LAZ writes Attorney General over London judgment

The Law Association of Zambia LAZ has written to the Attorney General following the High Court’s decision to throw out the London court judgment against former President Fredrick Chiluba.

LAZ president Stephen Lungu said the association has written to the Attorney General to seek an audience with him to discuss further the court’s decision to throw out the London judgment.

Mr Lungu said the association is seeking an audience with the Attorney General to further understand the basis of the court’s decision.

Meanwhile Zambia Direct Democracy Movement (ZDDM) national coordinator, Edwin Sakala has described the fight against corruption under the defunct disbanded task force on corruption as fake and malicious.

Mr Sakala has further castigated those that are condemning the decision by the high court to throw out the London high court judgment against Dr Chiluba.

Mr Sakala said that it is not right to have allowed the former president to be tried outside the country and to register the foreign judgment in a Zambian court.

He said such as act has the potential to cause divisions in the country.

He added that that the decision to throw out the London high court judgment does not come as a surprise because Dr Chiluba was unjustly treated from the beginning.

Mr Sakala described those who were pushing for the registration of the judgment as hypocrites whose true intentions he says will be exposed.

On Friday last week High Court Judge Evans Hamaundu threw out the London High Court judgment against Dr Chiluba and his co-accused which found them liable of making the Zambia government lose US$46 million.

The Attorney General was seeking to have the judgment registered in the high court so that it could be effected against the former president and his co-accused.

  1. At least we have sober voices in Zambia! Levy made a very serious error that has and will have dented the Zambian judiciary for ever! Which country under the sun could have allowed what a vindictive lawyer president like him did? Thanks, Mr. Evans Hamaundu for looking at the law and not at what vindictive people loved to see! Mr. Edwin Sakala thanks too for being objective. Zambian stone throwers can ruin our country for good. Don’t listen to them!

  2. Why has LAZ written to the Attorney-General and not to the judiciary? Does the Attorney-General have a hand in writing judgements? From my layman’s point of view, this seems to be what is being implied. Or does LAZ just want the Attorney-General to appeal against the court’s decision? Will the lawyers out there please educate me?

  3. We await for the legal opinion and the answer LAZ will be given. This time LAZ has reacted quickly unlike that time Chiluba was aquitted ficticiously. We hope this case wont die down quickly, Zambians pantu tulaba bwangu. Chiluba wasted public resources, his wife is a jail bird due to haveing recieved stolen goods. So how do you deed him innocnet. Chiluba is a thief period. The problem is sometimes pipo use law to steal. Like the $20m arms purchase, the arms never recieved up to now. Zambia lost $20m. Zambia sucks thats why LT is giving me a flag that is not Zambian when I’m here, I need to migrate.

    Lawyers from all walks of life have emerged making a giant killing financially friom poor people,look at how many lawyers are facing disclipnery charges at LAZ.
    Judicially has become a joke,thought there was a petition to have Sakala removed from office by Simeza Sangwa Associates.
    Zarare’s wife was found guilty of recieving stolen Govt property,yet the person who stole was acquited,what kind of justicwe is this.LAZ under Lungu is very unimpressive

Former Attorney General Mumba Malila yesterday said High Court judge Evans Hamaundu’s decision to throw out an application by the state to register the London High Court judgment that found former president Frederick Chiluba and others liable for theft of about US $46 million public funds has amazed him.

  6. This move is very telling because it shows that the Attorney general has powers over the judges. Judges should be independent and never be answerable to anyone. This just exposes judges in Zambia have strings to as do puppets

  7. What does Stephen Lungu mean he wants the Attorney General to explain how the court arrived at the decision? Or was the article lost in translation from legal terminology to LT journalism?

  8. His seeking audiance with AG to ensure they appeal againist the high court ruling. This means they seat down analyse the ruling given , on the THE FOREIGN JUDGMENTS (RECIPROCAL
    ENFORCEMENT) ACT, CAP 76 OF THE LAWS OF ZAMBIA; given that this was a high court ruling. So please before you make noise wait.

  9. Please read the provinsions of the Foreign Judgetment ( reciprocal enforcement) ACT , CAP 76 of the Laws of Zambia you can google it. The arguments made by the state for not registering can be debated. The examples given by the Judge one account dealt with matrimonial issues of which the case in question wasnt. One also needs to look at various conventions and signatories that Zambia has entered into especially on money laundering and corruption. If by signing as a state we agreed to register any criminal activities thereof then the AG can put across his submiossions to the supreme court to argue out his case.

  10. Task Force Misappropriated K1 trillion-Audit report

    The latest Zambia Auditor-General’s report indicates that the Task Force on Corruption set up by Late presdent Levy Mwanawasa misappropriated in excess of One trillion Zambian Kwacha.

