The Acting Chief Justice is in office legally-Sakeni

Information and Broadcasting Services Minister Kennedy Sakeni has said that Chief Justice Lombe Chibesakunda is in office legally. In a statement released to the media today in reaction to calls for the Chief Justice to resign, Mr Sakeni singled out United Party for National Development (UPND) President Hakainde Hichilema and described him as bitter and frustrated at his stalled political fortunes.

Mr Sakeni said that the Government, under the leadership of President Michael Sata re-affirms its commitment to the rule of law and the principle of separation of powers among the various institutions of the State in deepening and preserving the country’s democracy.

STATEMENT BY HON. KENNEDY SAKENI, MP, MINISTER OF INFORMATION AND BROADCASTING SERVICES AND CHIEF GOVERNMENT SPOKESPERSON ON CALLS BY UPND LEADER HAKAINDE HICHILEMA FOR ACTING CHIEF JUSTICE TO RESIGN IN 15 DAYS TIME.

Government wishes to dismiss calls by opposition UPND leader Hakainde Hichilema for acting Chief Justice Lombe Chibesakunda to resign as reported in some sections of the media.

The calls are unnecessary and unfounded.

Mr Hichilema’s outbursts are not new. They are a manifestation of his deepening frustration and bitterness at his stalled political fortunes.

He is advised to address his personal and party leadership inadequacies instead of venting his anger on people and institutions such as the Judiciary.

The Acting Chief Justice is in office legally.

There is nothing that warrants her to resign in 15 days time as demanded by Mr Hichilema.

The Government, under the leadership of His Excellency President Michael Chilufya Sata re-affirms its commitment to the rule of law and the principle of separation of powers among the various institutions of the State in deepening and preserving the country’s democracy.

    • What a hollow /shallow statement.We are in seriuos trouble even Grey Zulu would back up his statements with some form of reasoning.

    If your IQ is anything above average you would agree with me that as time has passed since they came to power, they have actually improved been a breath of fresh air.
    Court cases which used to take years (Chiluba) are now being solved in weeks (Chirwa) saving the public millions of Kwacha
    Kwacha is rebased and lighter on the pocket, govt is filled with a lot more educated people than the previous regime. This govt has reached out even to the opposition to form a unified government, Even the people that belittled and crossed line are FREE (William Banda) have been ignored(not punished/Jailed). Even the ex U presidents are now visiting Zambia, Currency has stabilised, inflation is under control.

  3. Mr Sakeni you have not qouted the law that you claim make it legal for Chibesakunda to continue acting beyond the 6 months as per constitution. Explain please why she is legally occupying the office as you claim. Furthermore, why have you singled out HH when many other qaurters of society are calling for Madam Chibesakunda to resign on moral grounds? What about LAZ, MMD, CCZ, etc? Please be objective and remember that you shall not be in power forever. Who ever thought people like yourself can ever assend to power! HH is not the only bitter Zambian instead more than half the citizenry is bitter with your PF.

  8. Sekeni should also state why he is differing with HH in relation to the matter at hand. HH should have said something to back up his claims. All we hear from this man is memorised words like ‘bitter, dwindling political fortunes’. Who told you that HH’s political fortunes are dwindling? Now suppose they are, he should not speak? I know of people who have virtually remained alone- people like Nawakwi, Miyanda, Tilyenji- but they speak, its their right, its their country. Sekeni, this HH’s country as much as it is yours. You are there doing that job in trust for the Zambian people. Take it easy, dont be excited. Many have been where you are and have left that job to others.

  9. Ok acting Chief Justice will not go anyway whether 9 months from now. The president is the appointing authority. LAZ never told Ruphia Banda to relief Chief Justice. This is were the difference between Sata and current crop of under fives politicians fail to match Sata. Sata is a mature and seasoned politician. He put the masses first than his political ambitions. ZRA went on strike he visited them and encouraged them to go back to work and. ZRA went back to work. Sata never used university students as he knows these are the future leaders but who can employ someone Associated with crime – destroying goods and properties?     • Pafwenamwine, get your facts right. Justice Sakala qualified when he was appointed. But was given a contract after he reached retirement. Chibesakunda does not qualify to be appointed. Dont lead this country into problems.

    We say this man ACJ is illegal for her/him to hold office now on constitution grounds
    1.0 She is over 65 years retirement age.
    2.0 She is still acting after six months
    3.0 The select committee rejected her by 100%
    On moral grounds
    1.0 many of mates here are being victimized once you seen not in support of PF
    2.0 Most the her ruling are not creditable
    3.0 she a relative of the presido- declare interest
    4.0 poor deliver of Chipoka tribunal judgement where the case went back to high court(Juniors)
    So Musekeni and kamimba cite on clause that makes her legal

  23. What is making this odd is the failure by Sakeni to quote the law which is backing the legality of Acting Chief Justice. Is there something in that office Mr Sakeni, which changes people, as we saw similar ways of thinking others in that office like Rony Shikapwasha? Please inform us so we can be ignoring statements from that office.
