Government Expenditure on Judge Chikopa is in National interest – Sakeni

CHIEF Government spokesperson Kennedy Sakeni says Malawian judge Lovemore Chipoka, appointed to chair a tribunal constituted to investigate alleged professional misconduct of three judges, will remain in Zambia until the stay before the courts of law is resolved.

Mr Sakeni, who is Minister of Information and Broadcasting Services, says concerns about the continued stay and expenditure on the Malawian judge are unfounded because Government had budgeted for his coming to Zambia.

He said in an interview from Mansa that the expenditure on Justice Chipoka’s stay is in national interest.

“Justice Chipoka will only go back once the court process is ended. You cannot invite someone for duty and tell them to go back because of one or two disturbances,” Mr Sakeni said.

In April this year, President Sata suspended Supreme Court Judge Phillip Musonda and High Court justices Nigel Mutuna and Charles Kajimanga for alleged professional misconduct and appointed a tribunal chaired by Justice Chipoka to probe them.

But the three judges challenged the decision through a judicial review, which acted as a stay of President Sata’s decision.

The matter is today expected to come up before the Supreme Court, to hear the High Court’s decision to grant Mr Justice Musonda and two High Court justices a stay of President Sata’s appointment of a tribunal to probe their alleged professional misconduct.

Mr Sakeni said there is no harm in Justice Chipoka’s continued stay in the country on Government expense because his services were requested and planned for by Government, like any other expenditure.

He said the PF administration is prudent and responsible in spending taxpayers’ money.

“This is expenditure in the right direction and what we want is to ensure that the process is followed. We do not see any harm in keeping Justice Chipoka in the country.
“The expenditure is on one individual and this is something the government can afford. We are spending responsibly for the good of the country” Mr Sakeni said.
Mr Sakeni said it is, however, healthy for stakeholders and Zambians to raise concerns about Government’s decisions and activities, adding that everyone is entitled to their own opinions.
He said interest groups must bear with Government because it was not the intention of the authorities to keep Justice Chipoka in Zambia for a long time.

    • @1 perfect! This Chipoka rape of our tax payers cash,now sucks! What fair justice and outcome would Zambians expect from this already compromised judge chipoka? Chipoka is swimming in the same corruption that corrupted the very alleged Judges he’s been called to investigate. we already know the outcome of Chipoka’s report-public perception is greater& better than self righteousness. chipoka and PF are deepening wounds of abuse&corruption. Justice ,a cherished Ideal is slowly turning into an abused commodity. Everything we fought for at independence is at stake!! In the strictest sense, Legality or Law is not necessarily LAWFUL. What then is the point of wasting money on this disgraced Chipoka?

  1. THE TRIBUNAL MUST GO ON. WE CAN’T HAVE CORRUPT JUDGES. THE LAW MUST BE SEEN TO BE VISITING ANYONE. TRULLY, IT’S FOR THE BEST INTEREST OF ZAMBIA THAT CHIKOPA WAITS UNTIL THE FINAL DECISION WHICH HOPEFULLY WILL BE IN THE INTEREST OF THE MAJORITY.

  2. Judge Chikopa himself is a shameless person. He should have left gone back to Malawi on moral grounds. After all we all know that there are more issues to sort out in Malawi and his services are required there. He continued stay in Zambia using poor tax payers money is only driven by greed and the fact that he is running away from pverty in his home country.

Malawi is very near, can’t he go back to wait from there? seeing as its uncertain when his services will be needed, if chikopa is a noble judge he will understand. people are suffering & you are busy wasting money, let sakeni disclose how much they are spending on chikopa daily, if its so cheap & he is an individual maybe sakeni should foot the bill from his pocket. PF is slowly turning into MMD, many have raised these concerns, instead of listening they are being defensive. you are spending 36% of my hard earned salary bakoswe

  5. Which national interest would be harmed by sending Chikopa to Malabi, saving the country a couple of hundred millions kwachas – money which could b used to clean Lsk streets? Or may b u have already INSTRUCTED the new supreme court judges/president’s relatives, to pass judgement in Govt favour? or may b cleaning Lsk streets is not in national interest? CNPs for sure!!

