18 PF MPs oppose impeachment calls

PATRIOTIC Front (PF) Members of Parliament attending the National Constitutional Conference (NCC) will not support plans to impeach President Rupiah Banda because he has not violated the Constitution, spokesperson, Peter Machungwa has said.

Dr Machungwa said in an interview in Lusaka yesterday that there was no Article in the Republican Constitution that the president had violated and the 18 PF MPs attending the NCC, therefore, found the calls to move the impeachment motion to be misguided.

“You only impeach the president if he has abrogated the Constitution and nobody has given any evidence showing that the president has violated the Constitution. In short, this thing is a non-starter,” Dr Machungwa said.

He said Article 37 of the Constitution stipulates the conditions under which an impeachment motion could be instituted against a president if the office holder had violated the Constitution.

He said an impeachment motion should be instituted through a notice given to the Speaker in writing and signed by at least one-third of Parliament, representing 53 MPs and that is not achievable under the current composition of the House.

The MMD has 81 MPs, PF 40, and UPND 22, while the United Liberal Party has three and UNIP one member.

Dr Machungwa said after its introduction and exhaustive debate, the impeachment motion could only be passed with the support of two-thirds of Parliament, representing 106 MPs.

In the event that such a motion was passed, a tribunal would then be appointed by the Chief Justice.

But even after its findings, the actual impeachment would need the support of three-quarters of the MPs.

Dr Machungwa, who is Luapula MP, said even other PF MPs not in his camp were against the motion to impeach President Banda because of the realisation that he had not violated the Constitution.

“Even assuming that there was no split in the PF, I know that some members will still not support the motion because they know that it is a non-starter,” Dr Machungwa said.

He said that MPs and opposition leaders pressing for the impeachment motion should produce evidence that President Banda has violated the Constitution, which he swore to uphold.

Now with 18 MPs rubbishing it, do we even have the minimum 53 to move the motion not mentioning the 106 required to pass it. This has been very damaging to the PACT.

    Someones who speaks objectively and independently and states their opinion is called all sorts of things if the opinion is for the ruling MMD. All sorts of thuggish vile hateful things are said about the person. They say You have been bought, you are a beneficiary, you are an MMD shushushu, you have been paid by the MMD, etc.

    Perhaps we have all forgotten that we are in a democracy and in a democracy, people will support and vote for different parties. If everyone votes for the same party then it ceases to be a democracy. You will never find a party getting 100% of the presidential vote in a National Presidential election. [tbc

  10. Its true the impeachment bid lacks constitutionality. There are no valid constitutional proviso violations. In light of the Legality surrounding Dora’s appointment there is a proviso [statutory Instrument] invoking presidential discretion to appoint without consultation thus enforcing article 42 of the Constitution of Zambia. It can be argued by convenors that certain parts of the act be enforced but such fall short of valid contention with respect to the proviso. It shall be an excercise aimed at embarrassing RB not ridding him of power. However it shall be at the expense of Zambians’ Time in parliament through their representatives.

  11. Now coming to the story, We all knew there is no way this motion to impeach the president would pass. It would just lead to another expensive election and is also leading to costs in parliament. The MP’s in parliament should be discussing developmental national issues and not impeachment of the president especially at a time when the world and the nation is financially strapped. How deep does Sata and HH want us to dig in the national purse should the impossible situation arise that the impeachment happens?

    HH is just talking senselessly. This is similar to his 24 hour ultimatum on Dora Siliya which saw nothing happen. [tbc

    As for Sata, we all know about his wishful thinking and how he speaks big on the impossible. Sata is once again showing traits of his empty words. We all saw this with Chiluba’s 3rd term bid which never happened, his 90 day economic miracle formula and finally this impeachment motion.

