MMD, PF reach concession over petitioned parliamentary seats in Chama and Luampa

The MMD has withdrawn the petition case of the Chama North parliamentary by election outcome that saw Patriotic Front-PF’s January Zimba emerging winner.

Mr. Mtayachalo through his lawyer Hobday Kabwe filed in the notice to discontinue the case in the Lusaka high court on Tuesday.

In his petition MMD’s Yotam Mtayachalo contended that the July 5th 2012 Chama North parliamentary by elections were marred with electoral malpractices.

Mr. Mtayachalo stated that the by election was characterized by bribery and abuse of state resources among other things.

And high court Judge Dominic Sichinga has stated that both parties in the petition will bear their own costs.

The Chama North by-elections arose when Lambwe Kachali of PF petitioned the election of MMD’s Darius Mumba on grounds of electoral malpractices during the campaigns.

Meanwhile MMD Luampa Member of Parliament Josephine Limata will continue as Luampa Member of Parliament following the agreement by both parties involved in the case to allow her to continue as the area MP.

This is a matter where Lusaka High Court Judge Mwikisa in April this year nullified Limata’s election as Luampa MMD Member of Parliament following a petition by losing PF parliamentary candidate, Musangu Muzaza, a Kaoma-based teacher.

  1. MMD have realised that under5 immature tribal politician called HH is not someone they can trust. Therefore, in their last NEC meeting they have opted to work with PF. Very soon they will officially anounce the Pact. Some leaders think owning 1 million cattle is wisdom enough for one to be presido of the country.

  3. I smell a rat here, You earlier said the election of Limata was rigged and that for Zimba too, so now it is give and take situation. I hope UPND can learn something from this.

  5. This is good though I just don’t understand how someone can continue to be MP if the high court already nullified their election

  6. If the high court has ruled that the election of Josephine Mbuywana Limata was fraudulent it is illegal for Sata and Mumba to let her continue. Nevers and Sata have just realised that their parties don’t stand the chance of winning the by-election. Zambia has really gone to lawless dogs. Court judgements to these monkeys don’t matter. We need the rule of law in Zambia otherwise the country is going to be destroyed. What sort of id.iots are these?

  7. This development is strange, the High Court nullifies the election and she remains MP without the Supreme Court overturning the ruling.  As for Mtayachalo, I think he is being sent into diplomatic service.

  8. UPND will be in pact with failure, watch this wide  stride of MMD. MMD has come to senses that it cant work giving in to UPND in bye elections. UPND will be buried soon for MMD is becoming canning in their behaviour just like the HH way. Good one indeed.

  10. this is total nonsence….mediocrity of the highest order. the parliamentary seat was nullified and declared vacant by the court, where on earth wud the same court reverse its decision insuch a manner.??? i smell a rat here…

  11. they shud have let the young man go to parliament,very courageous,humble with rich education,if he goes in the foreign service then parliament has lost
