Let London judgment go to Supreme Court-TIZ

Transparency International Zambia (TIZ) says the registration of the London Court judgment must go all the way to the Supreme Court.

TIZ executive director Goodwell Lungu in a statement released to QFM today says it is TIZ’s unwavering position that this is a matter of immense public interest which cannot be abandoned at this hurdle.

Last week High Court Judge Evans Hamaundu dismissed an application by the State to have the London Court judgment against former President Fredrick Chiluba and his co-accused in which they were found liable of defrauding the Zambia government of US$46 million registered.

Mr Lungu says it is unimaginable that the Attorney General can abandon the cause at this stage given the rather large judgment sum which should be recovered from the judgment debtors.

He says the Attorney General should pursue the registration of the London judgment to its logical conclusion.

Mr Lungu reminds that Zambian public that government has already used the same London High Court judgment to extract payments from defendants such as Atan Shansonga,Bimal Thaker,Cave Malik and their insurers in the United Kingdom and that properties in Belgium were recovered with a gross value of US$8 million in a claim against four European defendants on the same allegations against Dr Chiluba and others.

He adds that as far as TIZ is concerned, the finding against Dr Chiluba and his co-accused by the London Court remain valid, and that the ball is back in the court of the Attorney General and the Zambian Government.

Zambia is a sovereign constitutional state and not an extension of the so called TIZ.   3. It’s now very clear that RB owes chiluba something VERY BIG. It is very likely that chiluba connived with RB when he was VP and came up with a plan to assassinate Mwanawasa. This would allow RB take over the presidency and in turn set chiluba free as pay back. Chiluba knew very well that with Mwnawasa at the helm, he would surely go to jail. The biggest mistake Levy made was to appoint this shameless corrupt opportunist, RB, as VP. That was indeed a costly blunder that cost him his life. RB in tandem with George orchestrated the meanest move against their appointing authority, Levy, and sold him off at the alter of expediency. RB, George and Chiluba truly have blood on their hands!!

The fight is neither there nor here. Let Banda abuse all the resources like the way Chiluba did.   6. Under article 79(7) of the Zambian Constitution, Parliament “may make laws with retrospective effect”. If there was ever an appropriate case to do so, this is the one. Make the law, after all, it will only be dealing with procedure. The fact that the money was stolen is not in dispute.

    Mr TIZ Lungu, please go and recover the rest of the money in Europe, here the law says that the judgement cannot be registered, simple and straight forward. There is nothing to appeal, you just want to enrich your lawyer friends so that you continue getting commissions? Sorry, RB has wiped your pots dry and it’s now time to build roads, schools, ooh and buy mobile hospitals.

    But Mr TIZ Lungu, if you have recovered $8million in Europe, you have a balance of $38million. The bulk of that money, if at all it exists, must still be in Europe and can be recovered by the London judgment. Very little of that can be in Zambia. Logic demands that you go recover the money in Europe, doesn’t make sense otherwise. How can registering the judgment in Zambia help you to recover the money which is in Europe? This goes to show that you mint gold here in Zambia by sponsoring these court cases and making noises for your masters.

  23. I have not blogged for a long time but this issue calls for my word. It will not matter were you appeal to, wether to supreme court or to God, the star witness to this case is long dead. And the other that is still living will not talk because of the fear of bieng implicated. Ronald Mpenza was the one that engineered the whole thing and even dribbled Chiluba, the other person is Nawakwi who was dribbled by Chiluba. The other two guys you may ask , that is if they can talk , are Ngandu Magande and Samuel Musonda. Friday Ndhlovu may know something. If the post are clever , then let them follow the lead.

Nowhere has it been said in trial or Chiluba himself that Sata was involved or he stole with him. So Sata was not aware and believed that Chuiluba was innoconcent until Levy revealed to him. Period.   38. I think the fight against corruption should be revisited. Objectives reset and strategies be outlined. Not the Levy fight against corruption focused only on certain individuals while others are left scot free like Mabenga.
    This has just been a circus and a waste of money. The Nchitos are now rich thanks to Levy