  17. The problem in Zambia is that people in most cases vote for MPs who do not live in their areas. How can someone who resides in Lusaka, Ndola or Kitwe be an area MP for Kasama, Mongu, Chipata etc. It does not make sense at all. An area MP must reside in the area so that he can follow on what is happening. I feel the people are sometimes partly to blame for all this crap our country is facing. As for the fight against corruption let us forget it. The root cause of corruption in Zambia is poverty and greediness, we all know this, and as such until such time that poverty is eradicated and leaders start thinking about others we should not cheat ourselves that we shall do away with corruption never and this is regardless of who is President. All cases going on now will never end corruption

The trouble is, you pay a party monitor say in Magoye of Kashikishi, they then decide to get more money by doing what the ruling party decides. These people will never leave office. It is like going to state house is the most important and main issue on the agenda for most of these politicians. We need some Oboma type to emerge before 2011, someone young, wise and clean. It is time the young generation stepped in to save our country after all it is the future of the young people at stake. If 18 of them which is nearly half, dont support the impeachment process then the whole thing has got no legs to stand on. Opposition is wasting it’s credibiility with all these dramatic but empty gestures. Zambia is a democracy so you dont have to like RB, but the fact remains that he has not committed any impeachable offence.

Sata was telling lies that even some MMD MPs support the impeachment process but he forgot about his own party. What kind of strategist is he and some of you think this is the calibre of person to rule the country?

  26. 3RqU I get your point but what is worrying me is the fact that some of us still have relatives in Zambia and at the rate tings are going Zambia may end up in a disaster. We saw this under KK when some military guys working with civilians almost overthrow KK. You can push people but when you push them to the wall and you can not push then further they are bound to react. No one wants to see bloodshed in Zambia but the way things are going that looks enavitable and I won’t be surprised. There is just too much hatred in Zambian politics like never before and this sitiuation gives food for thought. RB’s alliance with Mugabe is another danger to our country, Mugabe of all people who was an enemy of LPM, who had no respect of LPM is all of a sudden RB’s friend. Sometime I wonder what killed…

This is why the UPND-PF PACT needs a good leader who needs to inspire confidence in all its members and that is no other than president HH as of now. All he needs is the Copperbelt Province to be convinced that he never s t o l e any money from Luansya Copper Mine during his time a boss of Grant Thornton when the RECEIVERSHIP was conducted by it on behalf of GRZ which previously owned the mine.

We need a person who is charismatic, who understands international relations and economics. There are a lot of strange things happening in Zambia. Just after RB was elected President of Zambia, Campaigns for the next elections begun. We all know that the impeachment issue is just a noise in the air, who remembers the inexperienced politians words giving MMD 24hrs ultimatum or else… Now its reasons for the impeachment….. MMD might not be as good as expected but they are in control of things. The only way to tackle these issues is to wait til 2011, were we would have our voices heard through the ballot papers. If truely the opposition pact is worth contesting and later on win, then that would be good for the democracy. The only problem is that the pact has no leader.

They rise through the ranks to eventually take on the responsibility. Obama did not just a run company so well as to assume the office he occupies.   48. People RB has no plans where development and ruling a nation is concerned. On the one hand, he’s very active when it comes to welcoming leaders from other countries. He’s even gone to an extent of giving a piece of land to Mswati. Has any leader ever given him a plot. His deeds are extreme. All because just like any other MMD member, they believe “title is bought”.

    On the other, he never even comes out when it comes to tackling serious problems facing the nation. He keeps quiet and all his people can do is to come up with the worst solutions a nation has to offer.

    So, MMD must go ASAP. The more time they are given to stay in power, the more they will steal and ruin Zambia. Apart from that MMD is full of irritating faces. Looking at them, one sees no seriousness in them.

ONE THING FOR CERTAIN This man Machungwa knew that LPM could not tolerate double standards thats why he thought of going to PF and possibly because he was not adopted to be MMD MP so as to stand on the MMD ticket so the thind was to join the opposition so as to still be MP and talk against the same party that put him there through the people who voted for the party. What should happen now is like what they do in Bostwana and South Africa. When one votes the person does not vote for the person but for the party if one misbeahaves and is taken away from the party they just replace the MP without by elections.   55. Let’s be rational in debating national issues. The 18 PF rebel MP oppose the impeachment on ground of lacking merit. Both Sata and HH have failed to advance reasons. While the rebel PF MPs are have sinned aganist Sata and PF, it does not mean everything they do and say is crap. The bottom line is Sata and HH know that this impeachment is non-starter… but hay this is politics… they need to be ssen to ‘active’ whether for the good or not.

