James Banda sues George Mpombo for libel over arms deal allegations

PRESIDENT Banda’s son James has sued Kafulafutamember of Parliament George Mpombo for libel over the latter’s allegations that he was involved in the procurement of arms worth US$100 million from South Africa.

Mr Banda says Mr Mpombo’s allegation has injured his credibility and reputation and brought him into public scandal, ridicule, odium and contempt.

“The said words in their natural and ordinary meaning meant and were intended to mean by innuendo that the plaintiff is acquiring wealth corruptly, illegally and by abuse of Government. The words further meant that the plaintiff is dishonest, a thief and has illegally attained his wealth through undue influence as he is the son of the President,” Mr Banda said in his statement of claim filed in the Lusaka High Court.

He is claiming damages for libel contained in The Post newspaper edition of April 19, 2011 where the outspoken former Minister of Defence claimed that he left Government because he did not agree with President Banda’s decision to award an arms supply deal to James Banda’s allies based in South Africa.

He is also seeking an injunction to restrain Mr Mpombo, his servants or agents from publishing the said words or other similar words.

He is further claiming damages or footing of aggravated or exemplary damages and any other relief the court may deem fit.

Mr Banda said he is a prominent businessman with various business dealings with local, regional and overseas organisations through various companies which are duly incorporated pursuant to provisions of the Companies Act Chapter 388 of the Laws of Zambia.

He said he is neither a civil servant nor a politician but the President’s son.

Mr Banda said on April 17, 2011 Mr Mpombo appeared on Muvi Television and gave an interview where he maliciously issued a false, disparaging, and defamatory statement concerning his reputation and business.

He said on April 19, 2011 Mr Mpombo again falsely and maliciously uttered the same words in The Post, alleging that had the arms deal gone through, Mr Banda would have received 10 percent of the total transaction value as a kickback.

  3. This (I think) is a good and mature decision mr Banda, it gives an opportunity to Mr Mpombo to prove his allegations against u and Mr Rupia Banda (farmer, Msc). The only problem is our courts are badly compromised, I wonder if mr Mpombo would get a fair justice on this one.

People, Mpombo never said the deal went through, he said the president wanted to use his sons to buy the arms in question but when RB realised not everyone was on his side, the whole issued was cancelled. So this man’s (banda) case has no basis (i think coz am not a lawyer). The case that is there is ‘attempted corruption’ if such a case exists. 
    So Mr James Banda you are suing Mpombo for something he didnt say about you.

  5. Mpombo has an opportunity to reveal everything. Even those servicemen he went with must come out and speak out honestly.

    James can use the father’s courts that acquitted a corrupt Kafupi to get at Mpombo, but this year is a year like no other, suing Mpombo could prove costly to his father’s political fortunes.

If Mpombo, correctly described by Sata as ‘Impombo’ is found wanting, he should pay all damages so that he is licked clean.   17. Mpombo has really done it this time. Why create lies just to discredit RB? Is it because he promised you presidency after his 3 year term and now he has changed his mind? If so, better you talk about what you can do and not what you think people have done. Mpombo should concentrate on marketing himself to the people instead of scandalising his self created enemies. If you are MMD, you somehow forfeit your right to seek redress in court and that is why it is perfectly fine for Satanzania to have God knows how many cases in court but an anathema for James to seek justice.

Finally a man with sense let Mupombo go and make his allegations real..and for those saying James has no reputation, each one of us has a reputation to protect…He has every right to seek court protection and the injunction will be in place until the court matter is held..now mUpombo has 10 million kwacha bounced cheque pending, libel case and ofocourse the forgery case at the Ministry and this is from a man who held the 3rd most powerful position in the land and often acted as president under LPM…..Good luck to him as he wriggles out of the web he has span for himself…

  27. Chiluba is a thief case is a good example of what can come out of this court case. Remember the Post regard Mpombo as a good source of information and James Banda is attracting problems by sueing Mpombo. He is know for dirty deeds and thats how chiluba put himself in trouble and ruined his reputation. In such court cases Mpombo will bring out all the dirty dealings James is associated with and that will compell more people to tell us what this little man James Banda has done…This is a 2 edged sword that can bring goodness and sadness on James and Mpombo

  31. Believe 3/4 of people who make allegations against others have no evidence. All they might have are suspicions and a bit of the story but no facts. Iam more than certain this could be the same with Mpombo. Its like me making an accusation that the accountant in the Ministry is a thief. I may suspect because of his life styles that are far beyond his salary but as I have no evidence I shouldnt go round telling people the guy stole. These stories should be restricted to the pub.   34. Well, now that James has decided to sue Mpombo has the right and opportunity to subpoena records from relevant Ministries to back up his allegations. Watch them Defence personnel who accompanied him to RSA on orders from RB be forced to tell what they know under oath!

