MMD deregistration, court to determine tomorrow

The hearing and final determination in the case in which MMD national secretary Richard Kachingwe and 53 members of parliament through their lawyers Hobday Kabwe and Company and George Kunda and Company filed a notice of application for leave to apply for judicial review over the deregistration of the MMD has been adjourned to tomorrow.

The former ruling party had sought legal redress against the de-registration and asked the court to declare the Registrar of Societies’ decision to deregister the former ruling party as unlawful, null and void.

Presiding judge Jane Kabuka adjourned the matter in order to study the submissions filed in by the state yesterday.

In this matter, Registrar of Societies Clement Andeleki sought the court to de-register the MMD on allegations that the former ruling party had failed to honor its obligation of remitting annual returns as required by law.

Judge Kabuka stayed Chief Registrar of Societies Clement Andeleki’s controversial decision to de-register the MMD pending the hearing and final determination of the case.

    • No matter how much you hate PFools, they may not be as foolish as you would like the world to believe. For me they are smart and beat MMD at their own game, with all the rigging, all the money and all the tactics of delaying announcing results, all trickery. MMD were beaten by a poor opposition party with a grade 4 at the helm as you claim him to be. RB (MA Economics) was beaten hands down by a grade 4. come on, give credit to the man. He had 1 MP in 2001. Now he has 56 or so. U may not like the man but repsect him, and whether PF loose all court cases coz judges are corrupt and protecting themselves, does not take away what PF achieved by ousting the MMD, the real fools, thieves, corrupt individuals.

    Intellects of nowadays!! when i was there we used to go pa commons na pa BG for shakers.. Anyway ask them to settle all debts failure to which De-register them

  2. This is another embarrassing episode of PF Groupthink delusions in their doomed quest for a one party dictatorship. I argue all Zambians of good will ever steadfast with democracy and Zambia at heart to stay busy on important issues and keep consolidating on the future of Zambia. Our people’s fate has all but been betrayed by Sata and his legion of visionless throwback cadres. For the first time since independence Zambians in their resource rich nation are dying en-masses in stampedes for casual jobs that are never there. Where such casual jobs are, they are being told to first learn speaking Chinese if they have to be considered because those are the conditions PF is contracting massive bilateral debts on from China.

  5. MMD must pay just as Membe nchito must pay. Be fair. Y treat MM could not payD like a baby, they had money to buy all those campaign tracks but registration fees with PACRA or whoever and u think that was PF plan that they dont pay. BE real, MMD are jsut finished, even if judge rules in their favour, they re not going anywhere. Mark my words.

  6. Zambians have very short memories. We cannot recall how terrible MMD was – how they institutionalized corruption, how the MMD raped the rule of law; how MMD turned the High Court Judges into toys to play with; how they persecuted innocent citizens. It is now time for the MMD to taste the pill they gave to others. MMD had to be de-registered or be renamed as Christian Coalition. MMD’s usefulness is long gone. It needs to be buried and let progressive parties participate in the democratic governance of our Zambia

  7. SENIOR CITIZEN is a loser. He has no shame to come out of hiding after last year’s elections. He is a perfect example of a man with a short memory. He was under the illusion that RB and UNIP/MMD would win. Now he has no shame to expose his ignorance and arrogance in matters that are straight forward. MMD will never come back to power. Nevers Mumba will destroy the party and Zambians won’t waste time in voting for a man who can never be trusted with anything.

  9. This is a straight case.MMD will be rightly reinstated.It really myopic to suggest that 20 years of MMD was a misrule,how then do you account for Sata’s 11 years in MMD?

  10. I actually like these cases whether PF wins cases or looses it creates credibility about what they do. When they loose a case they actually win because the people end up trusting the PF as a working government that does not interfere with the rule of law like the MMD did in a number of cases during their tenure in office. I am sure somehow before proceeding with these cases the PF knew that they are likely to loose many cases but it gives a good impression of their work in office. Giving a picture too that they are not a corrupt government.

    • Its not but in the eyes of people it is, that’s where the problem is. So the man doing his job at PACRA is merely working and following a good work ethic but his hard work is seeming as though the PF are the one’s who have told him to do so(which i would like to believe he is not being Pushed by anyone), so in turn if the MMD win the court case PF is seen as NOT interfering with the judiciary which of course i believe they are not so they turn out as the good guys after all. *Even the MMD are accusing PF planning for their party to be de-registered.   11. Fair play. MMD became complacent and drunk with power. That is what happens when you over stay in power and teh opposition is not effective at providing checks and balances. MMD should just own up and strike up a payment deal, like ask to pay in instalments over a certain period. Can also offer to pay interest on outstanding dues.

    PF could learn something from this situation too. The fact they are in govt can make them as compalcent and “above law” as MMD became. Power corrupts.

  12. Please people, dont say MMD ruined the country for 20 years. It is actually less than that. The first 5 years were ok. Yes, I agree that they should pay their dues, so the deregistration is not null and void. I pay tax through my salary every month and whatever i buy, i pay tax. even the road i move my car on, i pay. so if you have a debt, please PAY.

  13. Indeed mmd should pay. And anyone who was general secretary of mmd between 1991 and 2012 should recluse themselves from public office. Mr sata should explain to the country why he was the first sg of mmd to stop paying registration fees between 1993 and 2001. Zambia will forever be a backward country if justice continues to be applied selectively. Sata you are the one who started this and we demand an explanation. Pf is simply mmd mark II and only fools can believe the nonsense about change and the fight against corruption!
