Court Proceedings against the Acting Chief Justice begin today

According to the resolution of the Extra-ordinary General Meeting (EGM) of the Law Association of Zambia (LAZ) which was held on Saturday 24th August 2013 at the Mulungushi International Conference Centre, the LAZ litigation team will be filing court proceedings against the Acting Chief Justice on Monday, 23rd September 2013 at 11:00 hours at the Lusaka High Court.

The meeting unanimously resolved that Justice Chibesakunda was not qualified to work as Chief Justice.

It said the mandate by the AGM to the Council of LAZ to litigate on this issue shall be preceded by engagement with the relevant authorities within a reasonable period of time, not exceeding one month, with a view to ensuring that the vacancy in the substantive office of the Chief Justice of the Republic of Zambia is filled.

The Association resolved that in the event that the engagement with the relevant authorities fails, the Council of LAZ shall proceed in accordance with the mandate given by the past AGM to litigate this matter.

It said the litigation will be undertaken along with other forms of dignified and affirmative action by the members of the Association until the substantive position of the office of the Chief Justice is filled.

      2. LAZ allowed themselves to be ‘led’ by Albert Wood’s business partner. This weakened them (LAZ) to a point far below anything that would shake Mutembo and Wynter, let alone Fred and the Republican Head of State.

    A wrong will always be, we as a people should not shy away from correcting it, that shouldn’t be without any exception. It’s only when we think that was that as a Country we will progress.

  2. What is wrong with Madam Chibesakunda to act? I am 63 year and still working. I intend to stop when I am 70. I have the energy and what it takes to work while most of you young men and women are lazy. You spend time on the phone chaffing other people’s wives and husbands. I am more productive than the young ones I work with. so please give us a break.

    • Primarily the issue here is about what our laws say not her age. The law does not allow the CJ to act forever. If they can go to parly and change the law then chibesakunda can be confirmed.

    • At 63 you need to have reached a level where you have young men and women working at your own firm.

      Would be shamed to work for somebody at 63.

    • Hawing energy to work, it’s a great thing.
      Been appointed to the position contrary to the Constitution, that is another thing. Therefore, if you have problem at your age understanding the reasons it is called “dementia” and it is medical condition that you should take care.

  3. Can someone out there educate me on winter’s assesion that the law was changed to 7 year acting capacity for the CJ. When was this done. Was this the desire of PF or there are no capable men and women in the judicially. To bollow the presidents words, are they all criminal who have continued to work criminally and making the work of Chibesakunda difficult.

    • You just cited Kabimba’s Law and not the Zambian Law.

      Now you know why Kabimba has never won a case in Court. He uses Kabimba’s and not the Zambian Laws that are always at variance with reality.

  4. this is nonsense , which judge is going to hear that process, how can a judge decide that her boss the cj be fired. it is a non starter and a waste of time and laz can not force the president to act against the decision he had already made. I pitty the laz president he is so against the pf govt ,we are watching him.

    Laz should also comment on the economic subbotage hh want to cause on the copperbelt

In future I would like see an African Union court of justice that would handle cases not properly dealt with in national courts just like the European court of justice which can over rule the national courts. In this way I believe Africa will manage to nurture its young democracy and stop rogue leaders who want to use the judiciary for their own selfish gains.

    If there was such an establishment, all these opposition party seat nullifications, and opposition party candidate nomination barring would be non existent.

  7. For Members of Parliament (Legislature), the concept of Acting MP does not exist. Clear? The vacancy also can not exist more than 90 days. Leave Parliament alone and enter executive office. Here, stop wasting time and money and creating unnecessary problems. LAZ is directing attention to theoretical issues that have nothing to do with preventing miscarriage of justice in the country. Leave Justice Chibesakunda alone. Concentarte on Constitution making and modernizing archaic legislation. Here acting is possible. Period.

  8. Can somebody tell me for how long the CJ can act? Is the period stipulated in the law or constitution? If it just says acting, then it can be as long as the appointing authority wants the CJ to act. What does the law say about the acting -period of the CJ?