    James rightly says he is NOT a civil servant or a govt official, but one wonders why he is always at the center of govt procurement deals—-ain’t that suspicious?

    Chiluba sued in similar circumstances, and guess who ended up with a case to answer, Yes, the THIEF, Chiluba! I hope James is clean, otherwise he may just bringing himself some unwanted scrutiny and trouble. Nonetheless, it is his right to sue. I hope he is not trying to use the courts to shut people up because these things have a way of boomeranging.

  38. People who are saying Mpombo does not have evidence should realise that Mpombo can not reveal secret documents/evidence on TV or radio. But believe you me, records are there to back him up, or contradict what he has alleged. And the court is the right venue for such info to come out.

    Mind you, we are talking about military issues here and, by nature, such things are usually classified. Only a Judge can order/subpoena such records to ensure a fair trial. So records will show whether Mpombo indeed travelled to RSA, on what date, with whom, and for what? And Cabinet Ministers cannot just travel outside the country without the knowledge of the President, especially on govt business. So let the evidence come out in court before we starting celebrating the demise of Mr. Mpombo.

    Mpombo is just a disgruntled fellow who feels he deserved a more prominent position than was given him. Hatred and resentment never won any battle, my advice to him.

If he has good lawyers, they would advise Mr. Mpombo to settle outside court and issue a retraction on all the allegations he made against Mr. J Banda. If he maintains magician lawyer Mr. Wynter Kabimba who might advise him to go ahead with the case, then he is finished.

Leave the big man alone please he needs to concentrate on how to recontest kafulafuta , and under which party, now dragging him to court over things which you know very well that you got involved, will make him disqualfied because he has court cases.   58. Bringing a case of libel can very badly backfire. A smart lawyer can question Mr Banda on his wealth and how he got it. How much is he worth? How much was he worth before his father became president? Has he tendered for any government contracts, and how many has he won and lost? Has he ever had help from his father in pursuit of business contracts? All such questions are relevant in such a case to establish his business reputation that he claims to have. It can very easily backfire unless he has had no backing from his father!

    • No, I am not making such an assumption. look at my last statement. The point is that all those questions can be asked and he would have to answer them. If his wealth has increased substantially after his father became president, the the court of public opinion can reach a different conclusion from the legal courts; just pointing out why caution is advised in such cases.

  76. Mpombo might not have evidence on the James Banda involvement, remember James called Mpombo to see how things were moving with regards to the deal. What was his involvement for him to call on Military procurements? If they ask Mpombo about the trips, simple, there is that word called SUBPOENA, a writ commanding a person designated in it to appear or bring forward the documents to court under a penalty for failure. He can subpoena these documents from the MoD. The tickets and hotel bookings and meetings in SA cannot be classified documents, unless the courts, which we know are problematic of late decided to play politics as they usually do. The phone company will prove this chap JB as a conman who made the call on the said day to inquire about the deal.

You would not have the ‘prophetic balls’ to tell of Rbishs’ thieving clique like Mpombo did! Mpombo was actually wishing for this, so that he can allow the whole dirty sordid failed deal unveiled. James Banda may be intelligent, but he is definately not Mr. Clean, as was established during the RP Capital saga and he had his father oblige him this ‘once in a lifetime mega bucks deal’! James was the main MAN in the contracting of RP CAPITAL to reevaluate ZAMTEL for the purpose of disposing off most of the public shares to a foreign governments ownership, i.e. LAPGREEN! Mpombo should have the SA officials they meet summoned!

To me if the courts actually prove that Mpombo is right then it is a good thing for Zambia on two fronts – if indeed James and his father are corrupt then we shall definitely know about it instead of basing our opinions on rumours and innuendos and perhaps more importantly it will put pay to the notion that the Zambian judiciary is corrupt. So as far as am concerned, the ordinary people of Zambia are in a win-win situation.

  79. James is not and has never been a small boy. He has had big bucks from way back. These are the boys who used to hang out with premiership footballers such as John Fashanu. In fact John Fashanu came to Zambia to visit them. Its not easy to mix with such people who earn over 50k pounds a week if you are a pauper. Attack RB, he is the politician and leave James out of it. Probably you can answer for him, why did he call the Minister about the arms deal? In what capacity and on whose behalf did he do that? What interest does/did he have to know when the MoD is going to seal the deal?

  82. Mpombo knows what he is talking about, he has just revealed more of how James joined a government delegation on an oil trip deal to SA when he was not civil servant. Mpombo has also revealed that the president pressed on him to ”thandizani mwana wanu James”. Let the court case begin and we shall see who will be disgraced and exposed at the end. We are anxiously waiting.

  84. How can a thief sue a thief. This is where Human rights have compromised humanity. I hate Human right. These were simply made to protect the elite and those in power. All these guys should be sentenced to death by poisoning them with gas, the world will be a better place. Hold on a minute, put me in power and I will do the same, if not twice as much damage!