  6. The Government is respecting the independence of the judiciary by allowing the due process of the law without applying any pressure of them to dispose off the stay of execution. Once the judge postponed the ruling,Government simply complied but ensured that Judge Chikopa remains in the country to ensure that the tribunal starts immediately the stay of execution is lifted, and that may be today!!!!

    government can spend on one person and that is no collossal cost, if it helps remove corrupt judges from the bench!!

  8. I can’t believe what I am reading! Surely common sense is not common. I have never regarded Ba Sakeni to be any better than a convict in his warped thinking, but for him, on behalf of this government to yap this nonsense without any shame, is beyond comprehension, can’t say much, I being one of the people who voted for PF, I am perplexed to my bone.

  9. Mr. Minister, as much as we appreciate that Justice Chipoka is here to “cleanse” the judiciary, his indefinite stay worries the tax payers.

  10. Budgeted for Chikopa today; tomorrow it is the MMD budget we are using! MMD budgeted for indefinate stay of an investigator? This has really compromised the whole process of sorting out the mess in the judiciary, because it will only be pay-back-time once the tribunal sits – with those old men who are broke, after retirement – hungry chairperson, plus broke retired judges; what do you get!

  12. it is not in national interest to keep the judge as he has overstayed, is doing nothing except chew our tax. How can Sakeni say govt can afford to pay one individual when people are hungry, students had to demonstrate before getting meal allowances, our roads are potholed etc. If indeed govt had a budget for the judge, can he tell us how much it is as I think it has been overrun by now.

  13. It’s very strange to learn that there is nothing wrong with the continued stay of Judge Chikopa. This is total abuse of power by the pf government and it’s arrogance of the worst kind. These court cases drag on for ever and if one sees nothing wrong in keeping some one who is doing nothing but wasting Tax payers money, then that person is mad and does not deserve to be a leader. I doubt the sanity of Sakeni. Indeed power corrupts and it makes people forget about thinking, what a shame.

  14. Did you realy with due respect budget for this? How did you know he would stay this long? The call by MCS to probe the judges was made long after the budget and he could not have known that the judges will challenge him in the courts of law. So how is it possible that you could have budgeted for it? It is a pity that Zambians are being treated like kids with no brains. Now I believe what MCS once said to one of his friends in 1996. I quorte: ‘Zambians are very docile people and one day I will rule them’. Can anyone argue with him?

Or maybe, he is so dull and incompetent that his superiors don’t allocate any cases to him.For Sakeni, this is the more reason why people are calling you CNPs. Does the big-mouthed Sakeni know that there is budget adjustment if things don’t go as planned?So for Sakeni twisted thinking as long as something was budgeted for and does not produce tangible results, resources still have to be used.If this imbecile leadership were prudent in resource utilistaion, they could have told Chikopa to go back and return when the ruling of stay is passed.Anyway gabbage in gabbage out.

This judge, does it mean that he has no cases to preside over in Malawi because if he is that special, there should have been indeed many cases waiting for  him in Malawi.Didn’t they just pick someone from the street. I don’t think they even know him in Malawi. Was the chief justice and state of Malawi involved.

At best it shows the incompetence and lack of integrity of our executive and at worst exposes the indecision and lack of integrity of the bench. Either way, “one or two disturbances” does not define this shambles.

  24. pama fi think everyone agree to their useless decision.this one you are wrong and if you are a listening goverment you would have let the judge go and come back when you sort out court issues.this is a let down coming from a minister.l can under a party cadre maybe he does not know that we have pressing national issues we can attend to.our health centre need urgent attention.one week cost of accomdating this fool judge will go along way if you take it matero clinic.God why did you let this fools win .

I think the PF govt is lucking wisdom to lead this beautiful country.Zambians, to have leaders like sakein in gvt should a big worry,he sounds so dull for a gvt spokesman.Unfortunately we have so many of the likes of sakein in the PF gvt.The aim of this case is to punish the 3 judges to avoid embarrassing the DPP,gvt and Fred.

  28. SO CHIKOPO’s STAY WAS BUDGETED FOR, IS THAT RIGHT??? FOR AN INDEFINITE STAY??? This may just go some way to answer some suspicions, that chikopo may indeed have had some sex-change before! “ka gelo” at tax payers expense!!!
