New Constitution is not magic formula for Zambia-Scott

Vice President Guy Scott has charged that enacting a new constitution will not automatically solve all of Zambia’s problems.
Dr Scott said the opposition and the NGOs have misled many Zambians into believing that having a new constitution will dramatically change the way the country is governed.
He was speaking Sunday evening when he featured on a live ZNBC Sunday Interview programme.

“Can we guarantee everybody secondary education? You can write it in the constitution but you can’t guarantee it because you have limited level of resources and limited ability to manage your country which is the size of Texas,” Dr Scott charged.

He added, “So some people have been naughty and irresponsible telling people that the constitution will change everything. I met a taxi driver in Livingstone and he was busy telling me that he is very hungry and he waiting for the new constitution to get him the food and this guy was serious.”

“Let me give you another example, the late David Phiri, the forming sports and mining executive was on that Chona Constitution review commission and they flew over to the Barotse wetland in a helicopter to meet villagers and ask them what they wanted to see in the constitution and some villager rose and told them that he wants crocodiles banned in the new constitution. That shows you that people don’t understand this constitution issue and they want to make crocodiles unconstitutional.”

Dr Scott however said the PF government is committed to finalizing the enactment of a new constitution.
“It would be very nice to get finality on this issue of the constitution because we have been on this road before. I personally would like to have it changed because the present constitution does not allow me to stand as President, it’s a deficiency but I’m not prepared to enter into a battle of insults over that issue, I would rather retire.”

Dr Scott explained that a new constitution is important for Zambia but cautioned that it is not a magic formula that can take the place of good governance.
“Good governance is much more important than the constitution. The constitution can’t even guarantee you good governance. Good governance is the people you choose to lead you, they have to be sincere, they have to be genuine and take seriously their obligation to build schools and clinics,” Dr Scott stated.
Dr Scott said he also does not know when the Technical Committee will hand over the final draft and report to the report.
“We want the report delivered to State House because it is our report, we appointed the Technical Committee incidentally, the technical committee didn’t have PF cadres in it, it had people in it who were not even friendly to the PF, Ernest Mwansa was a PF rebel in the previous election but we appointed him because we do not want a rubberstamp job. The technical committee is not God which can produce a constitution which we can’t even read or comment on. Who gave the technical committee such supernatural powers?”
The Vice President said he is hopeful that the Technical Committee will hand over the report and draft constitution to President Sata in a matter of weeks.
He also said the 2016 general elections might be held under a new constitution.

    • Does this man think Zambians are so daft to not know that there are no silver bullets in the world? We want the constitution because we need proper systems in place.For instance the police right now are so biased against anyone of different opinions to PF and can arrest people on trumped up charges because we do not have proper laws in place.Right now we have illiterate Law makers in parliament who can not even debate issues of national importance- we need A new constitution…Right now we have an incompetent president who just swears in people, reshuffles ministers at a whim and therefore wastes lots of tax payers monies- we need a new constitution, right now there is no freedom of expression- we need a new constitution.The PF government has budget deficit -NEW CONSTITUTION

    • I think it’s magic, if it was not magic you could have thrown it to the dogs already- your so called President said, “the constitution will guarantee when elections will be held”- atleast we shall know when Sata leaves state house. To me that is magic.

    • PERHAPS Mr.Scott because of your whiteness you failed to understand what the people in Barotseland meant when they said they want crocodiles gotten rid of.They meant it should be law that ZAWA should monitor crocodile populations in the wetland.It infringes on the human rights of the Lozi to not able to free access water in the rivers due to overpopulated crocodiles.Access to water should be a basci human right in Zambia and prtected at all costs.Please do not insult the intelligence of the Lozi villagers jsu because they did not use colonial legal jargon.As for the bus driver he wants it to be law that food is easily accessible to Zambians. It should be illegal that so much maize goes to waste every rain season.It should be illegal that farmers are not paid for months on end.

    • While most bloggers might disagree with Scott, there is a lot of sense in what he said.

      Yes we need a new people driven constitution but we need also to be level headed as we make such demands.

      We had two constitution reviews under MMD so we need to make this one right so that democratic and governance institutions and not individuals are strengthened.

      These institutions will enhance accountability and help tackle corruption and consequently deliver development to the people.

    • Guy Scott is echoing his colonial fore father s’ stupid words when they tried to distract the people from fighting for independence, saying independence was no magic formula. We have heard this before from people who still stuck in colonial mentality.

      Guy Scott is not even ashamed of himself ,displaying his idio.cy in public. Who does not know that the new constitution will not put food on the table BUT WILL PROVIDE AN ENVIRONMENT WHERE EVERY BODY WILL BE GIVEN EQUAL CHANCES TO BE ABLE TO PROVIDE FOR THEIR FAMILY.

