Kabimba Tribunal begins sitting

The tribunal set up to probe Justice Minister Wynter Kabimba for abuse of office and breach of oath of secrecy has commenced its sittings today.

Former MMD Solwezi Central Member of Parliament Lucky Mulusa who was the first witness has told the tribunal that his application for the establishment of the tribunal to probe allegations leveled against Mr. Kabimba was in the best interest of the nation.

Mr. Mulusa, a resident of Plot No 9618 Mitek Area Solwezi ,Northwestern Province has told the tribunal being chaired by Acting Supreme Court Judge Evans Hamaundu that his interest in the matter is that Mr. Kabimba did breach the Oath of Secrecy and Oath of office when he disclosed a legal opinion given to him by Solicitor General Musa Mwenya to his party the Patriotic Front (PF).

Mr. Mulusa told the tribunal that by disclosing such a government document, Mr. Kabimba who is also PF Secretary General went against the Parliamentary and Ministerial code of conduct.

He said this is because the ruling PF earned pecuniary advantage by receiving a government legal opinion on the matter of nullification of parliamentary seats.

The former Member of Parliament was being led in examination in-chief by the complainants’ counsel Makebi Zulu.

And in close examination led by defence lawyer Dr. John Mulwila, Mr. Mulusa maintained his position that Mr. Kabimba did breach his Oath of Secrecy in his actions to disclose the a government legal opinion to a private entity the PF and subsequently a litigant Leonard Phiri.

Meanwhile members of the tribunal had a tough time guiding the defence team in how to handle their cross examination.

Justice Hamaundu at one point also advised both parties in the matter to avoid a confrontation approach as the tribunal was only there to hear facts.

The tribunal hearing will continue this afternoon.

Did you expect KABIMBA to charge himself money as Secretary-General of PF for consulting his own Ministerial Files as Minister of Justice and using Musa Mwenya’s advice which he received as Minister of Justice???? It is such a s.t.u.p.i.d argument that only a corrupt and desparate person can even waste resources to go to court for that. The national constitution right now DOES NOT differentiate between the ruling party and the government: the Government implements its development programmes based the manifesto of the ruling party but the ruling party NEVER charges the government for use of its manifesto, and so the ruling party is expected to know the opinions of government officers and use that information in its activities. Wash out!
