Nchito’s engagement by Taskforce was irregular — AG

THE latest report of the Auditor General on 21 parastatal institutions has revealed financial irregularities at the dissolved Task Force on Corruption in which Lusaka lawyer Mutembo Nchito’s firm was one of the legal firms engaged irregularly and benefited from K1.8 billion in legal fees.

MNB Legal Practitioners and other laws firms were paid US$20,000 every month whether there was work done or not and there was no justification for the fixed amounts.

The total amount paid to three local firms is more than K1.8 billion ($375,333.33). Other law firms that were paid similar amounts under the same terms were Zulu and Company, Sambo Kayukwa and Company and Mundia and Company.

One foreign company DLA Piper Rudnick was paid $1.3 million in the same period. The companies were paid money whether there was work done in any month or not.

Meanwhile, THE Auditor General’s Report for 2008 on parastatals has revealed that about K4.5 billion was paid out to 20 officers who did not have existing contracts of employment with the University Teaching Hospital (UTH).

The Auditor General’s report states that the amount was paid out to the officers as salaries, gratuity, housing allowance and accumulated leave days.

Upon verification however, the Auditor General discovered that the payments were irregular in that none of the payees had contracts of employment with UTH

The report has also revealed that as at December 2008, the hospital owed staff amounts totalling K26 billion in leave travel benefits, salaries and terminal benefits, gratuity, long service bonuses and settling in allowances.

According to the hospital’s financial statements, statutory contributions amounting to more than K1 billion were not remitted to respective institutions such as the Zambia State Insurance Corporation, Zambia Revenue Authority (ZRA) and National Pensions Scheme Authority (NAPSA).

And the Auditor General has revealed that except for 2003 and 2001 when profits of K8.8 billion and K17.1 billion were recorded, Zambia railways Limited (ZRL) recorded losses in all the other years under review.
“As of December 2008, the losses had accumulated to about K148.6 billion,” the report reads.

The report revealed that the working capital position of ZRL worsened from a deficit of about K28 billion in 2002 to a deficit of K75.8 billion in 2008 thereby exposing the company to the risk of insolvency.

A scrutiny of the concession agreement with railway Systems of Zambia (RSZ) revealed that apart from the US $3.5 million in the investment plan for rolling stock, there was nothing to compel the concessionaire to invest more in the 20 year lifespan of the agreement.

  1. No one and mean no one is honest in Zambia = Zambia decay! People are super inefficient, corruption everywhere, no time management, no resource management, the president is always on the move, name it!

  2. Mutembo Nchito and Muchima Nchito must be arrested together with Mark Chona, Brig.Gen Hakamangwe and Mark Chona’s son. They must explain why in the name of fighting corruption they looted the national treasury instead. These thieves have been the loudest mouths in this coun try yet they were just thieves!!!!

And this is not all a lot more will be revealed and then you will see the evil that was done during his reign. Even Maureen won’t escape, she thinks she is very smart with membe who has been shielding her and Levy under praises to blind the people from seeing what was happening. Maireen has stallen a lot of money since she was in control, what with her husband being a cabbage

  4. I am fagigued by these dangerous revelations that go nowhere. Could you professional people really put me in the light about an audit report. What is the purpose? In Zed it appears to be an exercise to just show functionality. We will get more reports next year, year after next, right up to 2030 and nothing will come out of these things to curb these excesses…

    Or am I being too pessimistic?

  5. I am fatigued by these dangerous revelations that go nowhere. Could you professional people really put me in the light about an audit report. What is the purpose? In Zed it appears to be an exercise to just show functionality. We will get more reports next year, year after next, right up to 2030 and nothing will come out of these things to curb these excesses…

  6. #5/6 above, the audit reports are published and acted on only on Opponents of the brutal ruling MMD regime in Zambia. They use them for settling old scores or to discredit those challenging or affecting the clique ruling, whether you are dead or alive. Be on their side like Mulongoti, despite irregularities in the Road sector where Donors even smelt a rat, Nothing is done to such corrupt individuals.

  7. When Kafupi picked on Nchito I knew the kamafellow had his foot on a stone. Now the guys are on Nchito just to make sure that the fight on corruption is really a bygone. This is sickening. Year in year out we are witch hunting and we seem not to find the real witches. I think the politicians are taking us for a ride and we shall never reach our destination. This is proper recipe for Bwezani to form a task force to investigate the task force on corruption formed by the late president. And Bwezani is very ready to do that and create some katemba for his parasites!

Yaba…….who scrutinises this reports? how many irregularities have been mentioned in previous reports and what has been done about them.. its annoying even reading this irregularities when you know nothing shall be done..its only in Zambia such rubbish happens and nothing is done..TWANAKA NENU BAKELENKA…..NALEKA!!!

