Court convicts three Barotse activists for publication of false news

The Kaoma magistrate court has convicted the three Barotseland activists three years each with hard labour for publication of false news with intent to cause fear or alarm to the public contrary to the laws of Zambia.

Magistrate Julius Malata convicted the trio today.
The magistrate said the case committed by the three activists Nayoto Mwenda 32, Boris Muziba 36 and Sikwibele Wasilota 33 was a misdemeanor but that their conduct during the court process was not good.

Magistrate Malata convicted the trio accordingly as the prosecution had proved its case beyond reasonable doubt.

Mr Malata said the court imposed serious punishment in order to deter future would be offenders adding that the trio did not show remorse even after being arrested by police officers.

He said Zambia was a unitary state that even included Western province and whether Zambian or non Zambian as long as the offence has been committed in Zambia everyone is amenable to the judicial system of the country.

Magistrate Malata said that he could not allow people committing offences with impunity whether Zambians or non Zambians adding that the three year sentence will be with effect from January 6, 2014.

But in mitigation, the trio maintained that the case be transferred to the common wealth court which is impartial as the matter was an international one.

Nayoto Mwenda said the matter cannot be tried by an illegal and biased Zambian court while Sikwibele Wasilota said the matter concerns two countries of Barotseland kingdom and Zambia hence the case be taken to an independent court.

However, Magistrate Malata said he has heard their mitigation adding that the matter committed was a serious one and sentenced the trio to three years each with hard labour.

He said that if they were not happy with the court’s outcome, the trio was free to appeal to the high court within 14 days.

Immediately after the verdict of the three Barotseland activists in a fully parked Kaoma magistrate court amidst tight police security, Barotseland sympathizers started crying while others were singing solidarity songs when the trio were being whisked away to Kaoma State prisons.

    • The cry for freedom and indeed the recognition of the BA64 maybe a legit. However, Western Province IS NOT BAROTSELAND. Therefore those trying to re-shape the boundaries to reduce Barotseland to Western Province alone should be subjected to treasonable provisions in Law.

    • You can take a Lozi away from Barotseland but you CAN NOT take Barotseland away from a Lozi. The trio are Heroes of Barotseland and they have stood their grounds as Barotse citizens.
      These men are martyrs’ for expressing their freedom and rights. Not amount of oppression, persecuting, torture and intimidation can stop a cause who’s time has come to be done with.

  1. Waist of times, PF did publicise false news about sata on working holiday in Israel and I didn’t see any one in court??

    • Even the post and most Zambian media published the Barotseland Agreement 1964, therefore, all should be arrested for “publishing false news” and alarming the country.
      On 21st May, 2011, in Limulunga, Mr Sata said ” I am Linyungadambo member” and ” will honor the Barotseland Agreement within 90 days…….”.
      The Roger Chongwe commission of inquiry report on Barotseland’s findings have not been made available to the public domain to date.
      The eyes of God are everywhere, watching what the evil people do infinitely. He who dies for what is his has not taken someone else ‘s anything commits’ no crime. The BA 64 issue is Gods blessings and time has indeed come, freedom.

The magistrate court is not the final legal institution, we shall appeal, more so because the Zambian law has no legal effect on an international or treaty law- The BA which supported by the provisions of of the International Covenant on Civil and Political Rights, 1976 and the Charter of the UN, 1945 which both guarantee the right to self determination which include secession.

  5. Publication of false news? Does Zed have such a law? These must be the first Zambians to be ever convicted of such a charge

    • Baba, IGNORANCE of the LAW is NO DEFENSE. In other words, just because you are unaware of the existence of a particular/certain law does not mean you can plead “$TUP!D” in court and walk!

  6. Hoe people waste their time on trivials. And you believe Barotseland will take you to heaven?

  7. People of Zambia, President Sata sent a commission of inquiries but what were the findings and why is it getting difficult to release the results of the BRE. So many Commissions of Inquiries were set and tax payers money has been spend but it is difficulty for the PF government to release them at once.

    Many people have lost interest in PF way of taking serious Issues affecting the citizens of Zambia.
