The Tribunal should go ahead

The tribunal against the three Suspended Judges should definitely go ahead and the Court Injunction should be further rejected by the Attorney General of Zambia.

There is no way President Michael Sata’s decision to Constitute a Tribunal towards conducting investigations of those three Judges be quashed.

Why are these three Judges scared of to be investigated? Why are these Judges panicking day and night or what are they hiding.If these guys are clean or innocent, why not come out and let the Tribunal go on and clear their names ? These are questions we should ask before condemning our President, or before passing on unreasonable comments over the Tribunal.

What comes from our learned Zambian High Court Judge in her ruling by granting Judges Nigel Mutuna and Charles Kajimanga leave to apply for judicial leave which would operate as a stay of Mr Sata’s decision to appoint a tribunal and suspend the judges and any adverse measures against the applicants.

The High Court Judge acted outside State Proceeding against the will of 13 million Citizenry of Zambia, this is because, before President Michael Sata made the decision of appointing a Tribunal to investigate these three Corrupted Judges, he (Sata) did this for Public Interest, not from his own individually interest. So we have to give him support, through backing him by taking this brave movement because it falls into our Public Interest, as a State Proceeding.

Its for this reason, every Zambian Citizen needs to see transparency into our only Judiciary System Operations . No one is above the Law, and every human-must be treated equal.

In this Case, we have to ignored Order 53 of 1965 Rules of Supreme Court 1965 (White Book), which states that, it is illegal, premature and consequently null and void for the President to appoint a Tribunal, but his powers is premised on Article 98(2),(30) and (5) of the Zambia Constitution.

However, every Zambian knows well that, Our Judiciary System is very rotten, and it has been in such a state for the past 47 years. We have seen and witnessed Criminals and Murderers being acquitted by the same Judges in our Courts. We have seen and witnessed Chief Justice’s taking over some sensitive Cases from Judges and acquitting culprits. We still remembered what happened to one of Our leaned Chief Justice who went so far, and later acquitted a son of a President for a first degree Murder . We still have a lot of very, very rotten eggs within our Judiciary System.

Many Judges have been over stayed to promote corruption within the System. It is high time for President Michael Sata to cleans the Judicial structure of Zambia and the Chief Justice must resign or be fired.

Moreover, it is so painfully and sad, to find out that, a High Court or Supreme Judge or Justice gets a monthly Salary of more than K75 million which is too much compared to other Civil Servants like teachers, police officers, nurses etc who are still living in minimum wages up to K2.5million kwacha Salaries per month. What a marginal shame ? This are real tendencies and products of Corruption. The PF Government have to do something over this issue.

    • It would appear Mr Brown Chibale is lost in this matter…… The issue is the 14 billion DBZ debt owed by DPP- Nchito and Post- Mmeembe ,which JUDGEMENT is already passed by the same “being victimized Judges.” Now Why should SATA or the Presidency come in, to protect his friends????? No no no no Ba chibale reason!! or better still go back & check the Chipoka tribunal terms of reference-its all DBZ 14billion, 14 billion, 14billion, is that how u implement policy in the judicial system????! ……If the president wanted Judicial reforms ,why can’t the terms of reference encompass the whole judicial system…??? It’s not about Judiciary v Executive powers….however the action and outcome of this battle opens the rot and weaknesses of our current constitution &the  need to  change

  2. true reflection of what is in the judiciary,has the judiciary complaint commision ever displined any judge?or forced a judge to retire ,fired since its inception,recommended to president for further findings.if your answer is no,then the MCS is do the right work.

  6. see how shallow the zambian system is!!! with developed countries presidents can’t influence or interfere with the system, there system is immine to govt interference instead its the govts how live by or change to the long robust constitutions. organs of government should have the mechanisms to controlling, correcting and adopting its operations with out crying to the president.

Brilliant,gorgeous articulation from batata ba Kapika,those against this tribunal are just criminals why did they keep quiet about the other tribunals let the law take its course.No one person is or must be above the LAW,what are they afraid of let the TRUTH SET THEM FREE…why are they crying tabalaboma no kuboma.What are they hiding,the tribunal must and it will go on you like it or not.And you headless chickens you can give us that money we fake demonstrations or whatever you call it for you have money to throw around.

  13. The judges are not corrupt. They have just ruled that sata’s friends should pay back what they owe a public institution. Natola fye does not apply in this case. Just pay back the money and stop protecting criminals! Masholi indeed!

  14. Absolute rubbish & trash, can’t possibly come from a genuine Zambian. For those shushushu that are monitoring our blogs tell your masters to go to hell. Tell them that no one has ever succeeded in suppressing a free people’s will. Near home ask KK who at the end of his term had two shushushu for every free Zambian citizen and IT DID NOT WORK. If politicians succeed now, it is their children and their children’s children who will pay for any transgressions against innocent citizens. Just what breed of humans are you politicians?

  15. This old man is better in the grave than any where on earth. Sata is protecting his “friends” here not the public. The general public did not borrow money from DBZ it was Nchito and Mmembe who did and the judges were ruling in this particular case not any other. Why see that the judiciary is corrupt only beacuse Mmembe and Nchito are being tried for clear theft of public resources. In fact this President is hiding behind the tribunal because he has not come out clean on the issue of the 14bn. He is also suing innocent Zambians using the same court system. How logical is this? Why not take his case to Malawi where cleaner Judges are now imported into Zambia? Hypocrites.

  17. so according to the majority, judges never go wrong and no one can discipline them. which law do they use that they cannot be touched? i still remember a small boy from western province was given a 9 month sentence for stealing ama battries, those tuma triple A battries in shoprite but in the same period, dora went scot free. this is the judiciary that said chilubas money in the zamtrop is his. how can you put money in another persons account without the owner agreeing with you and when you see the total amount gaining interest, you say mpeni naka 8million dollars? its high time some of these corrupt judges started collapsing while passing foolish judgements. we need some degree of cleanliness in our courts not ama sebelo