    Full details of the report will be published here in a few hours.

    Current president of Zambia Rupiah Banda is on record claiming that the lawyers who were attached to the dissolved Task Force on Corruption were paid US $13 million to prosecute former president Fredrick Chiluba over allegations that he stole US$500,000 public funds.There has been an outcry to have the Task Force audited.

    Check this space later for details of findings by the Auditor General.

  11. Why has this same LAZ not written to the DPP to ask them why that female minister who has a case like Hon. Mpombo not been taken to court? The judge in the Chiluba case has done a good thing the British can never in a million years do that to their former prime miniter like or not- well done judge and Chiluba enjoy your life for once.

  12. Cost of Vindictiveness saysaccording to the AG’s report theTask Force misappropriated ZMK1tn and there has been a public outcry to have TF audited. My question is has the TF been audited? Bcoz if there is a report from the AG’s office then it has been audited so why should there be public outcry? And London says the British can never do such a thing to their PM, I beg to differ if he were to dip his hands in the till they would go after the PM. People a thief is a thief whether former president or not. Look at what happens in Asia. Former presidents have gone in for corruption. Korea is a shining example. People, we are building a soceity that condones wrong doing. Very soon we will have presidents stealing knowing very well that nothing will happen to them.

  13. FTJ is a thief, he stole Regina from Eddie Mwanza. He used to give Regina colossal sums of money and this is as Far back as 1996. Let us not support people blindly. If you know people from ACC find out and you will be amazed at what FTJ did. There is a lot that is not in the public domain. Look at what has become of Government Procurement depts. The buyers are so crooked but how many of them have been convicted? We need to get rid of the nechekeleko syndrome for us to move forward. Ati rotten from the Head to the toes.

  14. Why didn’t the Attorney General withdraw the case if these loopholes were so obvious? It doesn’t make sense. I also don’t believe that Mwanawasa was just playing vindictiveness and wasting task payers’s money on a fruitless matter. He was a State Counsel and knew exactly what to do. The problem is that the rest of us who are stilol alive are too far behind to understand what the next step would have been for Levy, he knew exactly how he would have advised the Attorney General to do to win the registration. We are just tooi dumb to see that. Levy was just too sharp and too straight for the rest of us left behind. Let us just forget about the case and go to things we can easily understand. Don’t blame LPM just because we are too dumb to understand his actions!!!

  15. A bachelor of Laws degree is a shit degree especially in Zambian. Judges and lawyers are all *****s. Corrupt bastards. They all benefited from Chiluba’s plunder. One bunch of lawyers were on the side of Chiluba and his cronies while the other bunch was on the side of the Government chewing the task force money and today these are some of the richest bastards in Lusaka. They are the ones who are laughing the loudest and boasting to be very succesful. We know them all. All Maureen Mwanawasas classmates own their own law firms and got heavy business deals thru Maureen.

Forget all this nonsence and please do not ever trust the Zambian lawyers! Look at this differently, I am a network Engineer, look at Data VPN etc security and there is no way I will put my users at risk by connecting them to a foreign domain and later tell them that all the data has been stolen! This is the same thing the Zedian lawyers have done!!

LAZ is right to write to our AG because that’s where things went wrong.The high court judge said that the State tried to register the London judgement under “direct registration” instead of “common law” and the AG is the man who did that on behalf of the state.He blundered if what our high court judge said is correct!The AG and his chamber has a bunch of lawyers at his dispossal and among them SCs so how on earth can such a mistake be understood?George Kunda or Mumba Malila should explain how and why such a wrong move was made because one of them was our AG who undertook the registration issue.George handled the prosecution and secured a conviction which was good but how did things start going wrong from there?

The same MMD govt took the case to london ask George Kunda VP he was the Judiciary Minister and the same MMD govt RB & George Kunda REJECT the contents of Judge Smith ruling….so how noble is chiluba he used a Govt account as Head of State to bank personal funds he claims from well wishers when the country was under HIPIC ,so who is a criminal here???

I like mr Lungu’s smartness.Mr lungu is a qualified lawyer who understands law better.He knows very well that registering this case in zambia would not work.He knows that people in zambia are yapping too much and he decides to play it cool inorder to secure his job.He is wise.RB has could not follow this case because he noticed that what the task force earned was more than what chiluba stole.This chiluba case should end cause its just rising pressures as nothing is been done.

  28. Why are we all crying when we were told months ago that nothing would happen to Chiluba. Before judgement on the criminal cases, Mulongoti was on record saying it would be too expensive to jail Ka kafupi, so all cases involving kafupi will be wash out including Regina’s appeal. So my appeal to Zambians is to just work hard as individuals and make life better for ourselves otherwise yyou will just be depressed if you expect anything good from these devils called politicians
