Magistrate stabbed

NDOLA Magistrate Ben Akende is nursing serious wounds at Ndola Central Hospital (NCH) after being stabbed three times by his wife during a domestic quarrel.

Mr Akende, 51, of 41 Kuomboka Road in Kansenshi residential area in Ndola was stabbed twice on the chest and once in the stomach by his wife Gertrude of the same house.

Ndola District Investigations Officer Martin Chilando confirmed the incident which happened on Thursday at around 23.00 hours in the Akende’s bedrooms during a domestic quarrel.
“They started a fight around 23.00 hours while other family members were sleeping,and Mr Akende started screaming for help after being stabbed,” he said.
He said Mr Akende was rescued by his nephew who rushed him to Ndola Central Hospital.

The magistrates wife Gertrude, 41, is detained at Kansenshi Police Station and she will be charged with unlawful wounding. Mr Chilando said Ms Akende also sustained some injuries on the forehead and chest. He said she would be released for medical treatment before she appears in court.

    • Mr. Akende is my immediate neighbor and a fellow Lozi from Senanga. He is fond of beating his dear wife of four children.

    • Attempted murder is when a person pre-meditates the whole process of how they will carry out an act. Sometimes people act in the heat of themoment without thinking what they are doing but rather reacting to an immediate threat or provocation. In such cases it is not murder, or attempted murder. In English law, for eample,one can get away with “murder” when it is considered a crime of passion.

    • My question as well. Her face is said to be swollen and has a stab in the chest. Could she have done what she did in self defense? I am just wondering!

      It is simple. If anything this is attempted murder according to the LAW as stabbing someone twice in the chest is more than likely to result in death. While if i hit you because you have a knife and attacking (or simply threatening) me, the LAW allows me to use reasonable force to defend myself and in this case the extend of ones injuries will give an impression of who was likely to be “self defending”. I’m sure legal brains and Gender violence campaigners will say, she was defending herself from the obviously stronger male and had no choice but to use a knife. But seriously, how did the knife get in the bedroom? If she left the bedroom to collect one from the kitchen then her claim fails.

  4. Bo Gundown @ 5, yes there is such a thing as Lawful wounding, and yes, even lawful killing. With You supposedly living in the US one would expect you surely ought to know that! Every time the police shoot at and wound suspected criminals it is lawful wounding. And should such suspects die, it is considered lawful killing too, Bo Ndaate. When you shoot and wound someone even kill someone trying to steal from your home or attacking you, it is lawful wounding Bo Gundown. So, please think before you open your trap in the future. Thanks.

SElf defence, obviously he came back from his tweede wife or mukuchilisha when she confronted him, he then became defensive by hitting her like a log, her life was in danger he could have killed her, so she heed to her survival instincts and reciprocated with the only weapon available ( the Nkife) and sure to serve her own life.Am sure things could have been far much worse and different had she not used the weapon, this man has some explaining to do, women die everywhere at the hands of their spouses, the government must free this lady and this man be thrown in jail, i wouldnt mind him serving 6months jail time typical loser of a man! However there are a few good men out there, so dont get me all wrong.

      Good try but reasonable people don’t keep knives in the bedroom in order to “instinctively” turn to the only weapon available and if she went to collect one from the kitchen then the LAW will not accept self defence. It becomes premeditated otherwise one fearful of her life who gets a chance to go to the kitchen and return to the “lion” isn’t exactly in fear are they?

    • Tribal Blogging…, i havent read anywhere in the statement that she kept the knife in the bed room, she ran to get away from him at which point he ran after her caught her by the kitchen door grabed her back to the bedroom, mean while as he was dragging her she clinged to the the sink and picked that knife without him noticing.
      He has been doing this for a long time and abused women never leave unfortunately, just imagine how her life has been affected, obviously he abuses her verbally or evn sexually, she must have lost her self esteem, her children are tormented they dont fit to be with such a father they are also emotionally affected, she needs counselling i hope she will get it, the problem is him being a lawyer she will be unfairly treated, i wish she was outside Zambia.

  6. What kind of judgement would such a magistrate pass on a couple who have dragged each other to court saying their disputes always end in violence?

  7. These two(2)ninjas turned couple are a disgrace to their own family. The magistrate needs to be relieved of his duties to save the image of his fellow magistrate judges. His employers should let him work in the back office away from public duties. He is no different from the cops implicated in the recent copper theft or that Pastor who deceived his church female members to gain sexual favours.
