Sakwiba Sikota urges ACC to prosecute Shamenda

Prominent Lawyer Sakwiba Sikota has challenged the Anti-Corruption Commission (ACC) to prosecute Labour Minister Fackson Shamenda for failing to report an alleged bribe offer within 24 hours in line with section 39 Sub-section 1 of the Anti Corruption Act No.3 of 2012.

Mr. Shamenda has been recently quoted in the some sections of the media as saying that he is ready to go to prison if refusing a bribe is a crime following the indication by the ACC that it had not instituted investigations on the allegations he made against Dangote official, Bala Zango.

Mr. Sikota who is also United Liberal Party President says in view of the clear provisions of section 39 Sub-section 1 of the Anti Corruption Act, Mr. Shamenda did commit an offence and should be prosecuted.

Mr. Sikota has told Qfm News in an interview that if the ACC does not take up the matter, people will lose confidence in the institution.

He adds that based on the statement by Mr. Shamenda himself, it is also open for any member of the public to make a complaint to the Acting Chief Justice for a tribunal to be set up to probe the Labour and Social Security Minister.

Mr. Sikota says this is because Mr. Shamenda’s conducts amounts to breach of the Ministerial Code of Conduct.

He explains that Mr. Shamenda has admitted to having breached the law when failed to report the alleged bribe offer within lawful time of 24 hours.

    Its about time corruption had no legs to stand on and Shamenda should be prosecuted for entertaining corruption.
    PF is a problem and seriously shocking that he even yapping.

    • Shamenda should be ashamed of himself. After voting section 39 Sub-section 1 of the Anti Corruption Act No.3 of 2012 he turns out to be the first one to breach it.
      He needs to dropped from the cabinet and his seat nullified straight away. To the contrary this can never happen under PF as long as he is staunch PF cadre.

      PF is corrupt and its a party for corrupt people. Starting with Sata himself , he is the most corrupt leader Zambia will ever have. Chiluba was corrupt because of Sata’s influence.

      Opposition MPs’ seats were nullified under the pretext of corruption without criminal conviction and yet Masumba, Mwewa, and the other two who bought a second hand vehicle ,are still holding on to their parley seats despite being found wanting. Only f00lish PF cadres do not consider this…

  2. You are asking too much of this toothless organisation which has to ask permission from the absentee landlord before it can institute an investigation against a minister. Even if they investigate him, it will be all for show to shut people up. This is the most useless group of leaders ever assembled anywhere on earth. By the way when are they going to show the president walking again so we can applaud him?

  3. imagine how swift the ACC could have moved to arrest any opposition leader if they were involved in such a crime. Because shamenda is a minister ,the ACC has developed cold feets,and a tail between its immoral legs. The minister should be arrested and sent to jail to join steven masumba,criminals.

    We shouldn’t leave everything to Chengala or Harrington, even Sikota himself can initiate the process of formation of a tribunal.
    Shamenda wont be prosecuted for refusing a bribe but because of failure to report the incidence within 24hrs as the law stipulates……….

  6. Shamenda deserves respect. ACC also does not need advise on who needs to be arrested. Allow professionalism to do its work. Or are these just jokes between two old friendly cousins? It is hard to make distinction.

      According to HH critics PF has amassed so much debt for development projects. The next administration will need to clear those debts.

      So please, do tell; where is HH going to find money for Free Education AND Putting more money into people’s pocket?

      It’s a lie for the gullible. To enjoy our developments we will need to be paying for them by increased taxation of some sort. That is why this article is correct in demanding corruption be dealt with. We need a gov’t that will mandate against these type of people not promise the Shanghai-La. Fantasy dreams.

      That was ‘not promise Shangri-La.’

      Just to add we need Parties to show their ‘clean hands’ by saying what they will do to deal with corruption among them. It’s easy to criticise PF, but I bet all opposition go to bed dreaming of the ‘huge pie’ they might get their hands on! They are not going to tackle corruption as strongly as in the current trend with PF.

      You are absolutely right on the issue.

      As for @patriotic abroad, HH and his team are resolute on bringing back sanity on the way Zambian resources can be managed with out too much borrowing like PF.

      HH and his team will track down all companies owned by PF affiliates and collect all the taxes owed without fail and use that money to fund some of the projects in the manifesto. Apart from that they will clump down on ZRA massive corruption to increase tax revenue so the country can regain its international financial credibility which seems to dented by the PF CNPs.

      UPND in government will be well funded by donors for they know HH is a credible economic manager with internationally recognised reputation to be trusted with donor funding.

      From now on PF won’t get…

  8. We need PF to continue ruling a country with a strongly empowered ZRA and ACC to deal with corruption in gov’t and generally.

    Lately we have had brave steps taken by ZRA to claim our taxes. We need more bravado from ZRA. We approve of VAT Rule 18. Rule 18 may seem like a ‘caper,’ but that’s the type of desperation we want from a taxing body. Collect, collect. GO ZRA, GO ACC! That should be the motto for every Zambian citizen. We need to get our money!

      Are u hallucinating or not? Which ZRA and ACC is empowered?These two institutions are good for nothing for they only swing into action to punish the opponents of PF. They came hard on Zambeef because they thought HH has shares in Zambeef and yet he got rid of them a while ago. HH knew that Zambeef would be targeted by PF once he became prominent in politics.

      The Mmembe issue is dead and buried now for they need Mmembe in 2016. So they will be forced to write off the post ‘s debts like they did in 2011 when PF came to power.

      Now I wonder how many PF affiliates’ companies are having their tax bills written off at the expense of the poor Market traders who constantly get raided and their goods seized by ZRA, and yet they owe tax in hundreds not billions like…