This is ‘holy grail’ in Chiluba’s eyes, but wait a minute… Now that Mwanawasa is dead, the legal advisor to the LPM government, Hon George Kunda is still around, can he be made answerable for this? He ran around prosecuting Chiluba in London and even protecting the Nchitos then. Didn’t he know this was all wrong? He surely saw the contracts of payment and approved them. He is also liable full time. If he tells us that he was just following orders then he is not worthy of holding the position he has now. He is a very big liability to this country – he looks both ways. Let the game begin.

  10. It is very difficult to understand what is going on in Zambia, surely is it possible that it has taken us more 5 years to know that these lawyers where being paid even for doing nothing.

When i last wrote here on who has enjoyed money from the task force i was insulted that i was writing from out side Zambia when i said Max Nkole was taking it too personal with Chiluba people called me names on this site i’m a criminal psychologist highly trained in England, you tell us those of you who insulted President Banda when he said some lawyers have made money of the task force, i do not live in Zambia myself but is up to you people who pay tax there to stand up and make those Lawyers pay back that money.

  13. Sorry to say but the late Levy made a mess out of the Chiluba case and gained credit out of it for himself there is alot about this issue that you people will never know RB knows alot he has the files this was Levy’s personal war with Chiluba like it or not.

  15. The MMD, George Kunda in particular should explain their role in the formation of the Task Force. Doe it mean all the cases that were handled by the Task Force are being thrown out by the courts because of the blunders that were committed by George Kunda and his robbots?

  17. The framing of this headline seems to suggest that the Nchitos and the other lawyers helped themselves on state coffers. This is wrong. It is the controlling officer who should be answerable, in this case, George Kunda. And the report is rather vague. What was irregular about the contract, and what were the payment terms?

    This is yellow journalism at its worst!

  19. Chiluba plundered …and so did levy… and RB is doing the same…. Remove RB from office and the same stories will surface… our country stinks of corruption…

  20. It’s now very clear that RB owes chiluba something VERY BIG. It is very likely that chiluba connived with RB when he was VP and came up with a plan to assassinate Mwanawasa. This would allow RB take over the presidency and in turn set chiluba free as pay back. Chiluba knew very well that with Mwnawasa at the helm, he would surely go to jail. The biggest mistake Levy made was to appoint this shameless corrupt opportunist, RB, as VP. That was indeed a costly blunder that cost him his life. RB in tandem with George orchestrated the meanest move against their appointing authority, Levy, and sold him off at the alter of expediency. RB, George and Chiluba truly have blood on their hands!!

  22. Why do these reports come this late? It’s of no use discussing history. I often wonder whether it’s ethical or normal accounting procedure in Zambia to delay these Audit Reports. In any case, the report has just confirmed that Mwanawasa was not really an angel.

  23. It’s apparent that the Auditor General’s office is equally full of irregularities just like every GRZ wing. The evidence is on the wall.

  24. Levy and Umukashi got a lot of money which you guys aren’t aware of! When he was sick, she got a tonne of it! Persecuting Chiluba for years came to an end because God sees!!!

Before you start jumping all over Nchito you guys think of it this way.Over 10 million dollars was spent on these cases and 9.7million got spent on London Lawyers who failed to convict Chiluba on any criminal offence. And now you are busy jumping on Mutembo who managed to get the those generals, Richard Sakala and the other criminals behind bars for a 375,000 dollars? He did not even get a million out of this! And if you go back far enough, you will remember that Mutembo was prosecuting the cases for free at the beginning and when he decided to withdraw, Levy pleaded with him because the public was behind this fight. In Zambia you would rather kill your own brother for 1 ngwee and let foreigners run off with millions! Shameful!!

  26. I see this as a projected speech. I can see where its leading to. In short RB will justify Kunda’s dismissal. Kunda must be held accountable, this should extend to Max Nkole, Chona etc. Mmembe too is a culprit he used his tabloid to mislead the law.

The problem in our largely miserable republic is that cases take so long that before thieves like Kafupi go to jail, there are personnel changes and the new people wind up having different motives to stop the prosecutions. Also, the people being prosecuted have enough time to penetrate the system.

    Then Kafupi has the audacity to say “I have been vindicated” when it is clear he stole. There is just a techniccality of registering the judgement.

    Don’t blame the lawyers. When a retainer is given, that is the way it works. You pay per month. If you do not give work, that is your own indaba. Anyway, what did the Task Force care: They were getting their cut. With nichekeleko, everyting is possible.
