Post Newspaper defies court order

The Post Newspaper has defied the High Court injunction on Wednesday not to publish speculative stories on election results for the 2011 polls.

The paper has carried another Headline, speculating that Patriotic Front leader Michael “SATA LEADING WITH 59%” quoting party Secretary General Wynter Kabimba.

This is despite an injuction restraining the paper and two other private television stations from publishing elections results before they are announced by the Electoral Commission of Zambia.

The Newspaper has carried another article “Sata headed for a win if polls are not rigged”, which quotes a Mr Sishuwa.

It has further carried another article accusing the Electoral Commission of Zambia of employing calculated malpractices to favour incumbent president Rupiah Banda, entitled “ECZ is using delaying tactics to secure victory for MMD” which quotes the Alliance for Democracy and Development leader Charles Milupi.

It has further speculated and published another article that the “ECZ website puts Sata in lead with 140 000 votes after counting 133 Constituencies”.

But this is contrary to ECZ Chairperson Justice Mambilima’s clarification Wednesday night that the commission’s website had been hacked into, and has since been pulled down while investigations had been instituted.

Giving the last election results update Wednesday evening, Justice Mambilima also said results from 70 Constituencies had been received out of which only 33 had been verified and validly announced.

Justice Mambilima said the other results were still being verified and the next update would be made today Thursday.

She also said the Commission was happy that the results had begun to steadily roll in and all results would be announced within reasonable time.

In her update to the nation, Justice Mambilima announced the presidential results for only 33 constituencies, which showed Mr Sata with 265, 843 votes, standing at 46.59 percent, while President Rupiah Banda had 192, 966 votes, representing 33.82 percent.

The UPND’s Hakainde Hichilema had 93, 645 votes representing 16.41 percent.

But the Post Newspaper has gone ahead to publish speculative stories which Justice Mambilima had clarified in her briefing to the nation on ZNBC Television Wednesday evening.

And in granting the Exparte Injunction on Wednesday, High Court Judge Jane Kabuka said ordered and directed that “the defendants whether by themselves, servants, agents or whomsoever be and are hereby restrained from printing, publishing, running or carrying speculative stories on the tripartite election results held on 20th September, 2011 and subsequent dates and further from printing, or publishing or announcing election results before official results have been made by the electoral commission of Zambia.”

Judge Kabuka further ordered that “if you the within mentioned respondents whether by yourselves, servants, agent or otherwise howsoever disobey this order you shall be liable to contempt of court and shall therefore be committed to prison.”

Attorney General Abyudi Shonga filed in the petition to the restrain the Post Newspapers, Muvi Television, and Mobi International Limited from publishing speculative stories on results of the 2011 tripartite elections.

This followed the three media houses’ consistent announcement and broadcast of speculative stories.

The Three private media institutions have also been restrained from announcing election results before official results have been announced by the Electoral Commission of Zambia.

    • I only hope and pray that the media will be magnamious enough not to incite the people. As a Kenyan i know what irresponsible media can do in such a critical moment. Please give ECZ the opportunity to carry out its mandate.

    • with holding of results is what will bring chaos. Go to the ECZ site, there is no info. Right now we can conclude there is a media black out. ECZ cannot be serious that they have only counted 33 constituencies out of 150 up till now. Its not about PF, MMD or UPND..it’s about transparency and freedom of expression, freedom to information. It is not possible that only 33 constituencies have been counted..let them be honest

  2. It is not necessary to raise the tension. ECZ should quickly announce the final election results to avoid any escalation of acts of violence. It is obvious that Sata has won. I personally do not subscribe to this man but I am not Zambia, just Zambian.

    They are hoping that by delaying that bit longer, the people will become disinterested in the results and accept whatever they will be told.

  13. The next ECZ briefing is at 12hrs instead of 08.00hrs. The results in the constituencies are not A STATE SECRET. They have been PUBLICLY announced by returning officers and the parties have this info. The whole issue of waiting for so called “verified results” is moot. Nobody should prosecute you for collating and publishing results announced by returning officers in constituencies.

  15. We are entitled to alternative information (speculative or not) other than that provided by ECZ. The stifling of the private media while withholding information will not help those in authority but aggravate the already suspicious situation into a potentially volatile one.
    We all know that MMD would prefer to have a volatile situation and then use it as an excuse to declare a state of emergency, possibly cancel the release of results indefinitely and eventually nullify all poll results.
    Be warned that Zambians are ready for all this nonsense should rupiah decide to set Zambia on fire that he will be held accountable for any trouble

Can’t you be patient people.It takes time to compile thousands of results from all over the country.Party representatives are there,monitors are there and the results so far show the obvious.PF is leading in PF strong holds,MMD is leading in MMD strong holds,UPND is leading in Southern province so where is the rigging? This is treasonable and people responsible for this should be made accountable for the possible consequencies of their actions.   25. I see the Ivory Coast situation coming. And may be that is what Zambia needs at this point in time. After people have been hacked to death and stabbed and shot at, they will then realise that it does not pay. Meanwhile the leaders will be clean living in their mansions abroad. I think Zambia needs a bit of killing each other and may be eventual splitting up. Increasingly it is becoming evident that our provinces represent very different people that will never really sit and work together without problems.

Am concerned about wats going on in zed, i was in Zambia in august after 7 years away & the impression i got was that the MMD was going to win comfortably after talking to ordinary people from lstone, Ndola, CBU, and Lusaka.     The people have the right to be informed and that is what The Post is doing. Any news can appear to be “speculative” if accurate information is not available. This is the second day of counting roughly 5 million votes and ECZ is still not informing the masses, does that mean the media should also be dumb?

    In a functional democracy, there should be room for an independent press to release information even if it’s not accurate without being threatened with a court injunction.

The judge and the AG are abusing the courst process…. restraining orders are not meant to stifle perceived enemies and ‘punish’ them. Restraining order were meant to protect the welfare of the majority – in this case this order is working against the public. Besides ‘speculative’ or not the reported results won’t change the ultimate results of the votes that have already been cast. I will contribute my hard earned cash to Mmembe’s defence on this one.

  79. It’s really ridiculous that anyone can walk in a court and obtain an injunction… and the judge won’t even analyse it on merit. The judge should have asked the AG how ‘injurious’ publishing the reults would cause on him, ECZ or the public. In this case public interest in publishing the results (speculative or not) far out-weighs some injunction against it. And this so called ‘speculative’ argument is bul1dug. Media all over the world they project the outcome of elections and call them much earlier than the official results. These guys are filthy rich who watch international news – don’t they see CNN, BBC, Fox projecting election outcome even before official regulators have announced them… just ridiculous I have to say.
