesser amounts of theft. If we follow Mususus arguments then only cases involving billions of kwacha should be investigated. A case is only established upon…

  14. Why are we still talking about this issue ? Thought it was already sorted and RB was studying the reports. What is wrong with our leaders ?Going to other countries were they had offices now is a share waste of time because obviously most needed data wont be found. Evidence already destroyed.

Let us learn to appreciated the Zambian Law and also acknowledge the truth as regards to why the ZA Direcotrs are freely roaming around the whole world.

    Are you indicating that ACC, DEC and ZA have no auditors to perform a forensic audit following your “Hire an audit firm to carry out a forensic audit“?

    Which countrywide blackout are you talking about? Am in Zambia and am enjoying electricity from Zesco. Which country are you referring to?

  17. The advice from the DPP to extend the investigations is juicy.It cant just be confined in Zed only.The extent of ZA mismagement has to be fully exposed.
    Bwana IG be mindful of the cost of the investigation and not just adding people on the already bloated combined team of investigators.Quality(small competent team) is better than quantity(big blotaed team hell-bent on gobbling our meagre resources in terms of allowances)

    Could Mr Francis Kabonde also be informing the public of the progress in the KAPOKO K27 billion scam as it is a more serious criminal matter which needs public scrutiny. Also, can our lady, the Auditor General, institute further investigations in other ministries as well so that there is no stone left unturned.

  20. Its sad that GRZ are trying hard to PROVE that what RB alleged against ZA is TRUE. If ZA failed to remit monies collected on behalf of NAC then NAC must start civil suit against ZA. I believe thats how its supposed to be. If I fail to remit money to NAPSA then it will be up to NAPSA to find means to recover that money from me. Its not KABONDE to investigate me. What a shame for the country to be run by a bunch of COMEDIANS- Luaka Play House is waiting-go there please.

  21. These so called investigations are just too numerous that in the process some are forgotten or simply swept under the carpet. Let’s face it, the authorities know the truth to these things and they just want to buy time because it is usually the big fish behind all this. These endless investigations are just an easy way for clever people to make more money for their pockets, they do not benefit the poor in any way. Zambians know the crooked and guilty big fish walking the streets scot free and you waste precious time and money on meaningless investigations. Just round them up and drag them to the courts.

  22. #21 Yes there was a blackout at 20:21hrs – 03:45hrs. Problem was at Leopards hill Substation. It affected North of Lusaka and the Rest of Zambia North including the CB. Even Radio Stations and Cell phones were off air. Which part of Zambia are you?

  23. # 28 I agree with you on the blackout last night. I got some calls from the CB asking if we had power in Livingstone and thank God we had. Maybe were # 21 is there was no blackout but a lot of places had no power.

  25. #29 Conundrum- On allowances am with you. These guys come up with all sorts ways just to make that extra buck at the expense of development. Imagine Town Clerks have gone to China to see how towns are run there as economic zones. KK did that so all they needed was to look at the papers rather than go all the way to China-of course am forgetting the real raeson- allowances.

The last time I experienced an electrical blackout was the one due to natural causes and I know how it feels.. but do you know that if any damage occurs to your electrical goods in your house ZESCO is supposed to compersate?, in some countries even your food wasted in your fridge can be compersated.. if you are lucky.

  29. #20…..Iam not talking in respect to the law but in reality. Where law is concerned they will be found innocent hence my mentioning that white collar crime is complicated. It’s always difficult to convict someone who commiting a crime always have the though of what if iam caught at the back of his mind. The directors shall always walk our streets freely. ACC, DEC and Police might have forensic auditors but I don’t think they have certain specialised auditors. Specialised financial courses cost a fortune hence people who study them rarely work in GRZ Plc.

    Harare — VAST swathes of the country were last night plunged into darkness after Zesa lost power supplies from Hwange and Kariba power stations.

    The utility said supplies from Mozambique’s Hidroelectrica de Cahora Bassa and from the Zambian power grid had inexplicably gone out, leaving large chunks of the country without electricity.

  32. The investigations are welcome. Zambian Airways had to be crushed to pave way for Zambezi express; Banda invited Nsagomas to try and put demons on zambian soil. Whats new, Corruption is Rampant. Kaunda wanted to be a gd in the late eighties with heaven on earth. When are we going to have righteous people to rule.