    Otherwise, it will appear he likes lying and being cheated.

  62. Impeaching a president in our country is a dream, even though the president had a minority government in parliament. The reason why this cannot happen is because of a disease we suffer in our country called POVERTY!!! All these things we talk about in our country are for the western world. So lets not waste time talking about impeaching a president when we all know it will never happen for two reasons:
    1) The MP in parliament can easily be corrupted because of the poverty they experience in their home

In Zambia we have a constitution that is dificult to breach as is such a confused one.Any breacher easily finds a way in the same constitution to escape the breaching they’ve done.Ruling Zambia without a consitution would serve us much better than having a bunch of useless papers that play no purpose for the good of the citizens but is only there to suit the wishes of people in power.What good thing has parliament done in the last 2 decades?Police breach the constitution every minute, ” someone should only be held up to 48hrs without charge,” says the thing you call constitution,yet suspects stay weeks and are beaten to submission.Police don’t look for evidence,they panel beat suspects for the evidence.The constitution pays a blind eye to gross human rights abuses.

  68. Is the Calibre of People Seeking to Rule in Doubt?

    IT is clear that the so-called impeachment motion some members of the opposition Patriotic Front (PF) and United Party for National Development (UPND) want to move in Parliament has no backing from a cross section of Members of Parliament within their ranks.

    Today, Luapula MP Peter Machungwa, representing 18 MPs dubbed ‘rebels’ by their party because they are attending the National Constitutional Conference, is categorical in stating that he and his colleagues will not support the motion.

    Some UPND MPs have also expressed misgivings over the matter and are obviously not in favour of the move. Dr Machungwa’s reason for condemning the impeachment manoeuvres is that the president has not violated the Constitution.

  69. Article 37 of the Constitution stipulates the conditions under which an impeachment motion could be instituted against a president if the office holder had violated the Constitution.

    So far, the opposition MPs championing the move have failed to state their reasons apart from saying the president had violated the Constitution. But which parts of the Constitution has the president violated?

    Their failure to pinpoint the violations leaves one to conclude that their machinations are misguided if not frivolous. An impeachment motion can be instituted through a notice given to the Speaker in writing and signed by at least one-third of Parliament, representing 53 MPs.

    Simple mathematics will show that the PF only has 22 MPs not in the so-called ‘rebel camp’ plus the 22 for the UPND,…

  70. But even among the 44 MPs from both the PF and UPND, there are some who have not come out in the open that they do not support the calls for impeachment. One therefore wonders why they are insisting on this debate even when it is clear that it is a non-starter.

    Should this country be embroiled in such cheap politicking at the expense of serious issues affecting the nation such as the global economic crisis? The insistence by some opposition members from the PF and UPND to push a theory that the country is in a crisis warranting impeachment of the president makes us doubt the calibre of people seeking to rule us at any cost.

President RB Banda has lied again according to th POST which reported ““I thank my party MMD for being the national party, what they are, that in the last election they proved that they are a party for everyone in this country because my candidature proved wherever I stood because I stood in all 150 constituencies. I was either number one or number two. We were seven of us, I was never number three in any constituency, Your Majesty.” for there only 4 presidential candidates in the 2008 by-election namely: HH, Sata, B. Gen. Miyanda and President RB Banda. Incapacitation? _

  75. Why does LT and government run media persist in perpetuating the fiction that these 18 individuals are PF MPs? To the best of my knowledge, these guys were expelled from the PF and are just hanging on to their positions because of an indeterminate injunction they managed to get from our less than independent courts of law. During the last Presidential bye- elections, most of them vigorously campaigned for the MMD Presidential candidate. And these are the people being referred to as PF MPs!! Just how different is our perception of reality?

  76. #88 -Surely the issue in regard to the topic we are discussing is about numbers? Whether they are PF or rebel PF MPs or MMD plants is of no relevance as Satana and crown prince HH will not be able to get the numbers of MPs they require in order to move this thing forward. Perhaps now they can try and come up with credible policies and choose a leader for the fight in 2011 instead of wasting their time on this farce?