      Why is Sata so afraid of enacting the new constitution? The answer to this question is key to Zambia’s peace and stability. If not answered honestly it has the possibility of igniting civil strife like that seen in 90s.

I agree some people are trying to project it as if the constitution is a magical formula… Good governance is derived from the people you appoint.. so maybe PF should also look at that.

    • Among other things that I would like to see in the new constitution are;
      devolution of power.
      1. lets have provincial parliament in all provinces elected directly by people
      2. let provinces be in charge of health, education, social services, energy, RDA
      3. with improved & strengthened oversight, let 6% of VAT remain in provinces
      4. Provincial budgets and certain projects can be jointly funded by central & provincial govts.
      5. 50%+1 majority win and not the current first-past-the-post system

      these plus more will bring development close to the people. currently everything has to be approved and come from Lusaka including toilet tissue

    • Agreed that new Constitution will solve all the problems of Zambia, but without new Constitution which is a foundation for all laws, it will be impossible to solve any problem. Mr. Scott, you cannot build house from the roof down, it is other way, from foundations up.
      As to the usual brainless bottom kissers, try occasionally to understand issue before making stupid and irrelevant comments.

      Constitution should NOT depend on circumstancs of current political players. Let’s not lower presidential age limit to suit cosmo mumba nor increase it to suit sata. Let the will of the people prevail as will be submitted by the technical committee.

      However you have just fallen short of condemning PF’s actions on the instigating police partiality when dealing with political parties.

      Lets encourage the government to play it fair, and let the people decide who,where,and when they want to be addressed by.

      I believe I always make sensible contributions.

      Of course I come down very hard on UPND and its leadership under HH, its lack of any national development agenda and this is what some of you may not like.

      PF is still very popular and delivering serious development across the country.

      As for UPND, reform and infuse in new strategic thinking at top leadership, not the current emotional type, cultivate a national appeal or you will eternally remain in opposition

      In case you did not know, all the good bits in PF’s manifesto where copied from UPND manifesto and pasted in PF manifesto. The only problem is that PF copied ideas they have no clue of how to implement them. Thats why HH called them Chimbwis without a plan.

      If don’t understand the progressive UPND manifesto say so that a lot of us here on LT can help you understand it by interpreting it in simple grade 4 English language.

    • You really like twisting issues. You are the one saying the constitution is a magic formula. It is not normal to think that a plan is a magic formula. The constitution is a guide on how we should govern ourselves. The VP reminds me of what the late Ian Douglas Smith, the Prime Minister of Rhodesia used to say about black people and voting. He said voting was such an important weapon that you could not give it to a black man. He said it would take 1,000 years for blacks in Rhodesia to take over power, just like some people say about HH. Robert Mugabe took over power within a few years and it was a bitter pill for Ian. We whom our illiterate parents sent to school are explaining to them what the constitution is about and they understand.

    • whites will never see you as their equal. its just inherent in them. they can pretend long enough but times do coe when they speak freely or become too comfortable that they turn of that guard they have in their mouths to say certain things, that they say their real thoughts. When their guard is on, i call it conscious racism mitigation mechanism, when it is off, they just use their subconcious and s.h.i.t just flies out their mouths like scott did.
      The man knew exactly what he was saying and dont make excuses for him. Its the nature of the beast i suppose.

Your major issue with that constitution is the age clause we know. Everything has time and so is the case of being a leader, one cannot be a leader for life. What we are expecting is that the new constitution will provide for good governance, enhanced rule of law, separation of powers, improved standards of living through the bill of rights etc. You where advocating for these things when you were in opposition. What has Changed? Are you telling us that you lack integrity and honest to be VIP of Zambia? The single most tragedy in Zambia is lack of vision and development agenda confounded by bad laws at the apex of which is the current constitution. So our plea is that we put in place a constitution that is by the people, for the people through the people. This is fundamental and long over due; 50 years and still struggling with constitution, its a scandal Ba Guy Scot.

Dr scot should think for a change, the current constitution bar him from acting as president, and so are many Zambians, it gives so much power to the president to decide on anything and any time without consultation, people need schools, colleges universities, he is building stadium in Mongu. He is building 2 universities in his province while other provinces have none. He has no limt to borrow money with no plans the euro bond, nepotism is highest in SATA, even Masebo can hide in the president just by say the President instructed her. All these can be solved in the new people constitution. GIVE it to us Zambians its our money please.

