A three member High Court Judge Panel has begun hearing an appeal case for former republican President Dr Fredrick Chiluba’s Wife Regina following her conviction last year by a magistrate court for receiving property believed to have been stolen.
Mrs Chiluba was convicted on 3rd March 2009 on four counts and acquitted on one charge and sentenced to three years six months simple imprisonment by Magistrate Charles Kafunda.
In the first count Mrs Chiluba on dates unknown but between 16th of December 2002 and 3rd September 2007 had failed to account for property on stand number NDO/14 worth 80,000 thousand US dollars.
In the second and third counts Mrs Chiluba is alleged to have failed to account for property stand number KIT/ 643 worth 48, 000 US dollars and KIT/645 worth 60,000 US dollars in Kitwe respectively.
The property was suspected to have been stolen or unlawfully acquired contrary to section 319 of subsection A of the penal code.
In her appeal lawyer Robert Simeza of Simeza and Sangwa Associates said that the magistrate court ought to have had in place evidence that Mrs Chiluba had possessed the property in question.
He also argued that the court did not act in proportionate with the appellant’s station in life before having suspected her of having acquired the property in question illegally.
The defence also argued that the Magistrate did not prove that Mrs Chiluba had failed to account for the property.
The judges hearing the appeal are Judge Evans Hamaundu,Catherine ,Makungu and Eddie Sikazwe.

hope these judges will not be interfered by george kunda. please you guys do you best, let mrs regina mwanza explain how she made all that money, what kind of business she did and prove that she paid the taxes on all that cash. from the look of things, she may be the riches person in Zambia. can you please jail that woman and get that money from the bank to ministry of education.
I dont know how chiluba sleeps,he is called a thief and all sorts of names everyday and there’s nothing he can do about,he cant sue anyone for fear of opening a pandoras box,he is now even being booed by marketeers.he could have just stayed quietely and enjoyed his retirement,having fun with grandchildren and just chilling,but hey,the man’s got a thick skin.

I wonder how many lives the stolen money could have saved. Regina must explain how she made all that money in five years. Even magic has failed to reach that figure. I wanna know how she started a business and how the money was multiplied. FACT: FTJ will be very quiet during this period and will only speak when judgment is made in her favor. Regina is a convict and she must be treated like one.

Jezebel Regina Chiluba, belongs behind bars; that`s her correct residence. However, the stakes have never been higher for allah-bee. With elections around the corner and his looming loss, he would do anything to appease the self proclaimed master dribbler; Kafupi kaluba kapuba kawalala in the hope that him and his cohorts such as VJ would be able to conjure up something through their magic wand and turn his lost into a victory. This court thing for Regina is well choreographed and the results should not come as a surprise to all and sundry. Zed twa sebana!
Just set the ‘poor’ woman free. You sheilded the real thief. How can she be accused of receiving stolen property from a thief that never stole. We now understand why the appeal was delay until after the thief was acquitted. Get the picture?
RB is brought in again. What an insult to these eminent and learned men & women of the bench! It is sad to see lawyers like Ndulo & Habasonde discrediting the very legal system that they helped found! These people were not appointed by RB. Among the pusine judges RB appointed is Matibini, who is Nchito’s partner & Mmembe’s friend. How can RB be corrupt?
By simple logic Dr Chiluba was acquited by a Zambian court so Regina did not receive stolen goods. The London judgement is not registered in Zambia, so it does not exist as evidence. Simply put, Regina walks. Please don’t blame the judges, blame the prosecution that failed to prove beyond reasonable doubt that Chiluba stole. Prof Ndulo is an academic, not a practising Zambian lawyer. He is not infallible. Usually, academics are windbags! Those who can do, those who can’t, teach! How true!
