Tearing a copy of the Draft Constitution in public is an insult—NCC

THE National Constitutional Conference (NCC) has said the conduct of Patriotic Front (PF) deputy national secretary Samuel Mukupa to tear the Draft Constitution at a political rally is an insult to the many Zambians who have made submissions including Parliament.

And Mwense Patriotic Front (PF) Member of Parliament Jacob Chongo has said Mr Mukupa’s behaviour is also an insult to the United Party for National Development (UPND) their sister partner in the pact.

NCC spokesperson Mwangala Zaloumis said in an interview yesterday that it was wrong for the PF to politicise the cnstitution-making process.

“Zambians have been making submissions to the Draft Constitution and huge resources have been spent on this very important document therefore it would be wrong for people to politicise the process,” he said.

Ms Zaloumis said if people are opposed to the NCC process, they should not resort to politicising the constitution making process.

She said the NCC was a creation of the National Assembly and that it was wrong for a member of the PF to conduct himself when parliamentarians from the party were party to the creation of the Act.

“PF members of Parliament were there when the NCC Act was created,” she said.

NCC chairperson Chifumu Banda refused to comment about Mr Mukupa’s behaviour because he had so much work to do.

“We have so much work to do because we have received a lot of submissions which Zambians have made, so I will not waste my time to comment on that behaviour,” he said.

In a separate interview, Mr Chongo wondered how the PF and UPND would work together when they had such fundamental differences.

“That act by Mr Mukupa by itself is rubbishing all Zambians that have participated in the process including the UPND. They are telling the UPND that they do not think now just imagine how can these two parties work together. Are these really credible people that can form government?,” he said.

“Do you have to go to such an extent if you do not agree with something? I think there are more civil ways that people can show disagreement.”

He said by this act the PF were also rubbishing the Mung’omba Constitutional Review Commission (CRC) that the party has been advocating for.

“I only hope Zambians will now realise that these are criminals who want to usurp power by inciting people,” he said.

The Mwense MP also condemned the PF cadres for blocking Vice President George Kunda’s motorcade in Ndola.

“Just imagine what Mr Sata would have done if it was him that was blocked?” he said.
Mr Mukupa on Monday tore the Draft Constitution at a rally addressed by PF leader Michael Sata and threw it to the public saying the document was only fit for marketeers to use as a wrapper for vegetables.

Just because you are enjoying doesn’t mean everyone can afford that same K 1,000. that same amount you are talking about, you can buy two from Zimbabwe or rather three from Botswana. The government has to make the environment conducive for anybody to afford the necessities which are now luxury because of bootlikers like you. Why will i buy tissue when i can buy pamela from the same amount. Its time we started thinking for our brothers in chibolya who have to buy water with the same K,1000 you think is affordable than wasting it on tissue which i can get from the NCC.

  9. He was right to tear up a doomed and moribound draft constitution. How many have we had and what has beent he benefits. FTJ changed the constinution from 50%+1 to be declared a presidential winner to 1st past the post after realising he could not get more than 50% vvotes in his 2nd term. So when you come up with a constitution to target individuals & serve you not to serve the country, you tear it up democratically. simple logic.

  10. I would have condemed Mukupa if he had torn the Mungonba Draft Constitution because it reflected the wishes of the people. But now you’re refering to the George Kunda doctored nonsensical booklet, not worth being refered to as a draft constitution (What is the difference between the Constitution we have now and this piece of rubbish). This is a worthless piece of paper and a shear waste of my resources. And yes I agree with #1, it’s a worthless piece of people less valuable than a tissue of paper.

Been someone representing the people of zambia, he was supposed to submit his views to the NCC or Parliament for amendments rather than what he did potraying a Bad Picture of PF as a whole.Look Mr. MP, its not that everything is bad or not good in the Draft Constitution, certain things are still good for your Children and relatives. Lets do things which wiil see to it that the PACT gains support from each and every zambian so that we can form Government come 2011.

Honestly, why do we always want to be partisan in everything we debate on instead of looking at issues objetively? The learned lawyer was just politicking by tearing the draft constitution.     All progressive Zambians including the churches mother body have condemned this SHINDA paper, which is a doctored document representing the views of the MMD government unlike the Mungomba Constitutional Review Commission recommendations.

  22. This is part of democracy. This paper has no law to protect it and by tearing it, its the same the way you can tear a SHINDA paper. What maters is who is tearing it. But the one who is tearing it has reasons different to you. Don’t start insulting each other over a paper which will not even bring food on the plates of our brothers and sisters at home. The man was right according to what he feels about the paper. And if you think this paper is sacred then its sacred to you and not to him. This paper had it been that its protected by the law, you would have heard how people who have rushed to arrest this man. But failure to do so tells you who are condemning this that actually this paper is equal in status to a SHINDA paper.

  25. Tearing up of documents which people think are oppressive is a long standing tradition. Unip tore up the paper on the Federation of Rhodesia and Nyasaland. MMD asked us to surrender our Unip Cards which they later destroyed,therefore who ever tore this discrinatory document was only excercising his/her rights.

  28. I have tried to make sense out of the whole debate about the tearing of the Draft constitution at a campaign rally. I would like to respect one thing about the PF MP; that he has shown us that he is not happy with what the NCC has done. He has the right to express his displesure. However, it is sad that he did it at a political rally; he should not have thought that all the people at the rally think or feel like him on this matter. Zambia is a demoractic country, in which people should not be forced to either support or oppose a particular idea. For example, does he think that everyone really wanted the draft document torn??

    I do not agree with alot of things in that constitution but I would not allow someone to make me think what I do not want to. What did he mean by tearing the doc??