In our case this muzungu man and his PF friends do not see this because they think they are the alpha and omega of everything in and about Zambia. More the reason they have been flouting (actually raping) the current constitution with impunity and without shame.   13. Wrong. A people driven constitution is magic formula for any nation that wants to have sustainable, efficient and effective development. The reason why PF is aginst a people driven constitution is because they are afraid it will force them to work for the masses and not for themselves. If we had a people driven constitution:

    1. RDA and State House (imagine) wouldnt have been made a centre for plunder of national resources;
    2. Billions of kwacha wouldnt have been wasted on a useless technical committee reviewing the constitution;
    3. Billions of kwacha wouldnt have been wasted on byelections meant to keep a disaster in statehouse;
    4. Reckless borrowing for consumption wouldnt have been tolerated;
    5. Useless MPs would have been fired long ago,
    6. Sata would have resigned already. etc

    • The reason why Africa as a whole has stagnated is because of lack of a good base tio support good governance Scott is talking about and that good base is the constitution.

    Saudi Arabia
    Kazhastan
    Congo DR
    Sudan
    North Korea

    My conclusion is that a new constitution that will push us from the likes of North Korea to prosperity and freedoms of the USA, Japan, or Canada is THE priority.

During my holiday to my home in Zambia, it’s true of what people said all those nonsenses that I was so ashamed and was shocked of them being uneducated but I don’t blame them. Blame the poverty and mmd for doing this in 20 years. Even I saw some Zambians spoke stupid things even praising the HIV in TV that I failed to believe it and was so sad. I used to argued with them to correct the ways but they shut me off even banged my car. I’m really sad of their stubbornness but I don’t blame them because I know I will be like them thru poverty if I wasn’t on abroad. My people need to be patient. Diasporas, how many have you visited Zambia? To me, every year. Hear them talk that you will spin your head.

As Zambians, our priority is a people driven constitution now so that our leader who have become so arrogant can be stopped once and for ever in future. we dont want to be taken granted for ever again, thats why we need a people driven constitution. The kneel before us for our votes and once we vote them into ofiice, they start insulting us saying first we must show them an animal driven constitution, BEFORE THEY CAN CONSIDER OUR REQUEST. We are not requesting now. We are demanding what belongs to us and NOW!

    Is hanging onto priviledge and power at the expense of the rest of the nation worth it considering the grave risks of manipulating or witholding a people driven constitution??

    There are hundreds and hundreds of Zambians who are successful in the private sector without once benefiting as a tenderprenuer (those who get rich from governmen contracts through bribes and/or political patronage). I am a good example.

    Why hold the nation at ransom and drive it to the brink for just pieces of silver? Is easy money so sweet as to make people so reckless despite the election promises?

    I honestly believed PF would deliver what they promised but I suppose I have to beat a quick retreat to reality.

I absolutely agree with scott is no magic formula.but zambians have a long time aspired to have a better constitution. as a private citizen of zambia i would like a constitution which has a flexibility to change for the better. It must also be brief and direct ie ( It should not have ambiguities and obscurities of language, because this may lead to conflicting interpretations) above all zambia needs a good constitution which provides bill of rights for all the people the land.

In particular, good constitutions provide legal orientations rather than detailed specific prescriptions. Certain specifics are best left to reform-friendly laws derived from the collective experience of the nation.

  29. man is not capable of ruling himself period. only GOD the creator of man kind can successfully set up a government that all man kind will be happy with so this new constitution will not solve our problems so why waste time on things (constitution) that are destined to fail instead why not spend the limtied precious time you have on learning how and what is required of man to become a citizen in JEHOVAH’S kingdom. Were the leader is genuinly concerned about the needs of the citizens and truely loves them all but more importantly has the power to take care of ALL their problems.

  30. Having Car Insurance does not solve all your car problems but we still feel comfortable when we have it as opposed to driving a car without insurance. A constitution, solves one MAGICAL problem; it provides the framework that all men and women should follow. It has nothing to do with solving problems; but it provides the rules and regulations in which Zambian people will live in. ! So Vice president, please do not use the notion that a constitution wont solve ” Zambia’s problems” as a reason not to make it urgent. As young people we want a constitution for our future.. not for your future.. So if there is a legacy you should have as an administration get our constitution DONE!!!

  31. Woe unto a country whose vice-president, regardless of whether he is white, black, yellow or brown, fails to understand the value of a good constitution. A good constitution is not there to be a magic formula for all of a country’s problems; certainly not.

    This is what a good constitution does: it empowers the electorate to reward a good government and to punish a bad one. By its refusal to legitimize the new constitution, PF wants to stay protected and shielded from the fury of the electorate by the current bad constitution.

    However, to rule people against their will, is not a democratic ideal. The Zambian people know what that means after going through the 27 years of UNIP misrule. It’s against that, they yearn to be protected by the new constitution.
