Attorney General accuses Mutembo of undermining the tribunal

ATTORNEY General Likando Kalaluka has accused suspended Director of Public Prosecutions (DPP) Mutembo Nchito of trying to undermine the tribunal investigating him.

Mr. Kalaluka has since asked the tribunal, which is sitting in Lusaka, to dismiss preliminary issues raised by Mr Nchito.

Making his preliminary submissions this morning before the tribunal, Mr. Kalaluka said Mr Nchito’s preliminary issues must be dismissed because they lack merit.

Mr. Nchito has raised three preliminary issues, namely his opposition to have Justices Ernest Sakala and Mathew Ngulube as part of the tribunal and he is also disputing the terms of reference for the tribunal.

Mr Nchito also wants the tribunal proceedings not to be held in camera.

But Mr Kalaluka has instead accused Mr Nchito of trying to undermine the credibility of some members of the tribunal, a situation, which should not be entertained.

He has further asked the tribunal not to entertain Mr Nchito’s concerns about the terms of reference of the tribunal, saying there is no law in the country that spells out how these should be made.

Mr Kalaluka has further told the tribunal that the state has no problems in having the tribunal proceedings held under any condition, whether under camera or not.

The Attorney-General has however stated that there is already precedence of such tribunal proceedings investigating past DPPs being held under camera.

Meanwhile, the proceedings of the tribunal have continued.

President Edgar Lungu constituted a tribunal, comprising former Chief Justices, Annel Silungwe, Ernest Sakala And Mathews Ngulube, with Mathews Zulu as Tribunal Secretary, to probe Mr. Nchito for alleged professional misconduct.

  1. Please arrest this Mutembo Nchito he is a criminal. I was shocked that people like Mulongoti want to defend a dangerous criminal. Fred Mmembe and Mutembo Nchito are a danger to public order and security. We need to cage both immediately. Mwabombeni Ba Kalaluka

    • I think it is unfair to label Nchito a dangerous criminal. Who has murdered? There are cadres out there who have harmed others and those are the dangerous criminals. Mutembo has been accused of various offfences but he is not a dangerous criminal.

    • On top of it all, how man PF officials have been stealing and deserve to be equally probed before such a triunal?

    • Nchito is a criminal with blood of many innocents in his hands. It’s time to turn down a chapter of malice and hatred perpetuated by M’membe and Nchito. The blood of innocent professional Mukelabai framed up, chased from office then murdered in cold blood in a hotel is on his head haunting with tenacity. We are better off to let go of 2 evil souls than ruin our country. He is better donated to crockdiles in Lipompo river. The 2 xenophobs only fit the league of Zulu muraldes busy murdering innocent people today across South Africa.

    • Ba Mubanga, criminals are the ones who want to remove the DPP. Don’t just shout like a cadre. Think like a man. If he is a criminal, please prove it!
      When Newton broke the law in Chongwe – that is criminality. When the IG refused to obey a High Court Order – that is criminal. So what has Mutembo done that is criminal? He is defending himself using the law.
      EL is not greater than Zambia so that we bow down and worship him! He and RB must not be allowed to break the law becoa they hate Mutembo. They will be exposed, as we have started hearing from Brebner Changala. So that letter “requesting” for a tribunal was written for him!

    Case of Mutembo affects all tribes and has no tribal undertones to be brought into the fore.
    Mutembo is just playing monkey hide and sick tree jumping games.
    Whatever his trying to do will not do but to allow the tribunal to sit and investigate him. The Constitution has no provision which which shields DPP from investigation. Instead it says where the DPP acts contrary to public interest, the president shall appoint a tribunal. This provision removes the perception that he cannot be investigated for transgression. This is what happens when a street or desk lawyer is picked and supported by a night school lawyer Mmembe=: misunderstanding the law.

    • The Chair of this Tribunal should put his foot down and stop the nonsense this Mutembo Nchito is trying to stage manage just to buy time and win unsuspecting Zambians to be on his side as if he is being persecuted.This guy has done enough damage to a number of peoples lives and should allow the Tribunal to clear him or nail him.

      However, the same tactics which Nchito is using in this proceedings are also used by “learned” Solicitor General in other proceedings.

      Can you please clarify if such tactics are to be condemned generaly or just in this particular case?

    • DjR. Mutembo has not refused to be probed. Infact he has asked to be probed in the open and not in secret. Unlike you, he knows his rights & he knows the law.
      In order to have a free and fair tribunal, THE LAW GUARANTEES that where you can prove bias or the appearance of bias, a judge should recuse himself. This ensures fairness. That is what he is asking. Why should he hang himself, knowing that CJ’s Ngulube & Sakala hate him?
      It is also clear that EL wants to fix him. Maybe he is afraid becoz of the many scandals that are coming out, like the construction money stolen (from KK Airport refurbishment). That is why the want Mutembo out at all costs?
      Let the AG argue based on the law & not crying about!

