An 82-YEAR-OLD man of Kitwe’s Kawama has been put on his defence after the Kitwe Magistrates Court found him with a case to answer for allegedly defiling a nine-year-old girl.
This is in a case in which Joel Chileshe is charged with defilement, contrary to section 138 (1) of the Penal Code Chapter 87 of the Laws of Zambia.
In her ruling, Magistrate Ruth Kapulo said after hearing the evidence from prosecution witnesses, she is satisfied that a prima facie case has been established against Chileshe.
“There is evidence connecting the accused to the said offence and I, accordingly, put him on his defence,” Mrs Kapulo said.
It is alleged that Chileshe, on October 21, 2011 in Kitwe, defiled the nine-year-old girl.
And in his defence, Chileshe claimed that on October 24, last year, he went to visit his grandchildren in Mindolo where he was served some beer.
Chileshe told the court that he later returned home and did not go anywhere else because he was drunk.
He told the court that around 20:00 hours, his wife told him that there were a man and woman who wanted to see him outside.
“I went outside to meet them and they accused me of having sex with the girl. I was taken to Chimwemwe police station where I was charged with defilement,” Chileshe said.
He denied trailing the girl and defiling her on several occasions.
Chileshe caused laughter in court when he said it was not possible for him to have sex with the girl on several occasions because he does not have much strength left.
He accused the girl’s mother of allegedly receiving K8 million from a man identified as Aaron Lambi, who he claims defiled the child.
Mrs Kapulo adjourned the case to August 15, 2012 for judgement.

The story is incomplete,is the girl in question from his son or daughter? I cant imagine an old man like him doing such a thing.The girl’s mom should ask for forgiveness for troubling grand father.

My thot goes very far to hear about the stories concerning defilement cases, one would wonder if these cases are true, what is the side of the story from hospital,wat r the results? How posible size 82 and size 9?.There is a chain of some fishy things police, (defiled) family, and the court.What I think let the court be realistic on some cases,did the man realy fit in, did the girl manage, what is the behaviour of this girl in the community, and what is the social and economic status of the family.Lets all remember one day we shall stand b4 the TRUE JUDGE- Jesus
