Dora Siliya warned and cautioned for abuse of authority

Former Education Minister Dora Siliya has finally appeared before a combined team of investigators at the former Task Force offices in Lusaka where she has been warned and cautioned.

And Zambia Police Service spokesperson Elizabeth Kanjela has clarified her earlier statement to the media stressing that the former Minister has being warned and cautioned not charged as earlier reported.

ZANIS reports that Ms. Siliya who was smartly dressed and looked composed appeared at the former Task Force offices at 08:30 hours in the company of Lusaka lawyer Lubinda Linyama.

Ms. Siliya who was questioned by a combined team of officers from the Drug Enforcement, Anti Corruption Commission and Zambia Police for over an hour refused to talk to journalists as she opted to remain mute amid pressing questions from the press.

Ms. Siliya who is also former Communications and Transport Minister was summoned to appear before the investigators to answer charges of irregularities surrounding the supply, delivery, installation and commissioning of the Traffic Management Surveillance Radar System at Kenneth Kaunda and Harry Mwaanga Nkmbula International airports in Lusaka and Livingstone respectively.

And Zambia Police Spokesperson Elizabeth Kanjela confirmed that Ms. Siliya appeared before the investigators and has since being warned and cautioned for abuse of authority of office contrary to section 99 of cap 87 the laws of Zambia.

Ms. Kanjela has clarified that the former Minister has being warned and cautioned not charged as earlier reported in the morning.

She explained that Ms. Siliya was summoned to appear before the investigators in relation to the awarding of tender of supply, delivery, installation and commissioning of the Traffic Management surveillance Radar System at Kenneth Kaunda (KK) and Harry Mwanga Nkumbula international airports.

She noted that this happened between July 2008 and July 2010, adding that investigations are still going on.

Ms. Siliya was last week was expected to appear before a team of combined investigators, but kept the officers waiting as her lawyer Sakwiba Sikota later informed the police that his client was unwell.

Ms. Siliya is allegedly to have ordered the cancellation of a duly awarded contract for supply, delivery, and installation and commissioning of ZATM-RADAR at KK and Harry Mwaanga Nkumbula international airports to accommodate SELEX Sistemi Integrati an Italian company through single sourcing.

I now agree with the many observers who believe that these cases are going nowhere and are just a big drain on the megre resources, meanwhile clever lawyers are making a big kill.

    What is wrong with silently finishing all the investigation, arresting the pepetrators AND then Anouncing to the MEDIA that we have arrested this person and he will be appearing in court tomorrow.

    What is wrong with that? I ask. Why does PF have to play with their suppoeter’s emotions like that. This will surely backfire sonner than they realise.

If the abuse of authority relates to the cancellation of the installation of the radar systems at both Lusaka and Livinstone airports as well as the awarding of the contract to evaluate Zamtel, then I do not see this case going much further than the “warn and caution”. I cannot believe that Dora will have made such decisions without consulting the cabinet of the day and if she did then their is no case against her. The Government of the day will have made a decision and actioned through her ministry which should be the normal way of conducting Government business. However, if the cancellation was done with the influence of personal gain then this will be the 2nd fish to be found wanting. 

    • remember Timoshenko( or some similar name) in Ukraine. The only sin she committed was to negotiate with Russia for Gas. Today, she is in prison for abuse of office. These cases against Dora are serious. Please google timoshenko of Ukraine.

    • Timothy, I have read one or two articles and they seem to support my thoughts. The article I read on BBC suggest the she over stepped her authority during the negotiations with Russia. Similarly if Dora did what the authorities allege without the approval or knowledge of cabinet, then she is in hot waters. However, as we all know the previous admin backed Dora and if indeed cabinet was aware and endorsed the move then my point comes effect. Dora’s defence will simply be that it was not her unilateral decision but that of the sitting Govt.

Dora stands to win this case very easily.As Minister in charge of Communication and transport she rightly cancelled a Tender given to middle men or women instead of the manufacturers.What we are not being told is whether the manufacturer who got the Dora Tender charged more than the Middle men who were initially awarded the tender.Please lets have these facts.

    How can someone be warned and cautioned about an offence that does not exist? I read that Mr Nkonde says that this law will be applied in retrospect! Iye, munamvelako sure?

  19. The next government will arrest Sata for cancelling the Finance Bank sale, duly awarded contracts, renaming International airports, firing the ACC and DEC bosses and creating a new province and quashing Secretary to Treasury post. All that is abuse of office.

  20. That is a charitable explanation offered by Zambia police spokesperson Elizabeth Kanjela. Did Zambians need to be subjected to this circus chorus call of fighting corruption? NO, of course it wasn’t necessary. What is at play by the Zambia police under instructions from Sata is the glib, formulaic get-out and fix the shyster politicians. As others have stated, the toothless bull dog always barks louder than perform the actual task. Proper investigative agencies do exist in Zambia. So why have we allowed PF to trample on our rights as it has? I suggest we are numbed into awed surrender by the brazeness of the PF’s excitement arouser of high expectations tactics. Long enough Zambians have began to say and recognise to cut off that loyalty and take PF with a bit of slack.

  23. Mwana wa Mama, Dora Siliya, you have our total support for your bravery that surpasses the courage of most men. Sata and his PF have embarked on selective persecution of notable men and women from Eastern Province. Even when the major Churches have gone underground for fear of their individual lives, we have taken it upon ouselves to deliver genuine prayers to God. The PF Govt has set in a strange phenomenon of witch-hunting never seen on the African continent ostensively, perpetrated in the name of fighting corruption. Yet we know there were cases of the Mersaz housing project involving Sata & the slaughter of pigs by Guy Scott to plumber GRZ finances; now a Minister of Finance given a fake tender to renovate Statehouse. This is acry of highly educated Easterners. God Hear Our Prayers!

  24. I have one piece of timely advise for Dora, don’t do a Chiluba feigning sickness instead of being brave enough to face the music of your stinking bokossi actions. I would actually suggest a wise alternative, go to Livingstone and do a bungee jump, I will volunteer to tie or rather untie the knot for you, stupid obese cow!

  28. none of the accused show be jailed,the reason is so simple the “abuse of office clause” was removed by “Hon” Kunda George.they’ve protected themselves from proscution.remember that our zambian law has a lot of loop holes.advise to my presdo is to comment on issues that have been FULLY investigated and the case can be taken to court.he should let to hold the breath speak when necessary. i still never regret voting for SATA