  5. RB and his son will now go Scot-free and his corruption will never be talked about for as long EL reigns. Even though Mutembo has cases and issues to answer, the manner in which these issues have transpired does not mean well and they are setting a bad precedent. I hope Mutembo will come down and let the tribunal take its course and see how things unfold.

Yeah, “What goes around comes……………………….!” Mutombe Nchito is getting what he deserves! How many lives has he destroyed, together with his “pansy” friend of some known tabloid? Let him clear himself. He wanted a tribunal, didn’t he?

    • #4, What bad precedence are talking about? The English law works on Preceedence. The country has a Precedence of Nchito chasing Mukelabai Mukelabai from the same position all the way into murdering in a hotel room. Held his tribunal under camera and the same Nchito refusing to recuse himself in the M’members cases. So the tribunal is evoking the same precedences Period! Criminals are criminals that is why the law pursues them, arrest or purge them life if they dare run away from justice.

      Ba Senior Citizen, if Mukelebai did not want to ask for an open tribunal, that was his decision. Why should it be binding on everyone else?
      The law is very clear. A secret trial is the EXCEPTION and not the rule.
      Mutembo knows his rights. He is not like you who worship authority even if they are busy walking all over you!
      Follow the law, if he is guilty. But don’t step on his rights.

  7. We trust that the Silungwe Tribunal is comprised of some of the best legal brains in Zambia. Taking into account that three of them held the post of Chief Justice, we believe that the Tribunal will ably manage Mutembo Nchito’s legal trickery.

    Indeed, Nchito will be given enough rope to hang himself. At the end of the day, Zambians will have legally and democratically cleaned up the mess that the Cartel infested on this land.

  8. As a country we seem to have very short memories. Here we are talking about set precedence a matter that was contested then as it went against constitutional provisions. Two wrongs cannot make a right. People may not like Mutembo but that doesnt mean he should not be granted justice.   10. Indeed Mutembo Nchito and Fred Membe are criminals who deserve to be in prison for a lot of things. These chaps has caused a lot deaths and pains in lot innocent upright zambians including Army Generals who have mentally touchered by two fools, this is his time to dance to his own music, the chap should be removed and prosecuted sent to jail, you can not have two fools to hold the whole country at ransom that is dangerous and all these problems were caused by LEVY MWANAWASA AND SATA because of there politics of hate and vengeance no wonder they are dead, God can not allow such type leaders to leave for a long time because they became danger to the security of the nation

  11. After Mtembo has been removed as DPP, the price of all essential commodities will go down bt 50%, there will be more medicines in Hospitals, all Zambians will receive a pay rise, the poor will be assured of three meals per day and all of Zambia’s debt will be paid in full.
    So EL remove this guy and lock him up in prison so we can start to enjoy the benefits that comes from his removal.

  12. We know that Mutembo regards himself as a surrogate President of Zambia. The tribunal chair must make it abundantly clear that neither he nor any of the tribunal members are prepared to be accomplices of the crimes committed by Nchito and the cartel. Now get this straight folks… The terms of reference are clear, let the cleansing begin without further delay!

    • Who ever is desecreting the name of “Capt Thomas Sankara”, If the terms of reference are so clear, why is the AG & Solistor General failing to argue their points using the law?
      Justices Ngulube & Sakala left the bench in dubious circumstances. Nothing will change that. The law forbids them from sitting on that tribunal. We all know that.
      Don’t be cowards. Fight Mutembo like men, using the law. Not this underhand nonesense we are seeing from EL & RB.
      Those people who have suffered at Mutembo’s hands are the corrupt, like Richard Sakala. I suppose those who received funding for their elections are also worried. The terms are clear? As clear as Planting Drugs & Forging judgements? Without evidence? The truth has already started coming out. People made to signing fake letters to EL!

    Lusaka- Zambia (PANA) — The lawyer who gained prominence by beginning the prosecution of former Zambian president Frederick Chiluba for allegedly stealing millions of dollars from the treasury has died in Cape Town, South Africa, where he got employment after being retired by the government in Lusaka.
    Mukelabai Mukelabai, 45, was found dead on Thursday afternoon in his Cape Town apartment after failing to report for work at the Institute for Security Studies for three days.
    His Lusaka-based brother, Liyeli Mukelabai, confirmed the death of the high profile lawyer, while the Times of Zambia quoted a co-worker, Anita Hubschire, as saying that the former Zambian director of public prosecutions had failed to report for work and respond to…