If there were pipo who were un-happy, they also have a democratic right to be sad, however there is no report that said pipo were sad at the rally for his action up to now, no report and u know LT Pro-MMD, they could have reported.

  32. The draft constitution was a sheer waste of time and valuable resources. A lot of salient ideas and opinions which were assembled in Mung’omba Constitution were discarded. Things like bill of rights for our nation,50%+1 threshold. The draft constitution is just a method of hoodwinking the citizenry. It is so obnoxious and mind torturing. The original constitution was raped by the so called MMD thugs in the name of GK and rebel PF MPs. Those who are celebrating the draft constitution are in for a great shock. Both a c t s by PF (leader MC Sata in 2008 and appointed-by-MC-SATA-secretary-general deputy Mukupa) have shown some well-meaning Zambians that PF does not respect Zambian laws especially the current 1996 and the NCC Draft Consitution (since late President Mwanawasa referred to the NCC as LAW because it passed through an Act of our current Parliament).

    Thus, I urge the mighty UPND Team in the PF-UPND PACT never to allow PF to filed the 2011 PACT presidential candidate since PF may disregard a Vice-President from UPND if the PACT are to win the 2011 presidential elections under a PF person as 2011 PACT presidential candidate.

    PF has sadly shown from time to time that they have anarchy behaviour and I hope the RB Banda Administration will arrest Mukupa.

The NCC has so far spent K136 billion, yet they have discredited most of the submissions of ordinary Zambians made.   43. Let me just remind some bloggers the history behind this NCC conflict: Sata/PF were initially part of the NCC that sat down to agree on ways to adopt the new constitution. Some churches lead by the catholics & some NGOs did not agree with the politician driven constitutional making process and decided to boycott. Sata saw a political opportunity to exploit and decided to join the churches. That was the birth of the comflict. We expected those who opposed the constitutional making process to submit counter proposals, from outside, to influence the final outcome but unfortunately all what they have been doing is just oppose. In the end they will miss a golden opportunity to influence the outcome. Unfortunately due to the composition of parliament this process is unstoppable.

  44. Zambians have been taken for a ride for far too long. Scholars in political science have repeatedly said for a constitution to have legitimacey major stakeholders must be involved. In Zed our leaders don’t give a shit who jumps on the bandwagon because they can hire bodies to fill up the hall. All monies spent on these constitution reviews have gone to waste because even the current draft is a shit document. The day we vote in a good team that draft is headed for the waste bin. It is sad that resources can be wasted on such fruitless exercises when we have other pressing needs. We shall overcome.

As a right thinking Citizen of this Country,I can as well tear both the current Constitution and the draft because they are both ‘matuvi’.The Catholic Bishops have refused this so called draft Constitution,and many Civil Society groups have as well refused it BECAUSE IT DOESNT REFLECT THE Wishes of the people that were reflect the wishes of the Zambian people which were submitted in the Mung’omba and Mvunga draft constitution.Incase some people do not know,Mr.Chifumu Banda and Ms Mwangala Zoloumis’s law firms are not doing well,please go to Godfrey House and ask.So,are we not ashamed that our friends in Kenya were voting in a referendum to the new constitution when our own NCC is stealing K139Billion?. Come on Zambians,we are not foolish,we can do better than this.Stand up for this…

  49. What are the contentious issues in the draft constitution that have upset people so much? We should be debating such issues instead of rubbishing the all the document. We need each other, it should not be called an “MMD constitution”. It is well known fact that some parties, institutions and individuals boycotted the process simply because it was initiated by one Levy Patrick Mwanawasa (MHRIP). What this nincompoop did is shameful, remember “what goes up comes around”. You do not have the monopoly of wisdom and should therefore have supported the process. We are closely watching your conduct on national issues and we shall reciprocate when you form government.

The best way to stop this is not to condemn everything in the draft constitution but to pin point areas where we differ and offer counter proposals. Time is running out!!!

If Mukupa bought it with his own money, he has the right to do what he wants to do with it, even sell nshaba in it.   56. Even in the courts of law-the learned Mukupa has done nothing wrong against the state or the people of zambia. If so, it would be written elsewhere in the archives of law.   65. I am not surprised because these same pf guys do not have any document to guide them ( no constitution) what a party anyway. We are yet to see more when they come to power. Someone already prophesied that next year there will be change of government but people will realise that they made a mistake and thereafter thats when they will make a progressive change. This just shows how uncivil some of it’s members are including the leader. I really feel for journalists in our country, because they are yet to experience the worste in their lives with this coming change. In all documents you may not agree with certain articles but it does not mean you have to hate everything in it, learn to be civil pf guys we know your leader proved his uncivil manners on VOA.

Having read the comments above, I think chaps such as Mukupa have a considerable following among those who are quick to offer opinions and judgement without any understanding of the basic facts. Perhaps those who denounce the document so vehemently should suggest alternative avenues for specific sections that they disagree with. The entire document cannot be ‘rubbish’ as some have so eloquently described it, I presume having read it from cover to cover. As for those who protest that other drafts have not been adopted and therefore this draft should also be discarded, I would recommend an episode of Pink Panther to sharpen their arguments.   68. The constitution making process must not be mistaken as Law. I have seen the same constitution being used by MMD cadres for wrapping vitumbuwa in eastern province. why because cadres do not care about details but vitenges. Mukupa my mbuya is very gentle as for me I took it to the shredder and finally to the sewer line near somebody’s plot

  69. Viva Mukupa. Chifumu and Mwangala are just but zombies who should be taken to court and requested to repay the money “stolen” from the Zambians through this failed constitution making process.
